HomeMy WebLinkAbout20220087 Ver 1_01_RobertsRd_CoverLetter_20220114Kimley»>Horn January 14, 2022 Mr. James Lastinger U.S. Army Corps of Engineers Raleigh Regulatory Field Office 3331 Heritage Trade Drive, Suite 105 Wake Forest, NC 27587 Mr. Rick Trone NC Division of Water Resources 401 & Buffer Permitting Unit 512 North Salisbury Street Raleigh, NC 27604 RE: Nationwide Permit 29 & 58 Application — Roberts Road Townhomes AID# 2016-00945 Cary, Wake County, North Carolina Dear Mr. Lastinger and Mr. Trone: On behalf of our client, Toll Brothers, Inc., Kimley-Horn is submitting the attached application for authorization under Nationwide Permits (NWP) 29 and 58 for the above referenced project in Wake County to construct a residential townhouse development and associated sanitary sewer extension to service the proposed development. The proposed project includes the construction of 99 townhomes as part of a residential development located within six property parcels (Figure 5) at the corner of Page Road and Roberts Road in Cary, North Carolina. The proposed development is located outside of the current Town of Cary sanitary sewer service area; therefore, the project is proposing the extension of the existing sanitary sewer system to serve the proposed development by gravity sewer. The proposed associated sanitary sewer line will run north, along the eastern side of 1-540, then turn west and cross 1-540 just south of Jack Branch. The proposed sewer line will tie into the existing Town of Cary sanitary sewer line at Linville Gorge Way in Wake County, North Carolina (Figure 1). The proposed sanitary sewer extension will be handed over to the Town of Cary for long term maintenance and operation and will be protected by a public utility easement. The property parcels (PINS: 0733531087, 0733433001, 0733434406, 0733439208, 0733531378, and 0733439535) where the residential site development is proposed were delineated by Soil & Environmental Consultants, PA (S&EC) on April 26, 2017. Additionally, S&EC delineated a portion of the sanitary sewer line extension on October 26, 2020. A Buffer Determination Letter (Wake County #WC-18-001) was issued for the parcels by Betsy Pearce of the Wake County Water Quality Division on May 24, 2018. A Jurisdictional Determination has not been pursued for the site or part of the sanitary sewer line extension; however, the delineation has been completed and is shown in the attached documentation. Additionally, the remainder of the sanitary sewer extension was delineated by Ecological Engineering, LLP on April 26, 2016. A Buffer Determination Letter (JBRRO #16-181) for the sewer line extension was issued by Erin Deck of the NCDWR on June 21, 2016 and a Preliminary Ki m ey >>> H o r n Page 2 Jurisdictional Determination (AID# 2016-00945) was issued by Tasha Alexander of the USACE on June 27, 2016. The attached Figure 3 depicts the results of all delineations within the project using an adjusted labelling convention, relabeling the S&EC and Ecological Engineering, LLP mapping to streams S1-S6 and wetlands W1-W7. Three streams (S1, S5, and S6) and two wetlands (W5 and W6) were identified within the limits of disturbance for the proposed project. The above referenced determinations are included as part of this permit application package. The proposed project has been designed and located to avoid and minimize impacts to environmental features, however, necessary and unavoidable permanent and temporary impacts to wetlands and streams will result from the construction of the proposed project. Permanent wetland impacts to bottomland hardwood wetlands W5 and W6 are conversion only due to the installation of the sanitary sewer line and designation of permanent sewer easement for future maintenance. No permanent impacts to wetlands due to dredge or fill will result from the proposed project. Temporary impacts to wetlands will result from construction easement/access necessary for the installation of the utility line. Temporary impacts will be restored to pre -construction contours and re -vegetated with native species upon completion of the proposed project. A total of 0.049 acre of permanent (conversion only) wetland impacts will result from the sewer line extension portion of the project. Permanent impacts to stream S1 will result from a culvert replacement and improvement due to the widening of Page Road as part of the proposed residential development (Impact Site 8). Additionally, permanent impacts resulting in no net loss of stream S1 are proposed downstream and upstream of the new culvert headwalls at Impact Site 8. Upstream of the existing culvert inlet, the accumulation of alluvial sediment deposition is currently impeding the flow of stream S1 and blocking the undersized culvert, resulting in the stream overtopping the culvert and washing out the road. During the installation of the proposed improved culvert, this sediment will be removed to alleviate flow and stream S1 will be graded to match in -channel contours above the culvert disturbance area. In addition, downstream of the existing culvert outlet, stream S1 is scoured due to overwash from the undersized culvert. Therefore, the project is also proposing to install rip rap that will be keyed into the banks at the new culvert outlet to provide stabilization and prevent future erosion. The installation of the proposed sanitary sewer line will require temporary construction easement/access and will result in temporary stream impacts only (Impact Site 2 and Impact Site 4). Temporary impacts will be restored to pre -construction contours and revegetated upon completion of the proposed project. A total of 0.009 acre of permanent stream impacts, 0.008 acre of permanent no net loss stream impacts, and 0.010 acre of temporary stream impacts will result from the proposed project. A No Practical Alternatives Analysis (NPAA) Request is being prepared and submitted to the Town of Cary, the local governing body, to obtain authorization for work within the identified protected riparian buffers. Unavoidable permanent buffer impacts will result from the construction of the residential development, including impacts from widening and improving Page Road to facilitate access, and from the construction of the associated sanitary sewer extension. Temporary impacts to the riparian buffer zones will result from the required access to construct the development and extend the sanitary sewer line. Kimley>»Horn Page 3 As a result of the proposed project, total permanent (conversion only) wetland impacts (0.049 acres) are less than 0.10 acres and total permanent stream impacts that result in a loss of waters (0.009 acres) are less than 0.02 acres. Therefore, compensatory mitigation is not proposed as part of the Roberts Road Townhomes project.
