Dear Mr. Dutka:
On July 3, 2014, the Wilmington Regional Office received notification that you are proposing
additional built -upon area within the permitted low density project area of each of the subject
projects listed above. Please be advised that the individual existing stormwater management
permit covering each of these projects must be modified to account for the additional built -
upon area prior to any construction. Any construction on the subject site, prior to receipt of the
required modification to the existing coastal stormwater permit, will constitute a violation of 15A
NCAC 2H.1000 and may result in appropriate enforcement action by this Office.
For any of these permits that were issued with an allocation of future BUA, please submit your
request for a plan revision (one per project) and indicate how much of the future allocation you
wish to utilize for the project. If no allocation of future BUA was made in the permit or on the
original application, then you will need to submit a complete Stormwater Permit Application
Package (one per project) including 2 sets of plans, the completed application form, fee, and
supporting documentation, no later than August 8, 2014. Failure to respond to this request
may result in the initiation of enforcement action, and construction may experience a
subsequent delay.

original Division of Water Quality Stormwater Management Permit Revision application

I think this is pretty straight forward and I don't perceive any issues with the permits so I
do not have any problems with them getting their building permits. As I said, Kelly will be
handling the initial review of all the regular projects while I am out so I am cc'ing her and
Christine Nelson (who discussed one of these with you already) on this so they are aware that
I approved this.

Subject: Pender Co. Schools storm water permit request
As we discussed there are two existing schools that have low density permits . Topsail Area
Elementary SW8 960811 and Cape Fear Elementary & Middle School SW8 990804 . The school system
needs to add some small buildings at each site while school is out . The Topsail site has
future allocation called out in the permit so a plan revision is proposed . The Cape Fear
site is permitted for 30% coverage but no future allocation was written in the permit so a
permit mod is proposed only to get the paperwork correct. They are only at about 7% .
The question is can they go ahead and get a building permit and start work while the plan
revision and mod are being processed by you ? Time is of the essence . The packages will be
in your office in the next few days .
