Dear Mr. Finley:
Division personnel have reviewed and approved your application for
renewal of the subject permit. Accordingly, we are forwarding the attached
NPDES discharge permit. This permit is issued pursuant to the requirements
of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between North Carolina and the U.S. Environmental Protection Agency dated
October 15, 2007 (or as subsequently amended).
This final permit includes the following changes from the draft permit
sent to you on May 22, 2013:
> Based upon the comments submitted by your consultant (Heather Adams of
Envirolink, Inc.), the wording of Part I. A. (5) has been revised. One
report shall be submitted no later than July 30, 2014, documenting the
impact of the proposed operational changes to achieve consistent
compliance with the permit's BOD limits.
> Based upon the documents submitted by Ms. Adams, Part I. A. (6) has
been deleted.
> Based upon the comments and data submitted by Ms. Adams, Part I. A. (7)
has been revised. The "Industrial Waste Survey" shall be completed by
each new occupant within 60 days of occupancy. This requirement was
retained so that both you and the Division have proof that occupants
are not adding industrial wastes to the collection system, and also
that the existing documents regarding collection system use have been
distributed.
Please note that Swift Creek is listed as an impaired waterbody on the
North Carolina 303(d) Impaired Waters List. Addressing impaired waters is a
high priority with the Division; instream data will continue to be
evaluated. If there is noncompliance with this permit's effluent limits and
stream impairment can be attributed to your facility, then mitigative
measures may be required.

If any parts, measurement frequencies or sampling requirements
contained in this permit are unacceptable to you, you have the right to an
adjudicatory hearing upon written request within thirty (30) days following
receipt of this letter. This request must be in the form of a written
petition, conforming to Chapter 150B of the North Carolina General Statutes,
and filed with the Office of Administrative Hearings (6714 Mail Service
Center, Raleigh, North Carolina 27699-6714). Unless such demand is made,
this decision shall be final and binding.
Please note that this permit is not transferable except after notice
to the Division. The Division may require modification or revocation and
reissuance of the permit. This permit does not affect the legal
requirements to obtain other permits which may be required by the Division
of Water Quality or permits required by the Division of Land Resources, the
Coastal Area Management Act or any other Federal or Local governmental
permit that may be required.

In compliance with the provision of North Carolina General Statute 143-
215.1, other lawful standards and regulations promulgated and adopted by
the North Carolina Environmental Management Commission, and the Federal
Water Pollution Control Act, as amended,
Pope Industrial Park II LTD Partnership
is hereby authorized to discharge wastewater from a facility located
at the
Pope Industrial Park WWTP
5602 Fayetteville Road, south of Raleigh
Wake County
to receiving waters designated as and unnamed tributary to Swift
Creek in subbasin 03-04-02 of the Neuse River Basin in accordance
with effluent limitations, monitoring requirements, and other
conditions set forth in Parts I, II, III and IV hereof.
This permit shall become effective September 1, 2013.
This permit and authorization to discharge shall expire at midnight
on February 28, 2018.

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES Permits issued to this facility, whether for operation or
discharge are hereby revoked. As of this permit issuance, any previously issued
permit bearing this number is no longer effective. Therefore, the exclusive
authority to operate and discharge from this facility arises under the permit
conditions, requirements, terms, and provisions included herein.

Park WWTP off Fayetteville Road (Highway 401 South) in Wake
County.
2. Discharge from said treatment works via outfall 001 at the
location specified on the enclosed map into an unnamed tributary
to Swift Creek, currently classified WS-III NSW waters in
hydrologic unit 03020201 of the Neuse River Basin.

A. (2) CALCULATION OF TOTAL NITROGEN LOADS
1. The Permittee shall calculate monthly and annual TN Loads as follows:
(1) Monthly TN Load (pounds/month) = TN x TMF x 8.34
where:
TN = the average Total Nitrogen concentration (mg/L)
of the composite samples collected during the
month
TMF = the Total Monthly Flow of wastewater discharged
during the month (MG/month)
8.34= conversion factor, from (mg/L x MG) to pounds
(2) Annual'TN Load (pounds/year) = Sum of the 12 Monthly TN Loads for the
calendar year
2. The Permittee shall report monthly Total Nitrogen results (mg/L and
pounds/month) in the appropriate discharge monitoring report for each month
and shall report each year's annual results (pounds/year) with the December
report for that year.
A. (3) TOTAL NITROGEN ALLOCATIONS
a. The following table lists the Total Nitrogen (TN) allocation(s) assigned to,
acquired by, or transferred to the Permittee in accordance with the Neuse River
nutrient management rule (T15A NCAC 02B.0234) and the status of each as of
permit issuance. For compliance purposes, this table does not supercede any TN
limit(s) established elsewhere in this permit or in the NPDES permit of a
compliance association of which the Permittee is a Co-Permittee Member.

ammonia nitrogen (NH3 as N) pending any subsequent rules establishing nutrient
restrictions in the Swift Creek watershed.

A. (5) OPERATIONS AND MAINTENANCE REPORT
The Permittee shall provide a written report no later July 30, 2014 documenting
the results of the operational changes proposed to the Division in June 2013. The
report shall document the impact of the operational changes to the facility's BOD
compliance. The report shall document any BOD violations, explaining both the
cause for the violations and the remedial actions taken.
The report shall be submitted to the NC DENR Raleigh Regional Office at the
address listed in A. (6) .
A. (6) INDUSTRIAL WASTE SURVEY & OCCUPANT COMMUNICATIONS PLAN
The Permittee shall collect, from every "New" occupant/business, information
contained in the enclosed "Industrial Waste Survey"
➢ New occupants shall receive a copy of the established Communications Plan no
later than the date of occupancy.
➢ New occupant/business information contained in the "Industrial Waste Survey"
shall be submitted by the occupant no later than sixty (60) days from the
date of occupancy.
➢ The permittee shall submit completed "Industrial Waste Survey" forms no
later than ninety (90) days from the date of occupancy for each new tenant
to the following address:

Charles,
These conditions have been included in previous permits. A review of the file showed that in 2005 violations may have
been attributed to the discharge of chemicals by tenants and possibly unauthorized discharges to the system by non -
tenants.
A note to the file on 1-4-06 included contract painters may be pouring paint/chemicals down drains. Bar screen solids
appear like latex paint. Chemical odor also at bar screen.
A response from Pope dated 2-1-08 stated materials for general cleaning are contributing to the low pH's at the WWTP.
Discussed during the 5-29-13 CEI was the possibility that septage haulers could be illegally dumping into the collection
system at remote locations on the property. It would be difficult to stop this practice.
Implementation of these conditions would be beneficial for the WWTP. Inhibition and pass -through could be prevented,
and sludge quality could be preserved.

On behalf of Pope Industrial Park, Envirolink Inc. appreciates the opportunity to
provide comments on the Draft NPDES Permit NC0060526 issued on May 22, 2013.
Please find enclosed our comments to the following items:
Permit Condition: The revised Total Residual Chlorine compliance level has been added
to section A. (1).
Comment: No comments at this time.
Permit Condition(s):
the submission of two Operations and Maintenance Reports, Communications Plan and
Industrial Waste Surveys.

ew conditions A. (5), A. (6), and A. (7) have been added, requiring
Comment: In commenting on these conditions, we referred to NC DWQ Inspection
Reports, and 2 years self -monitoring data (May 2011-May 2013). A review of
compliance history does indicate repeated violations associated with the summer 5-day
Biochemical Oxygen Demand (BOD) but does not indicate any violations for ammonia
(NH3-N). Condition A. (5) references non-compliance for 5-day BOD and NH3-N. Please
note that the facility has been in substantial compliance with NH3-N.
It appears that the conditions A. (5), A. (6) and A. (7) are derived from and consistent
with a Pretreatment Program. While the name of the development references
"Industrial", it does not treat industrial waste. The following comments are meant to
address each condition individually.

Condition A. (5) Operations and Maintenance Report. Please note that a review of NC
DWQ inspection reports along with on -site conversation with NC DWQ inspectors have
indicated that the facility is being properly operated and maintained. Regardless, we
concur that a review of the facility O&M along with reporting of such to NC DWQ is
warranted. We request revision of condition to the following:
A. (5) Operations and Maintenance Report
The Permittee shall provide a written report within 360 days of permit issuance
documenting impact of the operation and maintenance changes to the effluent BOD
quality. The report should document BOD violations, if any, along with the cause and
actions taken to prevent further violations.
We feel that this modification is warranted provided that we have provided a report on
proposed operational changes with this submittal (Exhibit 1) and that the facility has
been in compliance with the permitted effluent limits for ammonia.
Condition A. (6) Communications Plan. We do not understand the reason for this
condition. As indicated in Table 1, the facility only receives domestic wastewater.
While there is the possibility of illegal dumping into the collection system from outside
sources, there are no kitchens, process wastewater or other sources of wastewater that
would justify such a condition. As there is no basis for this condition, please remove
this requirement.
Condition A. (7) Industrial Waste Survey. As mentioned above, while the word
"Industrial" is included in the name of the development, it does not receive any
industrial waste. Industrial Waste Surveys are typical of facilities with a Pretreatment
Program; however, a Pretreatment Program is not applicable in this situation and
Industrial Waste Survey's would not aid in achieving compliance. As there is no basis for
a Pretreatment Program or this condition, please remove this requirement.

Since a majority of the BOD exceedances were related to clogged sludge return lines, it
is recommended that the Operator clean the return lines at a frequency of at least
monthly. As the monitoring data is evaluated, the Operations Staff can increase the
frequency if needed.
To ensure that illegal waste dumping is not occurring, it is recommended that the
influent pH be monitored weekly in conjunction with the effluent monitoring. It is also
recommended that the influent 5 Day BOD be monitored monthly.

The RRO recommends the permit be reissued with the requirement that the facility be required to investigate the possibility of
connecting to municipal sewer and eliminate the discharge. Changes in BIMS are needed as noted in the 'Effluent limits' section
and 'equipment description' section above. Part A (5) Industrial Waste Survey and part A (6) Communications Plan in the current
permit should remain in the reissued permit.
Due to limit violations observed during the last permit cycle (see attached data) the following Operations and
Maintenance Reporting is recommended to be included as a condition of this permit:

Provide a written account within 180 days of permit issuance to address needed operational and/or maintenance
improvements necessary to prevent violations of BOD, NH3 limits.
Within 360 days of permit issuance, detail in writing what changes have been implemented to affect improvements
in treatment unit operations. This report must show compliance trends regarding BOD, NH3. Reports must be
submitted to Raleigh Regional Office — Surface Water Protection Section.
