Dear Mr. Smith:
The Division received your application for a wastewater discharge permit on May 10, 2004.
Division personnel have reviewed and approved your application. Accordingly, we are forwarding
the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North
Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina
and the U.S. Environmental Protection Agency dated May 2004, and as subsequently amended.
This permit contains two (2) substantial changes:
> Because aluminum sulfate is used in the wastewater treatment process, an aluminum
monitoring requirement has been added to this permit. If you decide to replace aluminum
sulfate as the agent for the chemical phosphorus removal, then at such time you may
request a permit modification to have the aluminum monitoring requirement removed from
the permit.
> The United States Environmental Protection Agency (US EPA), based on findings from
epidemiological studies, has developed new water quality criteria for enterococci in both
freshwater and marine waters. As a result, the subject permit has a limit and monitoring
requirements for enterococci. Currently, the US EPA does not have validated enterococci
methods for use in effluent matrices. The Agency is in the process of trying to validate
methods for use with wastewater effluent. Because the US EPA has not yet
promulgated/approved testing methods for use in effluent matrices, the monitoring
requirement will not be required until March 1, 2006. The enterococci monthly average limit
will take effect beginning March 1, 2007. [See Permit Condition A. (4.)1
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within
thirty (30) days following receipt of this letter. This request must be in the form of a written
petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the
Office of Administrative Hearings, Post Office Drawer 27447, Raleigh, North Carolina 27611-7447.
Unless such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may
require modification or revocation and reissuance of the permit.

to receiving waters designated as the Pungo River in the Tar -Pamlico River Basin
in accordance with effluent limits, monitoring requirements, and other conditions set
forth in Parts I, II, III and IV hereof.
This permit shall become effective April 1, 2005.
This permit and authorization to discharge shall expire at midnight on November 30, 2009.

All previous NPDES permits issued to this facility, whether for operation or discharge are hereby
revoked. As of this permit issuance, any previously issued permit bearing this number is no longer
effective. Therefore, the exclusive authority to operate and discharge from this facility arises under the
permit conditions, requirements, terms, and provisions included herein.
Dowry Creek Community Association, Inc.
is hereby authorized to:
1. Continue to operate an existing 0.05 MGD dual -train package plant wastewater
treatment system consisting of the following components:
■ Influent flow equalization
■ Aerated surge tank
■ Bar screen
■ Flow splitter box
■ Dual diffused -air aeration tanks
■ Dual clarifiers with aluminum sulfate feed for chemical phosphorus removal
• Tablet chlorinator and contact chamber
■ Effluent flow measurement by V-notch weir with a float gauge recorder and
totalizer
• Effluent pump tank and aerobic digester
• Tablet dechlorination and post -aeration
The facility is located at the Dowry Creek WWTP on Bible Shores Road /
Spinnaker Run Road east of Belhaven in Beaufort County.
2. Discharge from said treatment works at the location specified on the attached map
into the Pungo River, classified SB-NSW waters in the Tar -Pamlico River Basin.

A. (1.) EFFLUENT LIMITS AND MONITORING REQUIREMENTS — FINAL
During the period beginning on the effective date of the permit and lasting until expiration, the
permittee is authorized to discharge from outfall 001 into the Pungo River from a diffuser assembly
located at a minimum water depth of six (6) feet. Such discharges shall be limited and monitored
by the permittee as specified below:

A. (2.) Nutrient Reduction Requirement
The Tar -Pamlico Nutrient Sensitive Waters (NSW) Implementation Strategy requires a total reduction
in nutrients (total phosphorus and total nitrogen) within the Tar -Pamlico River basin.
If requirements other than those listed in this permit are adopted as part of a future revision to the
NSW strategy, the Division reserves the right to reopen this permit and include those requirements.
If requirements other than those listed in this permit are adopted to prevent localized adverse impacts
to water quality, the Division reserves the right to reopen this permit and include those requirements.

A. (3.) WARNING SIGN REQUIREMENTS
The permittee shall install and properly maintain a warning sign at the end of the diffuser assembly.
The sign should:
> have white letters on a red background
> identify the diffuser as a submerged utility line
> urge caution in the area
> clearly identify the name and telephone number of the permittee so that the public can report
any problems that might occur.
The permittee will ensure that the sign remains visible and legible.
A. (4.) NEW WATER QUALITY CRITERIA REQUIREMENTS
Based on findings from recent epidemiological studies, the United States Environmental Protection
Agency (US EPA) has developed new water quality criteria for enterococci in both freshwater and
marine waters. Enterococci are enteric bacteria used to indicate fecal contamination and the possible
presence of pathogens in water. Currently, the US EPA does not have validated enterococci methods
for use in effluent matrices. The Agency is in the process of trying to validate methods for use with
wastewater effluent. As a result of the new US EPA water quality criteria and because the US EPA has
not yet promulgated/approved testing methods for use in effluent matrices, the permittee will have
limits and monitoring requirements for enterococci as follows:
> Beginning March 1, 2006, the permittee shall monitor for Enterococci on a weekly basis (with
no effluent limit) as required by condition A. (1.) above; and
> Beginning March 1, 2007, the monthly average limit for Enterococci shall take effect as
required by condition A. (1.) above.

NOTIFICATION OF INTENT TO ISSUE A NPDES
WASTEWATER PERMIT
On the basis of thorough staff review and application
of NC General Statute 143.21, Public law 92-500 and
other lawful standards and regulations, the North Caro-
lina Environmental Management Commission proposes to
issue a National Pollutant Discharge Elimination System
(NPDES) wastewater discharge permit to the person(s)
listed below effective 45 days from the publish date of
this notice.
Written comments regarding the proposed permit will
be accepted until 30 days after the publish date of this
notice. All comments received prior to that date are con-
sidered in the final determinations regarding the proposed
permit. The Director of the NC Division of Water Quality
may decide to hold a public meeting for the proposed
permit should the Division receive a significant degree of
public interest.
Copies of the draft permit and other supporting infor-
mation on file used to determine conditions present in
the draft permit are available upon request and payment
of the costs of reproduction. Mail comments and/or re-

discharge may affect future allocations to this portion of
the receiving stream.
Dowry Creek Community Association, Inc. (PO Box 711,
Belhaven, NC 27810) has applied for renewal of NPEDS
permit NC00; :i 426 for Dowry Creek WWTP in Beaufort
County. This permitted facility discharges 0.05 MGD
treated wastewater to Pungo River in the Tar -Pamlico River
Basin. Currently BOD, ammonia nitrogen, total residual
chlorine, enterococci, total nitrogen and total phospho-
rus are water quality limited. This discharge may affect
future allocations in this portion of the Tar -Pamlico River
Basin.

Enclosed with this letter is a copy of the draft permit for your facility. Please review the draft very carefully to
ensure a thorough understanding of the conditions and requirements it contains.
Your permit is among several in the Tar -Pamlico River Basin the Division of Water Quality (Division) has
targeted for expedited renewal. No major changes have taken place to the Division's management strategy for
the Tar -Pamlico River. The Division can therefore expedite renewal of permits in the Tar -Pamlico River Basin
whose operations have not changed since the last permit renewal, and whose compliance records are in good
standing.
This draft permit contains two (2) substantial changes from the existing permit:
> Because aluminum sulfate is used in the wastewater treatment process, an Aluminum monitoring
requirement has been added to this permit.
> The United States Environmental Protection Agency (US EPA), based on findings from epidemiological
studies, has developed new water quality criteria for enterococci in both freshwater and marine waters.

will not be required until twelve (12) months after the effective date of the permit. Twenty-four (24)
months following the effective date of this permit, the enterococci monthly average limit will take effect.

marine waters. Enterococci are enteric bacteria used to indicate fecal contamination and the possible
presence of pathogens in water. Currently, the US EPA does not have validated enterococci methods
for use in effluent matrices. The Agency is in the process of trying to validate methods for use with
wastewater effluent. As a result of the new US EPA water quality criteria and because the US EPA has
not yet promulgated/approved testing methods for use in effluent matrices, the permittee will have
limits and monitoring requirements for enterococci as follows:
> Twelve (12) months following the effective date of this permit, the permittee shall monitor for
Enterococci on a weekly basis (with no effluent limit) as required by condition A. (1.) above; and
> Twenty-four (24) months following the effective date of this permit, the monthly average limit
for Enterococci shall take effect.

permit. Enclosed are the original and two copies each of the completed application and
narrative description of the sludge management plan for the facility and two copiesof this
renewal request.
In reference to a phone conversation with Dave Goodrich- on May 6, 2004, note that on
question #10 we were advised to check (NO), on question #1 we wre advised to enter the
name of our ORC, Max O'Neal, and- on question #5 we -were advised to check residental
and other and note that other represents a marina, club house and pool facility to which
we provide sewage treatment service.
There has not been any changes at the facility since the issuance of the last permit.

Dear Mr. Whitley,
In August 1996, Harbour Pointe Associates, Inc:,the former owner of the Dowry Creek
WWTP, entered into an agreement with Atlantic Nutrients,Inc. d/b/a Atlantic Sewage
Control, 4013 Marlins Point Road,Kitty Hawk,NC 27949,to add Dowry Creek WWTP to
their sludge permit for hauling and disposal. We were notified that on February 28,1997,
the State had approved Dowry Creek WWTP as an add on -to Atlantic
Nutrients,Inc. sludge permit #WQ0000974.
Under the agreement, a sludge analysis will beperformed annually,or at the time of
sludge removal,if less than annually,in accordance with DEM requirements. Sludge
stabilization and vector attraction reduction shallbe performed at Dowry Creek WWTP
prior to sludge hauling in accordance with DEM requirements.
