Dear Mr. Finley:
Division personnel have reviewed and approved your request for modification of the subject
permit. This permit modification authorizes the requested change from composite samples to grab
samples in Section A.(1.) of the above -referenced permit. The attached permit page should be placed in
the permit and the old page discarded. This permit modification is issued pursuant to the requirements
of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North
Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently
amended).

1. Upstream = at least 100 feet upstream from the outfall. Downstream = below the U.S. Highway 401 bridge.
2. The daily average dissolved oxygen effluent concentration shall not be less than 6.0 mg/L.
3. For a given wastewater sample, TN = TKN + NO2-N + NO3-N, where TN is Total Nitrogen and TKN is Total Kjeldahl
Nitrogen.
4. TN Load is the mass load of Total Nitrogen discharged in a given period of time [see condition A. (2)].
There shall be no discharge of floating solids or visible foam in other than trace amounts.

This letter is to follow up our phone conversation November 18, 2004.
According to the new permit, which was effective March 1, 2004 it requires
a monthly composite sample for Nitrate/Nitrite, TKN, Total Nitrogen and
Total Phosphorus. We feel this would not represent a true flow due to the
fact that the plant mainly operates during the daytime; there is very little
flow during the evening hours. This plant originally required grab samples,
which was probably due to the plant mainly operating during the day.
Enclosed please find the last six months of flow data as requested.
