During the site visit the investigators took photographs and made observations of impacts associated with grading, grubbing, and clearing in excess of 1.0 mile of stream -side (riparian) buffer zone along the Tar River in Edgecombe County. Further, fill, grading and mechanical land disturbances in wetlands was also observed. The stream -side (buffer area) was severely impacted by removal of vegetation and grading. Also noted was that wetland areas landward of the main -stem of the river had been grubbed/ back - filled with earthen material. As a result, the subject site inspection revealed violations and/or merit additional information requests for the following items: 1) Tar - Pamlico Riparian Buffer zone violations and 2) wetland standard violations. Richard Anderson 03/03/03 Item 1. Wetland Standard Violation IAT of the main -stem of the Tar River. This activity, without the proper authorizations /permits, constitutes a wetland standard violation. 15A NCAC 2B .0231(h)U "Liquids, fill, or other-solids or dissolved gases may not be present in amounts which may cause adverse impacts on existing wetland uses;" Item 2. Riparian Buffer Rule The Tar - Pamlico River Basin is a basin that is subject to riparian (streamside) buffer rules. 'The purposes of -these rul'e's are:to protect and preserve riparian buffers 'in "the Tar - Pamlico River Basin. That is, these rules help to maintain the nutrient removal functions of the streamside areas necessary to protect surface waters. 'Specifi'cally, this Rule applies to the 50 -foot wide riparian buffers ,directly adjacent to surface wateis,(intermitterit,streams, perennial -streams-, lakes, ponds, and estuaries). Further, the ,protected riparian buffer has two zones as follows: (a) Zone 1 [measured from stream bank landward for 30 feet] shall consist of a vegetated area that is undisturbed except for uses provided for in Subparagraph (6) of 15A NCAC 2B .0259, and (b) Zone 2 [the outer 20 feet, landward from the outer'30 foot edge of zone,I ] shall consist of stable vegetated area that is •undisturbed except for activities and uses provided for in Subparagraphs (4) and (6) of 15A NCAC 2B .0259. The site,visit and file review of this tract of land confirmed no Pre- Construction Notification . was received for this project and riparian buffer, impacts associated with clearing of vegetation, grading and grubbing were not authorized by DWQ. Specifically, no request, or a DWQ practical alternative determination, variance or authorization had been issued for these impacts to the riparian zone. As aresult the following riparian buffer rule violations are noted: Tar - Pamlico River Buffer Rule 15A NCAC 2B .0259 Deposition of fill, grading, grubbingand the respectivecleaimg of vegetation has occurred in the riparian zone; a violation of the requirement ,thatZone I and Zone II consist of stable, vegetated area that is undisturbed except for activities and uses provided for in Item (6) of the-Rule. This Notice of Violation detailed impacts to approximately 1.0 mile of stream -side (riparian) buffer zone and wetland standards violations along the Tar River in Edgecombe County. On April 7, 2003, the Wetlands Central Office received a response to the NOV that was deficient of needed information. Within the response letter, some information implied that a Forest Management Plan was to be designed and implemented to address the riparian buffer issues. According to 15A NCAC 02B .0233 (11)(b): In Zone 1, forest vegetation shall be protected and maintained. Selective harvest as provided for below is allowed on forest lands that have a deferment for use value under forestry in accordance with G.S. 105. -277.2 through G.S. 277.6 or on forest lands that have a forest management plan prepared or approved by a registered professional forester. Copies of either the approval of the deferment for use value under forestry or the forest management plan shall be produced upon request. If you are retaining a deferment for use value under forestry or a forest management plan prepared and approved by a registered forester this should be submitted upon receipt of this letter. In addition, please submit all information addressed in the NOV dated March 3, 2003. Mr. Jack Rich is the contact person. We had hoped to do a preliminary study of the site, but due to the Tar River going above flood stage twice in last two weeks and considerable rain we have not completed our assessment. I intend to have the work done as soon as weather permits. In addition we will keep AB Whitley, NRCS apprised of the matters related to this issue. For the record and to give a brief history of the farm, for over fifty years the farm was used as an illegal household/construction dump, a sandpit, and a junkyard by previous owners. We have taken great efforts to clean up the farm and return it to a forestry/recreation farm. During the removal of this debris we committed these infractions in the least intrusive manner as possible. We will mitigate /restore any problem area, according to an acceptable plan.
