Unnamed Tributary to Crabtree Creek
Neuse River Basin, Town of Cary

Barbara H, Mulkey Engineering, Inc. is working on a land development project in
the Town of Cary for a private firm. A drainage channel located on the site is
shown as a blue -line on the Wake County soil survey map. The Town of Cary has
designated this channel as requiring a 50 foot buffer per Cary buffer rules as well
as the 50 foot Neuse buffer. However, the Town of Cary has stated that if the
North Carolina Division of Water Quality (NCDWQ) determines the stream is an
ephemeral channel it will not be subject to the Town's buffer rules.
Using the NCDWQ Stream Classification Rating Form we have determined this
channel is an ephemeral drainage and should not be subject to the Neuse
buffer rules and Town of Cary buffer rules, We are requesting a field
determination of the stream and written verification that it is an ephemeral
channel and therefore not subject buffer rules.
Attached is a map showing the location of the project site and the unnamed
tributary to Crabtree Creek. If you have any questions about our request or the
