Dear Mr. Morris:
I have reviewed the information submitted for the project referenced by the Raleigh Regional
Office as NBR 03 -079. An evaluation of the stream features present on the property was
performed to determine whether or not the site would require compliance with the Neuse Buffer
Rules.
Two features are represented on the Wake County Soil and one on the Lake Wheeler USGS
topographic map. Since this determination has been accomplished to complete a lot separation,
it was determined that both features are present on the ground as streams and therefore subject
to the Neuse River Basin: Nutrient Sensitive Waters Management Strategy; Protection and
Maintenance of Existing Riparian Areas, Administrative Code 15A:2B.0233. The required fifty -
foot buffer is shown on the attached map along the stream features.
This letter addresses only those issues involving the riparian area. For information relative to
water quality permitting, buffer impacts, 401/404 or wetland issues, please contact Mr. John

Dear Mr. Mitchell:
I have a client that wishes to divide off one building lot on a 32 acre tract
on Banks Road about 1 mile east of Hwy 401. 1 have attached copies of
the USGS Quad Sheet, Soil Survey, Tax Map, and proposed subdivision
plat. There is a creek on the rear of the property that I know will have a
buffer, and there is a drainage swale that may need one. Nothing we are
doing will affect either area at this time, but Wake County wants me to
show the buffers anyway.
