There are a few corrections that are required immediately. I apologize for the short notice. Due to the small amount of Zone 1 impact, we determined diffusing the flow from the two downspouts on the west side of the home would be sufficient to protect water quality. Stormwater treatment by the infiltration trench is not necessary and would increase the buffer impact from the project. An outlet dissipator pad would be sufficient. The WQC will accept draft copies of the site plan and restrictive covenant. So, in the interest of meeting the deadline to submit material for the March meeting, please revise the site plan (by hand is acceptable) to remove all references to the infiltration trench and draw in a dissipator pad at the outlet of the gutter discharge outside Zone 2 of the buffer. No part of the outlet dissipator pad should cross into the buffer. Please also revise the restrictive covenant to change infiltration trench to outlet dissipator pad. After item #2 add the following items. 1. A portion of this lot (as depicted or described on the attached Map) has been determined to meet the requirements for designation as a stream and protected stream buffer. Any subsequent fill or alteration of this area shall conform to the requirements of the state rules adopted by the State of North Carolina in force at the time of the proposed alteration. The intent of this provision is to prevent additional stream or buffer filling, draining, creation of concentrated stormwater flow, or impacts to riparian buffer(s) (streamside) vegetation, so the property owner should not assume that a future application for filling, draining or riparian vegetation removal would be approved. The property owner shall report the name of the subdivision, copy of the variance and this covenant in any application pertaining to said rules. 2. The stream and protected Neuse River Riparian Buffer exists on the property. Two downspouts on the west side of the house have been routed to an outlet dissipator pad outside the buffer and stream side plantings have been provided on the property to ensure diffuse flow is maintained from the downspouts and restoration of the buffer adjacent to the stream channel. These matters should remain in place, be utilized and maintained on a regular basis. The Division of Water Resources is to be notified in writing of any proposal to remove or modify the above stormwater control measures or buffer restoration area. This written notification is to be mailed to Division of Water Resources, 401 & Buffer Permitting Unit, 1650 Mail Service Center, Raleigh, NC 27699 -1650. 3. This covenant is intended to ensure continued compliance with all rules adopted by the State of North Carolina and therefore the State of North Carolina may enforce benefits. 4. This covenant is to run with the land and shall be binding on all Parties and all persons claiming under them. The buffer restoration area must also be maintained on a regular basis. The outlet dissipater pad should be checked regularly to make sure it is operating properly. The buffer restoration area must be maintained and kept in accordance with the regulations of the State of N.C. 7. This Covenant that the infiltration trench continue to exist, to be a collection facility for water from the two downspouts, and to be checked at least monthly and properly maintained, will stay on the property for so long as the present dwelling is on the property. The outlet dissipater pad and the buffer restoration area will also be maintained in good condition, and checked regularly to make sure everything is in proper order. It will be binding upon the heirs, successors and assigns of Jeffrey Gunter. 8.
