Dear Mr. Davis:
The information that was received by the Raleigh Regional Office on March 12, 2003 has been
reviewed. The plat map and other information was provided to allow a determination to be made
as to whether or not the site would require compliance with the Neuse Buffer Rule. This project is
referenced by the Raleigh Regional Office as NBRRO 03 -077.
The features represented on the Nash County Soils and the Rocky Mount USGS Quad maps were
evaluated to determine their subjectivity to the Neuse Buffer Rule. It was determined that there
are no features depicted on either of the maps. Therefore, according the Rule, this property is not
subject to the Tar Pamlico River Basin: Nutrient Sensitive Waters Management Strategy;
Protection and Maintenance of Existing Riparian Areas, Administrative Code T15A:2B.0259 (NCAC
0259) .
This letter addresses only the applicability of the Neuse Buffer Rules. For information relative to
water quality impacts, wetland or 401/404 issues, please contact Mr. John Dorney at 919.733-

Reference is made to the site map and property description you provided on March 10, 2003 to the North Carolina
Division of Water Quality (DWQ) for a property located in Nash County. I understand that you also discussed the property
with Ms. Cyndi Karoly of the DWQ Central Office in Raleigh on March 9, 2003. Based upon the property description you
provided, we concur that the man -made pond on this property is exempt from the Isolated Wetland Rules in accordance
with 15A NCAC 2H .1305(e)(2). Permission from DWQ is not required to fill this man -made pond. We understand that Mr.
Steve Mitchell of the DWQ Raleigh Regional Office will provide you with correspondence related to the Tar - Pamlico Buffer
Rules with respect to this property.
