Skvada, III Secretary The Division of Water Resources (DWR) has performed a preliminary review of a 401 Water Quality Certification application submitted for the above referenced property. Additional information will be required in order to complete the review process. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. Application Item B. 3. d. requests a purpose for your project. In part, you have stated that boulder weirs to trap sediment is, in part, the purpose for your project. In stream treatment for an "out of stream" pollution source is the least desirable of options when there is the opportunity to capture sediments before it enters the waterway. You must re- evaluate all "out of stream" sediment management options in your alternatives analysis prior to pursuing any form of in- stream treatment. 2. Application Item -B. 3. e: requests the project be- described in detail: - During a -site visit --by -Kevin Barnett and Jeff Menzel of the Asheville Regional Office, it was discussed with your onsite contractor that there were wetlands contained within the parcel of land. There is no request for wetlands to be converted to open waters. Additionally, Application Item C. 2. indicates no request for wetland impacts. You must obtain the services of a qualified professional to perform a wetland delineation on this property. The application shall then be modified to reflect all necessary impacts to wetlands in the application, and provide how you minimize all impacts to waters /wetlands through the project planning process. In the plans attached to the application, it is referenced that portions of the stream channel bank will be lined with stone, the restored stream bottom will include rip -rap, and in- stream structures are proposed. No reference stream data was provided to show the appropriate dimensional area of the designed stream channel, nor the stream substrate size distribution for any constructed riffle segments. All restored channel features must be based on a reference reach of an undisturbed stream of the same drainage area size and located in the same physiographic province, and be based on Natural Channel Design concepts. You must provide reference reach calculations in order to justify the proposed restoration channel characteristics. Please provide your response in writing to the addresses below prior to December 30, 2013. This letter only addresses the preliminary application review and does not authorize any impacts to wetlands, waters or protected buffers.
