Dave asked me to respond to your questions about this site.
1. They'll need an AtC for the new outfall line. Outfall relocations typically require a major permit modification;
however, this outfall isn't being relocated to a new stream. The permittee is apprently re-establishing the existing outfall
in response to DOT's work.
2. Lmits and monitoring will remain the same.
3. Unless a better alternative exists, we would permit the discharge.
We strongly encourage the permittee to check with Wildlife Resources prior to submitting plans, etc. We do not need
another debacle like the Camden County WTP.

Chowan County
Please find attached the letter from Mr. Luther Copeland, County Manager, with the County of Chowan.
The County owns and operates the Valhalla WTP. Some years back, DOT changed the drainage pattern of
Highway 37 which cutoff the discharge of the wastewater. This office did not realize this until a couple of
years ago. The plant now dumps their backwash water into their settling pond, which is connected to the
roadside drainage ditch along Hwy. 37. However this drainage does not go anywhere. Therefore the
wastewater seeps into the ground and evaporates from the settling pond. The WTP, prior to the DOT work,
discharged their water into the roadside drainage ditch and it flowed under the road and discharged to
Rockyhock Creek.
At this time, the County proposes to move their discharge downstream from where they use to discharge
into. The new discharge will be located at N36 degrees 08' 20" and W76 degrees 39' 59". The force main
will run along Hwy. 37 and NCSR 1222 and then discharge into Rockyhock Creek.
The questions that we ask you are:
1. What is the permitting process? A to C, modification to existing permit, or new NPDES
Permit
2. Will the monitoring parameters and limits change?
3. Will we allow this discharge?

As we recently discussed, the County of Chowan is proposing to move the discharge Location of
the referenced permit to a point downstream of the Bennett's Mill Pond dam. The proposed
discharge location coordinates arc:
N 36° 08' 20"
W 76° 39' 59"
We are also proposing to abandon the existing borrow pit and route the plant discharge to a
treatment facility which will settle solids to reduce TSS and TSR prior to pumping the supernate
to the referenced discharge location. We would like to perform these outlined improvements by
the ATC process by submitting completed plans and specifications for your approval and then
constructing the facilities.
We would appreciate your assistance and guidelines in this matter. Please let me know if I can
provide further information.

Dear Mr. Goodwin:
In response to your June 4, 1999 letter concerning the discharge point of your treatment
pond, this office has reviewed the information and would like to see the discharge point
downstream of Bennett Millpond. The closest point to accomplish this task is where you and Mr.
Bill Diehl showed Brad Shaver and myself at the bridge on NCSR 1212. It is also apparent that
the intermittent stream where you once discharged is now located on adjacent property of a
private single family. This discharge point may be difficult to get to now.
Your discharge permit allows the discharge of treated waste to an unnamed tributary to
Rockyhock Creek. You will not be required to get a new NPDES permit since the receiving
stream has not changed. However, an Authorization to Construct (A to C) is necessary to build
the discharge line to Rockyhock Creek. Attached is submittal requirements for the A to C
process.
The County should proceed with this project in order to achieve compliance with their
NPDES permit or should apply for a Non discharge permit. If you should have any questions,
