Dear Mr. Copeland:
Division personnel have reviewed and approved your application for the subject permit. Accordingly, we are
forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North
Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S.
Environmental Protection Agency dated October 15, 2007 (or as subsequently amended).
The issued permit has the following changes from the September, 26, 2007 draft permit:
> The Division verified that an unnamed tributary to Pollock Swamp is the correct receiving stream and made
the appropriate corrections to the affect text, coordinates. and water classification.
> The chloride compliance limit was changed to a Daily Maximum.
➢ The chloride measurement frequency was changed to 2/Month.
➢ The flow compliance limit was changed to 0.060 MGD Monthly Average Maximum.
> Narrative corrections were made, footnotes and A(2), to clarify the permit requirements.
It is strongly recommended that a plan be initiated to address the toxicity test failures. Future renewed permits may
include toxicity compliance limit if toxicity test failures are persistent.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you
have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter.
This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General
Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina
27699-6714). Unless such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may require
modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain
other permits which may be required by the Division of Water Quality or permits required by the Division of Land
Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that may be
required.

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES Permits issued to this facility, whether for operation or discharge are hereby revoked. As of this permit
issuance, any previously issued permit bearing this number is no Ionger effective. Therefore, the exclusive authority to
operate and discharge from this facility arises under the permit conditions, requirements, terms, and provisions included

2. For instantaneous flow monitoring, the duration of the discharge must be reported in addition to the total flow.

The facility shall report all effluent TRC values reported by a NC certified laboratory including field certified.
However, effluent values below 50 µg/L will be treated as zero for compliance purposes.
4. Chronic Toxicity (Ceriodaphnia) monitor only at 90.0%; February, May, August, November; See Special Condition A (2)
of the Supplement to Effluent Limitations.
All samples collected should be of a representative discharge.
There shall be no discharge of floating solids or foam visible in other than trace amounts.

A(2). CHRONIC TOXICITY MONITORING (QRTRLY)
The permittee shall conduct quarterly chronic toxicity tests using test procedures outlined in the "North
Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent
versions.
The effluent concentration defined as treatment two in the procedure document is 90%. The testing shall be
performed as a Ceriodaphnia dubia 7 day pass/fail test. The tests will be performed during the months of
February, May, August, and November. Effluent sampling for this testing shall be performed at the
NPDES permitted final effluent discharge below all treatment processes.
All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge
Monitoring Form (MR-1) for the month in which it was performed, using the parameter code TGP3B.
Additionally, DWQ Form AT-1 (original) is to be sent to the following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no later than
30 days after the end of the reporting period for which the report is made.
Test data shall be complete and accurate and include all supporting chemical/physical measurements
performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine of
the effluent toxicity sample must be measured and reported if chlorine or a chlorine derivative is employed
for disinfection of the waste stream.
Should there be no discharge of flow from the facility during a month in which toxicity monitoring is
required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form
indicating the facility name, permit number, pipe number, county, and the month/year of the report with the
notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental
Sciences Section at the address cited above.
Should the permittee fail to monitor during a month in which toxicity monitoring is required, then monthly
monitoring will begin immediately. Upon submission of a valid test, this monthly test requirement will
revert to quarterly in the months specified above.
Should any test data from this monitoring requirement or tests performed by the North Carolina Division of
Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified
to include alternate monitoring requirements or limits.
If the Permittee monitors any pollutant more frequently then required by this permit, the results of such
monitoring shall be included in the calculation & reporting of the data submitted on the DMR & all AT
Forms submitted.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control
organism survival, minimum control organism reproduction, and appropriate environmental controls, shall
constitute an invalid test and will require immediate follow-up testing to be completed no later than the last
day of the month following the month of the initial monitoring.

Summary
Chowan County operates the Valhala WTP. The water treatment process consists of groundwater
wells, aeration, detention, filtration, and ion exchange softener. The backwash from the softeners
is treated on a settling pond and discharged to an unnamed tributary to Pollock Swamp. The
active permit was issued on September 2006 with an expiration date of November 30, 2007.

Proposed Modifications
• Total residual chlorine limit - the permit has the incorrect units for the TRC limit. The limit
was corrected to 17 µg/I instead of 17 mg/1.
• Total Zinc - Monitoring was eliminated from the permit, all reported values were less than
10 µg/ 1.
• Total lead - Monitoring for total lead was eliminated, all reported values were less than 5
µg/l.
• Chloride - A limit of 230 mg/I was implemented based on reasonable potential to exceed the
water quality standard.
• As per the Division's water treatment guidance a flow limit was implemented in the permit.
The renewal application indicated the facility is designed for a backwash reject flow of 0.05 MGD.
Final Modifications
After review of DMR data it was determined that the permittee would have been
out of compliance with the 0.05 MGD monthly average limit 11 out of the last 12
months. Because of other concerns the region has requested that the monthly
average permitted flow be set no higher than 0.060 MGD. With 0.0600 MGD as
the new limit the permittee would have been out of compliance 3 times in the
last 24 months The renewed permit will set 0.060 MGD as the permitted flow
limit.

Al,
As we discussed during the current renewal cycle WTPs are being assigned a permitted
flow. In several cases we have alerted the permittee and region that the application
data and actual DMR data indicates the potential to routinely exceed the implicated
MGD flow. Accordingly, we have made adjustments.
In the case of Valhalla we do want to grant a capacity increase wee it is not
applicable so we will assign as agreed a monthly average of 0.060 MGD as the
compliance permitted flow.
FYI...Based on the last 24 months (April 06 - 08) Valhalla WTP would have exceeded
the monthly 0.060 MGD 3 months out of the 24, the last exceedance in April 2007. In
the application they stated 0.050 MGD as the monthly flow. In the 1998 Fact Sheet it
states 0.055 MGD as the monthly design discharge flow.
If you have any questions let me know. Hopefully the final permit will go out this
week.

it looks like to me they expanded the use of this plant without a permit
modification.* i do not support an expansion of the discharge at this location.
*they have ask for a renewal not an expansion. there are records in our files that
at one time they did have a discharge limit of 60,000 gpd we may have changed it,
i don't know?
the region should have been sending nov's for the permit violation. the
regional supervisor(whoever he is) told the staff to concentrate on npdes systems
with an 02 uptake parameter.

Al & Kristin,
After discussing the Chronic Toxicity Limit change with the senior permit writers and
reviewing the current WTP guidance it was pointed out to me that we should not be
imposing a Chronic Toxicity Limit. We can include language in the cover letter
stating the continued failure of the toxicity test would most likely result in a
toxicity compliance limit in the next permit renewal. Please advise if want this
language included.
Kristin and I discussed this as well as the original information I had provided on
any WTPs with toxicity limits. I went back and conducted a second review of the WTPs
that had assigned toxicity actions in their permits, my findings were as follows:
1) There are currently 57 WTPs in the state with some form of toxicity actions in
their permit.
2) Out of the 57 WTPs, 52 have toxicity monitoring only, 5 have toxicity limits.
3) However, the 5 WTPs that received toxicity limits should have received monitoring
only. There has been no issues with the 5 permits with limits because either they
have no discharges (no DMR report) todate or they have been able to pass toxicity.
Out of the 5 with limits, 2 are in your region ( NC0088480,NC0088455, no discharges
reported).
Sorry about the confusion.
On another matter the chloride limit monitoring frequency should be 2/Month not
monthly. Also, the chloride limit should be a Daily Max.
As requested by Kristin I will forward an electronic copy of the final permit and
cover letter.

Kristin,
Based on Teresa notes the following changes were going to be incorporated into the
renewed permit:
1) TRC limit units would be corrected to 17 µg/L.
2) Total Zinc and Total Lead monitoring requirements would be removed since DMR data
evaluation indicate these metals concentration are not significant.
3) Chloride limit of 230 mg/L maximum would be imposed since DMR data evaluation
indicated this compound concentration could exceed the water quality standard.
4) A permitted flow, 0.050 MGD monthly average, would be established as limit per DWQ
policy.
This is currently in a freshwater class. It is a zero flow situation which is why the
TRC limit is set at 17 µg/L. Other rational for setting limits or monitoring or
special conditions depends on the basin plan, other agencies recommendations, etc. I
am not aware of any at this time other than what you and Al have mentioned, cleaning
of the lagoon/pit.

water (White Oak Basin)but has passed all its tests. The other 2 WTPs have no
WET test violations.

the WET test. I have attached the Chronic WET Test Limit page for
your review. Please note it basically requires the permittee to do
more testing. There is a statement in this text that allows further

Summary
Chowan County operates the Valhala WTP. The water treatment process consists of groundwater
wells, aeration, detention, filtration, and ion exchange softener. The backwash from the softeners
is treated by a settling pond and discharged to an unnamed tributary to Rockyhock Creek. The
active permit was issued on September 2006 with an expiration date of November 30, 2007.

Whole Effluent Toxicity - The permit requires chronic test (ceriodaphnia) at 90 % effluent
concentration. The facility has failed four consecutive quarterly tests.

Proposed Modifications
• Total residual chlorine — the permit had the incorrect units for the TRC limit. The limit was
corrected to 17 µg/1 instead of 17 mg/1.
• Total Zinc — Monitoring was eliminated from the permit, all reported values were less than
10 µg/1.
• Total lead — Monitoring was eliminated from the permit, all reported values were less than 5
µg/1.
• Chloride — A limit of 230 mg/1 was implemented based on reasonable potential to exceed the
water quality standard.
• As per the Division's water treatment plant guidance a flow limit was implemented in the
permit. The renewal application indicated the facility is designed for a backwash reject flow
of 0.05 MGD.

4.4.2 Pollock Swamp [AU# 26-1-1-1] and Rockyhock Creek [AU# 25-22]
Pollock Swamp drains to Edenton Bay and Rockyhock Creek is a tributary to the Chowan River.
These waters were not monitored and are therefore not given use support ratings. Water quality
conditions are of concern here because Valhalla WTP (NC0032719) is discharging to an
unnamed tributary to the Pollock Swamp when they are permitted to discharge to Rockyhock
Creek. The facility is currently out of compliance with toxicity issues; the lagoon is leaking to
old borrow pits on the south side and may be contaminating surface waters. The plant holds a
temporary permit for the new discharge site, while the renewal permit is being processed for
discharge into the unnamed tributary of Pollock Swamp. The new permit will require toxicity
monitoring. DWQ recommends the lagoon be repaired and excess solids be cleaned out.
Pollock Swamp drains into Pembroke Creek (AU# 26-1-1) along the western edge of Edenton
and Queen Ann's Creek (AU # 26-1-2) flows along the eastern side of Edenton. Resource
agencies have identified these creeks as priority in need of riparian buffers, stormwater wetlands
and critical area plantings to improve water quality.
