Subject: Ambient Water Quality Monitoring Report Review
Bay Lakes
Beaufort County
Dear Mr. Whichard:
On December 4, 2013, the Washington Regional Office received your Ambient Water
Quality Monitoring Report for Bay Lakes prepared by Land Management Group, Inc. The report
summarizes water quality monitoring data for samples collected in the vicinity of Bay Lake.
Based on the data, water quality within Bay Lake is equal to or better than water quality within
Taylor Creek and Chocowinity Bay.
Based on favorable findings, the Division of Water Resources (DWR) does not object to:
1) maintaining the existing connection between Bay Lake and Taylor Creek located on the
northwestern side of Bay Lake and as identified on the attached figure as Point A; and
2) removal of the bulkhead closure located at the southwestern corner of Bay Lake and as
identified on the attached figure as Point B.
The above positions are considered conditional upon installation of piles at the existing
connection (Point A) to restrict boat traffic and conducting proposed activities under proper
authorization from the Division of Coastal Management (piles at Point A, removal of bulkhead
closure, and canal maintenance /improvement efforts). Once proposed activities as referenced
above are implemented in accordance with plans approved by the Division of Coastal
Management, DWR will consider the Notice of Violation and Recommendation For Enforcement
dated September 11, 2012 (NOV- 2012 -PC -0311) closed out with no further action required.
Should you fail to restrict access at the existing connection (Point A) as proposed and in
accordance with approvals from other agencies, you remain subject to potential enforcement
actions as specified in the original September 11, 2012 Notice.
