Dear Madam:
The North Carolina Department of Transportation (NCDOT) proposes to replace the existing 7‐
span, 308 foot long bridge with a 313 foot long, 3 span bridge. Due to a road, stream and
railroad under the bridge, there will be 130 linear feet of bank stabilization and 0.06 acre of
temporary stream fill for a temporary work bridge and work pad necessary to remove and
install the new bridge. Traffic on US 23‐74 will maintained on a single lane pattern, and traffic
on SR 1705 will be detoured off‐ site during construction.
Please see enclosed copies of the Pre‐Construction Notification (PCN), Stormwater
management plan, permit drawings, design plans, Rapanos forms, and USFWS informal
concurrence response for the above‐referenced project. A Categorical Exclusion (CE) was
completed and distributed in February 2012. Additional copies are available upon request.
Comments from the North Carolina Wildlife Resources Commission (NCWRC) will be required
prior to authorization by the United States Army Corps of Engineers (USACE). By copy of this
letter and attachments, NCDOT hereby requests NCWRC’s review. NCDOT requests that
NCWRC forward their comments to the Corps of Engineers and the NCDOT within 30 calendar
days of receipt of this application.
This project calls for a letting date of June 17, 2014 and a review date of April 29, 2014.
However, the date could be advanced if funding becomes available.

The project involves replacing a seven-span bridge with a three-span bridge on existing location. US 74 traffic will be
phased and maintained on the current structure in by reducing it to a two lane pattern. Traffic underneath the structure
will be detoured off-site onto other routes. Standard road building equipment, such as trucks, dozers, and cranes will be
used.

D. Impact Justification and Mitigation
1. Avoidance and Minimization
1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
This bridge will be replaced as close to the existing bridge as possible, but with 4 less sets of bents. Currently, bridge
bents exist on both banks of the stream. The new bridge will only have bents on one side of the stream. Unfortunately,
due to the limited space under the bridge with a road, a railroad track, and a stream, there is little room to place bridge
bents without impact to the stream. Dark Ridge Road (the road that runs under the bridge) will be closed during
construction to allow for construction and thus result in less temporary impact to Scott's Creek.
1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques.
Design Standards for Sensitive Waters will be used for this project. Deck drains will not discharge into open water. The
Department will observe an in-stream moratorium for trout from October 15-April 15.

stream bank stabilization activities. Stabilizing the bank of a
stream does not require fill in the stream bed and, therefore,
under Section 404 of the Clean Water Act, does not
constitute Loss of Waters of the U.S. and is not subject to
compensatory mitigation. Furthermore, the proposed bank
stabilization activities are necessary to prevent erosion and
sedimentation, i.e. preventing bank destabilization and
minimizing impacts to the environment.
