Board members present included Ed Davis, Tyrone Byrd and Kathleen Baylies. Outgoing President, Steve Adams, was also present. Kathleen announced meeting minutes of the previous board meeting, held May 29, 2006 can't be found. OLD BUSINESS Outgoing President, Steve Adams passed on pertinent HOA.dbcuments to the board, including giving his copy of the pool house key to Ed Davis. Tyrone reported our bank balance is $43,132.96 The sign reminding people that no one under 16 may swim without supervision has been posted. There was some discussion about the number of kids who don't follow the rules. It was decided the minutes from the annual home owners' association meeting will be reviewed at the next board meeting. NEW BUSINESS Tyrone Tom Forrest with the Kure Beach Village Home Owners Association asked if their members could use our beach access while they're repairing theirs. We decided we would allow that. Tyrone also got the name of the company (Mike Melvin) who will be adding gravel to the Kure Beach Village gazebo lot. Kathleen made motion that we contract with Mike Melvin to add gravel to our gazebo parking lot. Tyrone seconded. Motion passed unanimously. Tyrone reported that the cleaning of the gazebo has been changed from twice a week to once a week. Tyrone has asked Ryan Bradshaw to put rain sensors on the irrigation system. Ed Davis made motion we turn off the irrigation system around the pond and turn it on during dry spells. Butch VonCannon second. Motion passed unanimously. Ed Davis mentioned we need to set up a date for the July 0' neighborhood party, and send out notice to our members. Ed suggested having at the .pool and using his garage as a rain date. Kathleen made a motion that we set the party for 5:30pm, on Saturday, July 1. Butch seconded the motion. It passed Page3 Kure Estates Annual Meeting 5/l/04 =0,,99 Insurance: Given by Joe Hearne Joe advise anyone interested in reviewing the policy, may see it in the office. Ed Davis asked if it covered:"wind and hail", the answer was yes. The Election of the Directors was next on the agenda. Each lot owner was given a ballot for each lot owned in Kure Estates. Proxies were mailed to each member, to be used if unable to attend. These were collected at admission and sign in, and ballots were distributed at that time. Joe Hearne, Acting President, presented the slate for the Board of Directors for the 2004-2007 years. The terms will be rotated, 1,2 and 3 year terms, to be determined by the board. There will be 6 directors on the board. The motion to approve a new board, and establish rotating terms, with 6 board members, was made by Perry Barwick, and seconded by Cris Kaprantzas. The vote was passed by a unanimous vote. The slate of directors was presented to the membership by Joe Hearne as follows: Joe Hearne, Steve Adams, Tyrone Byrd, Butch von Cannon, Bob McClosky, and Barbara Ervin. The membership was asked if there were any nominations from the floor, there being none, a motion .to accept the. slate of directors was made by Tom .Souflas, and seconded by Linda Souflas. The board of directors slate was elected by unanimous vote. Tom Souflas raised the question if we do not have people to be on the board, Joe advised a professional company could be hired. The next item was Ratification of the Budget: There were questions. from.the membership as follows: Frank Magestro asked what would- happen if we lost our reserve, Joe Hearne explained we would have a "special assessment" if we need it. Page 2 5/12/04 r 1119 LBY:.---a brief discussion of a vending machine. There will not be any now. Butch suggested a clock is needed by the pool. The lot next to pools will be cut, when needed so parking can be done on it, if needed. Retention Pond: Joe Hearne suggested .a service to keep the pond clean, he will get information together on that subject. Architectural Committee: Joe Hearne said we must start enforcing the painting of fences and other offenses. Steve Adams will take a walk through neighborhood, and check homeowners. Offenders will receive a letter to correct the problem. THE RESOLUTION WAS PASSED BY UNANIMOUS VOTE BY THE BOARD OF DIRECTORS AS FOLLOWS: IT IS REQUIRED THAT ALL EXTERIOR SIDING AND SHOWER ENCLOSURES BE PAINTED. THE COLOR TO BE APPROVED BY TFIE ARCHITECTURAL COMMITTEE. IT IS REQUIRED, ALL EXTERIOR DECK RAILS. PICKETS AND POSTS BE PAINTED WHITE. RECF TED APR 0 9 l009 BY: Present were: Joe Hearne, Bob McClosky, Butch von Cannon, Steve Adams, Tyrone Byrd, Barbara Ervin Joe Hearne announced that this was his temporary board, until officers were elected at annual meeting. Minutes from the annual meeting were distributed. The Financial Report was distributed and discussed and explained. The temporary treasurer will be Tyrone Byrd, temporary secretary will be Barbara Ervin. A discussion of the Home Owners Association followed and what will take place at the annual meeting. The proxies will be sent to all homeowners by mail to their New Hanover real estate addresscs. The annual meeting will take place May1, 2004, at the Community Building in Kure Beach, if they have no other booking. The follow up meeting will take place on April 5, 2004 at 5PM The meeting was adjourned at 6:45PM Respectively submitted, Barbara Ervin Temporary Secretary MINUTES Kure Estates Homeowners .Board of Director's Meeting February 12, 2007 REC ,Pv APR 0 9 7009 BY: President Butch VonCannon called -the meeting to order at.4:16 p.m. Board members present included Ed Davis, Tyrone Byrd and Kathleen Baylies:. The minutes from the June 17, 2006 were -reviewed. Butch VonCannon made a motion the minutes be accepted. Ed Davis seconded. Motion passed unanimously. NEW BUSINESS Ed Davis volunteered to contact Progress Energy to .find out if our rate is the appropriate rate and whether or not it may be possible to get a lower rate. Tyrone Byrd reported on the homeowners dues.. To date we've collected 54 out of 85 dues from homeowners. The deadline for dues is February 28. Tyrone has talked to the HOA's insurance agent and the agent seemed to think our rate might go down. Our insurance is due February 26. The agent will be reviewing all four of our policies with Tyrone in the coming weeks. We discussed what the time 'requirements* are for notifying members of the annual meeting in order for us to conform to the rules. Since our last meeting, Jeff Becken and Butch VonCannon measured the depth of the retention pond to make sure it meets depth requirements. Once a month, Jeff looks at the pond and makes a report. Jeff has told Butch he will submit a report on ways to improve the maintenance of the pond. Tyrone Byrd reported that he has filed the tax return for the HOA. Butch VonCannon brought up the fact that there are people who are using parking passes who are not members of the HOA. Tyrone says he will produce new signs with the name and address of each HOA member, by using the old signs that we still have in stock and addinga sticker with the name and address of the owner. We will send out new signs with the sticker and send a letter to each HOA member to explain the need to.use the new signs. in the letter, we will let owners know it is their responsibility to let their long-term renters know the details of the pool and gazebo parking rules. Tyrone reported someone broke into the pool bathrooms by "carding them" after the water had been turned off for the winter. Tyrone then installed deadbolts to prevent use while the water is off for the winter. This renewal is in response to a letter dated January 13, 2009 from Ms. Georgette Scott of the Surface Water Protection Section. Information is attached for your consideration in the evaluation of our renewal package. A portion of this information is based on a recent meeting I had with Ms. Mary Jean Naugle regarding the renewal process for this project. Please find the following documents enclosed: o Renewal permit application processing fee of $ 505.00 for application review. o A completed Stormwater Management Permit Renewal Application Form based on the current version from Surface Water Protection Section Website. Please note that this form is the version that Ms. Naugle. o A copy of the acknowledgement of the change in signing official for the subject project. Please note that the letter from Ms. Scott was sent to an incorrect person and address. Please forward all future correspondences to the person and address listed with the attached acknowledgement letter. o A copy of the designer certification is also attached. Based on the information provided in the letter from Ms. Scott, it appears that your office does not have a copy of this certification on file. o A copy of the original State Stormwater Management permit for your use. Please note that none of the stormwater management features referenced within this original permit have changed since the designer certification was completed. The home owner's association was started at that time with the directors being appointed by the President — Joe Hearn. Joe Hearn was the original signature authority of the original permit. o Meeting minutes from the association's annual meeting in which the directors were elected to the board. o The positions of the board is determined by the elected directors. Steve Adams became the President of the Board on May 12, 2004, per the attached meeting minutes from that date. Steve Adam's signed the most recently approved Stormwater Permit and authorized me to be the signing official. o Butch VonCannon became the board president during a board meeting on June 17, 2006, as indicated by the attached minutes from that meeting. o As indicated by the February 12, 2007 meeting minutes, Butch VonCannon was still president at that time. o A notarized document of the current board members and their respective positions is attached for your reference. A preliminary review of that information has determined that the application is not complete. Only the following checked information is needed to continue the stormwater review: ® Permit Renewal Application. The permittee identified in Section 1.3 of the renewal application must be a principal executive officer of at least the level of vice-president of the corporation per NCAC 2H.1003(e). To ensure the permittee is a principal executive officer of the corporation, they must be registered with the NC Secretary of State or official documentation from the corporation can be provided supporting the permittee as a principal executive officer. In the letter from DWQ dated November 28, 2006, Mr. Becken was acknowledged as one of the signing officials for the corporation, however the permit was not transferred from Mr. Adams. This acknowledgement allows Mr. Becken to sign on behalf of the principal executive officer of the corporation, however the permit will still be issued to the person identified in Section 1.3 of the application. Please re -submit page 1 of the application with the correct permittee identified in Section 1.3 along with documentation supporting that individual's position within the corporation. ❑ Operation and Maintenance Agreement. Original signatures must be on the operation and maintenance agreement. The operation and maintenance agreement received by' this office appears to be a copy. ❑ A signed Operation and Maintenance Agreement. This permit expires on August 19, 2009. Section .1003(h) of 15 A NCAC 2H .1000 (the stornnuater rules) requires that applications for permit renewals shall be submitted 180 days prior to the expiration of a permit and must be accompanied by a processing fee, which is currently set at $505.00. If this is still an active project please complete and submit the enclosed renewal application in a timely manner. If this project has not been constructed and a permit is no longer needed, please submit a request to have the pemtit resc�ded.
