After we spoke on the phone, I discussed the proposed expansion at Sapona with two of our
engineers. They believe we can issue the modification.
While the stream segment to which Sapona discharges in on the 303 (d) list [copy attached], the segment
is impaired for Copper. As long as the expansion at Sapona will not contribute to the cause of
impairment [add more copper into the stream], it can likely be permitted.
Permittees requesting flow expansions are asking for a Major Modification to their NPDES permit. Such
applicants must submit the following documents, at minimum:
NOTE: For all documents, the applicant must submit one original and two copies.
1. A completed application form [attached]. This is required by 40 CFR 122.21, NCGS 143-215.1, and
15A NCAC 02H.0105.
2. Modification fee of $260.00. Make checks payable to NC DENR. Application fees are non-
refundable [15A NCAC 02H.0105 (b)].
3. A completed Engineering Alternatives Analysis (EAA), required by 15A NCAC 02H.0105 (c)
(2). The EAA guidance document is attached.
4. 7Q10 streamflow data for the receiving stream from USGS [contact Curtis Weaver at 919 571-
4043], required by 15A NCAC 02B.0206. Permits for discharge of oxygen -consuming (e.g.
domestic) wastewater cannot be issued for streams with 7Q10 and 30Q2 flows estimated to be
zero.
