It looks like we still need to get the transfer applications signed by Riptide. We also still need the renewals for SW8 940405. And, need to get two more 0&M. SW8 940226 is a low density permit that needs an O&M. (I inadvertently left that off of the previous O&M list.) SW8 940405 is a high density permit needing an O&M. That file is really complicated. See below. I originally thought that an O&M was not needed. But, it looks like the most recent version of the permit (attached from 1996) was not on file. But, there are 1996 approved plans for SW8 940405 showing a pond and so there must have been an O&M. We will need an 0&M for that permit. (I have attached a blank form with the pond cross-section diagram as well as a picture of the 1996 SW8 940405 plans to show the necessary elevations.) Hopefully this information will wrap this up. As you know, I have to set a due date because we get audited. Please respond by 12/2/2020. It seems that some of the —23 permits that need to be "transferred" were in the wrong name to begin with. It seems arduous and expensive to ask you to pay $505 for each of the "transfers" when there is a fair argument that they are actually corrections. For administrative purposes we need to go through the process to formally transfer each permit into the correct name, but we will do all of these under a single $505 fee. Can you please send me a list of those permit numbers so that we can keep up with that? Zhu <jzhu@seatrail.com> Subject: RE: [External] RE: Sea Trail questions Dana, There are two ways to transfer the ownership of a permit, and it has to do with whether there was a merger with a surviving company of if it is just transferring to an entirely different corporation. Both forms are found here, https://deg.nc.gov/about/divisions/energy-mineral-land-resourcesle_ nergy-mineral-land-rules/stormwater- rogra mlpost-construction. 1. Permit Update Form: I see on the NC Secretary of State's site that Wealth Spring Industry, LLC merged into Chinaway Corporate Development, LLC in 2017. At that point, Wealth Spring was no longer a valid entity and its assets became represented by a new name, Chinaway. Any permits issued to Wealth Spring can submit the." Permit Update Form. This is just an administrative exercise to formally change the permit to the modified corporate name. Any other corporations with mergers would follow this same pattern. If there are several permits issued to Wealth Spring, then you can just submit one form and attach a list of affected permits. Permit Transfer Application: If it wasn't just a matter of the name of a company changing or a merger that essentially changed the name of the company, then you have to formally transfer the permit to the appropriate entity. Though transfers tend to create a feeling of dread because they tend to get complicated this particular situation should not be that difficult. If there are the same people on both sides of the transfer, then they can submit a letter with the application indicating that they will take the transfer of the permit "as is" without an inspection. It should also state that they understand that, as the incoming permittee, they will become responsible for anything that needs to be done to bring the project into compliance if anything were to come up. If your goal is to get all the permits into the same name (or as few as possible), this is the best path forward. Eventually you will have to transfer the permits to the HOA. At that point we will have to do the full transfer process where we look at all the documents (deed restrictions, O&M, certifications, etc), do the field inspection, demonstrate that at least 50% of the lots have been sold, document that the impervious area ROY COOPER MQCHAEL S. Operation and Maintenance (O&M) Agreement: Please submit the enclosed O&M Agreements signed by the incoming permittee for the eight permits listed above. SW8 040405 Renewal: We had previously identified three permits that needed to be renewed before they can be transferred and those have been processed. But, as I went through these files I discovered that SW8 940405 was also expired but it was inaccurately entered in our database and so I did not know until I pulled the hard copy file. This permit expired on February 6, 2006. It needs two eight -year renewals to get it from 2006 to 2014 and then to 2022 in order to be an active permit. 4. SW8 940226: Nothing is needed for this permit at this time. But, it is dependent on the other permits being issued. The various tables in this permit will be updated to reflect the overall changes to the 19 permits when they are all issued. Please remember to confirm that any revised information is presented consistently throughout the application documents including calculations, supplements, narrative, and plans. Please also remember to provide two hard copies of any updated documents per 15A NCAC 02H.1042(2). All of the requested information listed above should be received in this Office by June 16, 2020, or the application will be returned as incomplete. If additional time is needed to submit the requested information, please email your extension request prior to this due date to the email address provided below with aiustification and a date of when the requested information will be submitted, which shall be no later than 15 days past the original due date. Please note that only two letters requesting additional information is allowed in the State Stormwater Program for a total of 30 days to submit the requested additional information. The law extends the effective period of any stormwater permit that was set to expire during this time frame up to three (3) years from its current expiration date.
