This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated December 6, 1983. On October 16,1997, Washington Regional Office staff conducted a site visit which indicated that the settling lagoon at the plant is nearly filled to capacity with sludge. Although Chowan County is aware of the problem, the Division emphasizes the importance of remediating this problem especially because the Valhalla Plant has recently been modified to double capacity. In addition, please note the following: settleable solids is to be monitored at the effluent, turbidity is to be monitored instream, and the pH monitoring requirement has been eliminated from the permit. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, Post Office Drawer 27447, Raleigh, North Carolina 27611-7447. Unless such demand is made, this decision shall be final and binding. Please take note that this permit is not transferable. Part II, E.4. addresses the requirements to be followed in case of change in ownership or control of this discharge. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Quality or permits required by the Division of Land Resources or any other Federal or Local governmental permit that may be required. Continue to discharge from a facility (with a pond for solids settling) located at Valhalla Water Plant, intersection of NC Highway 32 & NCSR 1222, north of Valhalla, Chowan County (See Part III of this permit), and 2. Discharge filter backwash and softener backwash from said treatment works at the location specified on the attached map into an unnamed tributary to Rockyhock Creek (Class B-NSW) in the Chowan River Basin. A. EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS Permit No. NC0032719 During the period beginning on the effective date of the permit and lasting until expiration, the Permittee is authorized to discharge from outfall(s) serial number 001. If the turbidity exceeds these levels due to natural background conditions, the discharge level cannot cause any increase in the turbidity in the receiving water. All samples collected should be of a representative discharge. There shall be no discharge of floating solids or visible foam in other than trace amounts. NC0032719 Summary November 10, 1997 Chowan County -Valhalla WTP has applied to renew their permit to discharge backwash water to an unnamed tributary to Rockyhock Creek (B-NSW) in the Chowan River basin (030104). The WTP has three filters which are backwashed every day and two softeners which are backwashed every other day. The treatment system consists of a solids settling pond which rarely discharges. However, the pond is filling with solids and should be dredged in the near future to avoid a potential problem (M. Starr - staff report 971016). Compliance Summary Effluent data reviewed from January 1995 through August 1997 indicated no violations. However, the facility is not monitoring for settleable solids at the effluent and is monitoring for turbidity at the effluent not instream as is required in the permit. WLA Summary Permit will be renewed with the same standard WTP monitoring requirements. A prior staff report prepared by Lyn Hardison stated that there are high iron and manganese levels in the groundwater. Iron monitoring is required in the permit. Manganese has a water quality standard only in water supply waters, thus manganese monitoring will not be required. Note: The Valhalla WTP is doubling their capacity and thus, the Brahall WTP will only be used during periods of peak flow (M. Starr - phone conversation w/ P. Clark 971021). Other Special Items: PART IV - EVALUATION AND RECOMMENDATIONS An inspection was conducted at the Valhalla Water Treatment Plant. The results of the inspection indicate that the plant was in compliance with the limitations and conditions of the permit. In general, the plant is well maintained. The settling lagoon at the plant, however, is nearly filled to capacity with sludge. The Chowan County Water Department is aware of the problem, and a sludge disposal plan will be put in effect as soon as possible. It is of the utmost importance that sludge is cleared from the lagoon since the Valhalla Plant has recently been modified to double capacity, which will double sludge production. Currently the settling lagoon rarely discharges into surface waters, with the doubling of wastewater production, it is likely that discharges will occur more frequently. The effluent appeared clear and free of visible solids. A cursory review of data generation and tracking, sampling practices, and self -monitoring data revealed no discrepancies.
