3. Project Description:
3a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application:
The project site consists of approximately 3.5-acres located at 647 Trinity Court in
Chapel Hill, North Carolina within Orange County. The site is comprised of two public
housing multi -family apartment buildings, associated stormwater control measures,
utility connections, parking lots, and access roads. The site is bound by Umstead
Park to the north, residential development to the east and south, and by forested
areas and residential development to the west.
The project is proposing to redevelop the site by razing the existing, condemned
apartment buildings and constructing two new apartment buildings in the existing
footprint. The project is further proposing improvements to existing paved areas to
allow safe ingress and egress throughout the site, as well as improvements to
stormwater conveyances and utility connections. These improvements are necessary
to maintain public housing in the area while ensure the site is safe and up to current
standards.

4. Proposed Activity
Provide a detailed description of the proposed activity including its purpose and include the type of equipment to be used: *
The proposed redevelopment is a single -phased public residential development
project that is located at 647 Trinity Court in central Chapel Hill, North Carolina within
Orange County. The purpose of the proposed project is to redevelop an existing
public housing multi -family apartment complex in central Chapel Hill, North Carolina
with the necessary amenities as the current site is condemned.
The project site will include two new, multi -family apartment buildings and other
associated amenities, including stormwater control measure and utility improvements.
All work will be conducted in accordance with local, state, and federal regulations.
Traditional equipment will be used consisting of front-end loaders, bulldozers, paving
equipment, graders, and earth movers. SCMs are required and will be used.

Comments:
At the request of the Town of Chapel Hill, Allison Weakley with the Town Public
Works Department conducted an onsite stream determination on July 16, 2020 and
issued the findings on July 20, 2020. A buffer determination was later conducted by
Stephanie Goss of the NC DWR on September 27, 2021 to determine the
applicability of the Jordan buffer protection rule to the site. A buffer determination
letter was issued on September 28, 2021. Further, a delineation of the site was
completed by Timmons Group on November 9, 2021 to identify any potentially
jurisdictional waters within the site.

Comments:
The proposed project will consist of a total of 305-sq.ft. of Zone 1 impacts and 1,502-
sq.ft. of Zone 2 impacts.
Of the proposed impacts, Impact 1 will result in 528-sq.ft. of Zone 2 impacts
associated with grading and installation of a retaining wall, as well as a stormwater
conveyance. Grading and the retaining wall in this location are necessary to ensure
the stability of the building pad and associated paved areas and to reduce erosion in
this area due to the existing steep grade. All grading will be conducted within the
footprint of the existing development. The stormwater conveyance will consist of a
riprap dissipater pad in Zone 2 to prevent concentrated stormwater flow through Zone
1 of the buffer. Further, the stormwater conveyance is aligned with an existing
stormwater outfall and will not create new stormwater flow through the buffer. Per
15A NCAC 02B .0627 and the Table of Uses found therein, these activities do not
require riparian buffer mitigation.
Impacts 2, 3, 4, and 5 are associated with grading and road widening necessary for
driveway improvements to allow safe access between the eastern and western
portions of the site. Impact 4 will result in 305-sq.ft. of Zone 1 impacts, while Impacts
2, 3, and 5 will result in a total of 974-sq.ft. of Zone 2 impacts resulting from grading
necessary to widen the driveway to accommodate traffic within the site. Per 15A
NCAC 02B .0627 and the Table of Uses found therein, these activities do not require
riparian buffer mitigation.
Though the proposed project is located in an area subject to the Town of Chapel Hill's
Resource Conservation District (RCD) riparian buffers, all parcels where the
intermittent stream identified onsite was observed were platted well before January
27, 2003. Therefore, the intermittent stream is not subject to the Town's RCD riparian
buffers. Parcel records are attached in Section G. Additional Information.
D. Impact Justification and Mitigation
1. Avoidance and Minimization
la. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project.
Impacts to jurisdictional features have been avoided and minimized to the maximum
extent practicable by incorporating resourceful site planning, including utilization of
the wetland/stream delineation to adjust the layout of the Site design to avoid and
minimize impacts. The remaining impacts proposed are necessary in order for the
project's goals to be realized.
Resourceful site planning was utilized to design the proposed project in a way that
minimized impacts to jurisdictional features through the utilization of the existing
development's footprint where able. The existing culvert and hardened stream areas
where they occur along the stream crossing will not be replaced or modified in any
way to avoid impacts to the jurisdictional intermittent stream. All remaining proposed
riparian buffer impacts are necessary to ensure site safety and access within the site
and have been limited to those that are absolutely necessary.
1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques.
Proper sedimentation and erosion control methods will be utilized during all phases of
construction and installation as described in accordance with the requirements of the
North Carolina Department of Environment and Natural Resources: Erosion Control
Planning and Design Manual (May 2013) and local codes. All work will take place
during dry conditions and can be facilitated from high, non -jurisdictional, stable
ground. The contractor shall install silt fence, inlet protection, sediment traps, division
ditches, temporary coffer dams, tree protection, and clearing only as necessary to
install devices. All erosion and sediment control measures will be checked for stability
and operation following every runoff producing rainfall, but in no case less than once
every week. Any needed repairs will be made immediately to maintain all measures
designed. An erosion control inspections report is required and will be kept by the
owner's representative.
Temporary seeding and permanent seeding plans are included to restore impacted
areas. The project will meet all relative requirements of Best Management Practices
and Engineered Stormwater Control Structures as outlined through State and Local
Stormwater Rules. Measures will be taken to prevent oil, tar, trash, debris, and other
pollutants from entering adjacent jurisdictional features. Any excess excavated
materials not utilized as back fill will be placed and contained within upland areas and
permanently stabilized to prevent erosion into adjacent jurisdictional features.
Therefore, stockpiling of excavated material within jurisdictional waters of the U.S. will
be strictly prohibited as part of the construction of this project. All project construction
activities initiated within jurisdictional waters of the U.S. will be carried to completion
in an expeditious manner to minimize the period of disturbance within jurisdictional
waters.
