This permit, issued on 1111/25/113 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
1) Unless specifically altered herein, this minor modification authorizes the one -time installation of
concrete A jacks and sandbags around the piles associated with Bridge Pile Support Bent #166, as
depicted on the attached workplan drawings.
2) Prior to the initiation of construction, the permittee shall contact the U.S. Coast Guard (USCG) to
determine if there are any USCG requirements for marking or mapping the location of the concrete
A jacks and sandbags. The permittee shall adhere to any such USCG requirements.
3) No attempt shall be made by the permittee to prevent the free and full use by the public of all
navigable waters at or adjacent to the authorized work.

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on

4) Placement of the concrete A jacks and sandbags shall adhere to the alignment and dimensions as
described in the attached application letter, including the attached workplan drawings.
5) All construction access for the authorized activity shall be through the use of the existing bridge and
work barges /tug operation, as described in the permit application.
6) Live concrete shall not be allowed to contact the water in or entering into Oregon Inlet.
7) Upon completion of the new Bonner Bridge replacement structure, and prior to the subsequent removal
of the existing Bonner Bridge structure, the permittee shall initiate coordination with the N.C. Division
of Coastal Management (DCM) and other appropriate resource agencies to determine if the concrete A-
jacks and sandbags shall be removed.
8) The material used to fill the sandbags shall be obtained from an approved upland source and shall be
clean and free of any pollutants except in trace quantities.
9) The permittee shall provide DCM with an as -built survey of the approved concrete A jacks and
sandbags within 60 days of project completion, including final dimensions and GPS coordinates of their
location.
10) The permittee and /or his contractor shall contact the DCM Transportation Field Representative to
request a preconstruction conference prior to project initiation.
11) This minor modification does not eliminate the need to obtain any additional permits, approvals or
authorizations that may be required. Such permits may include, but are not limited to, permits from the
N.C. Division of Water Resources, the U.S. Army Corps of Engineers and the U.S. Fish and Wildlife
Service. Any such permits shall be obtained prior to the initiation of construction.
12) This minor modification shall be attached to the original of Permit No. 128 -04, which was issued on
8/26/04, as well as all subsequent modifications, letters of refinement, and renewals, and copies of all
documents shall be readily available on site when a Division representative inspects the project for
compliance.
13) All conditions and stipulations of the active permit remain in force under this minor modification unless
altered herein.

This permit, issued on 12/20/13 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Ocean Oautfall
1) In order to protect sea turtle nesting sites, no work seaward of the frontal dune or the first line of
stable natural vegetation, whichever is more restrictive, shall be conducted from May 1St to
November 15th of any year, without the prior approval of the N.C. Division of Coastal Management
(DCM), in consultation with the N.C. Wildlife Resources Commission.
2) In accordance with 15A NCAC 07H .0306(a), the proposed extension of the existing ocean outfall by
65 feet is not authorized.
3) In performing maintenance and /or repair activities on the existing outfall structures, the repaired
outfall pipes and associated structures shall not exceed the footprint of the existing outfall structures.

ADDffTIONAL CONDITIONS
4) The permittee shall post appropriate signs to warn the public of potential hazards during maintenance
and construction activities.
5) The permittee shall remove all debris and construction material immediately upon project completion.
6) The elements of the support structures from the existing ocean outfall that are no longer needed shall be
removed in their entirety.
7) All materials and debris associated with the repair and /or maintenance of the existing ocean outfall and
associated materials shall be disposed of at an approved upland site or shall be recycled in an
environmentally appropriate manner provided appropriate authorizations from any relevant state,
federal, or local authorities are obtained.
8) Land -based equipment necessary for construction work shall be brought to the site through the existing
public beach access located at Admiral Street Drive. Should the work result in any damage to the
existing access, the access shall be restored to pre - project conditions immediately upon project
completion.
9) Live concrete shall not be allowed to contact Waters of the State or water that will enter Waters of the
State.
Temporary Sheet Pile and Temporary Work Trestle Platform
10) The temporary sheet pile and temporary work trestle platform shall be installed securely to minimize the
likelihood that they will break loose and become a hazard during any damaging weather events that may
occur while the project is underway.
11) The temporary sheet pile and temporary work trestle platform shall be removed in their entirety within 7
days after project completion.
General
NOTE: The following comments were received from the N.C. Division of Marine Fisheries, Shellfish
Sanitation and Recreational Water Quality Section: "Negative impacts to beach water quality
associated with the Dare County ocean storm drains have been well documented by both the
University of North Carolina Institute of Marine Sciences and the UNC Coastal Studies Institute.
As proposed, this outfall will most likely discharge within the surf zone, and thus will continue
to have a negative impact on swimmers. Extending the drain pipe further offshore beyond the
surf zone will likely allow for the stormwater to discharge beyond the area used by swimmers,
and thus reduce the threat to public health."
12) Development authorized by this permit shall only be conducted on lands owned by the N.C. Department
of Transportation and /or its right -of -ways and /or easements.

13) The permittee and /or their contractor shall contact a DCM Field Representative in Elizabeth City to
request a preconstruction conference prior to project initiation.

required, from the N.C. Division of Water Resources, and any required authorization from the
U.S. Army Corps of Engineers.

1) Unless specifically altered herein, this minor modification authorizes the following activities at the
North End of Ocracoke Island associated with the South Dock Ferry Terminal: (1) construction of a
toll booth; (2) widening the pavement of NC Highway 12 within the existing right -of -way by up to 9-
feet on each side for a distance of approximately 1,300 linear feet; and (3) installing riprap for erosion
control along approximately 550 linear feet of the spoil site berm, all as depicted on the attached
workplan drawings.
2) Unless specifically altered herein, all work authorized by this minor modification shall be carried out in
accordance with the following workplan drawings (5): 1 dated as received on 11/13/13, 2 dated
10/21/13, 1 dated 11/12/13, and 1 dated as received on 12/5/13.

3) In accordance with 15A NCAC 07H .0306(k), the authorized structures shall be relocated or dismantled
when they become imminently threatened by changes in shoreline configuration. The structures shall be
relocated or dismantled within two years of the time when they become imminently threatened, and in any
case upon their collapse or subsidence. However, if natural shoreline recovery or beach re- nourishment
takes place within two years of the time the structures become imminently threatened, so that the
structures are no longer imminently threatened, then they need not be relocated or dismantled at that time.
This condition shall not affect the permit holder's right to seek authorization of temporary protective
measures allowed under 15A NCAC 07H.0308(a)(2).
4) Prior to the initiation of construction within the Ocean Hazard Area of Environmental Concern (AEC), a
representative of the N.C. Division of Coastal Management (DCM) shall approve the first line of stable,
natural vegetation and the corresponding setbacks. All development authorized by this minor
modification shall be located landward of the appropriate setback lines. These setback determinations
shall replace those done at the time the permit application was processed and approved. Construction
shall begin within sixty days of this determination or the measurement is void and shall be re- established.
In the case of a major shoreline change within that period, a new setback determination shall be required
before construction begins.
5) All buildings in the Ocean Hazard AEC shall be on pilings not less than 8 inches in diameter if round, or 8
inches to a side if square.
6) All foundations and structures shall be designed to be stable during applicable fluctuations in ground
elevation and wave forces during a 100 -year storm. Cantilevered decks and walkways shall meet this
standard or shall be designed to break -away without structural damage to the main structure.
7) All pilings within the Ocean Hazard AEC shall have a tip penetration greater than eight feet below the
lowest ground elevation under the structures. For those structures so located on the primary dune or
nearer to the ocean, the pilings shall extend to five feet below mean sea level.
Spoil Site Berm Erosion Control
8) The riprap shall not be placed below normal high water level at any point along its alignment.
9) Placement of riprap material shall be limited to the areas as depicted on the attached workplan drawings.
The riprap material shall be free from loose dirt or any pollutant except in trace quantities. The material
shall be of a size sufficient to prevent its movement from the approved alignment by wave or current
action.
10) Filter fabric shall be in place prior to the placement of any riprap.
11) All materials resulting from regrading of the berm shall be confined above normal high water level and
landward of regularly or irregularly flooded wetlands behind adequate dikes or other retaining structures
to prevent spillover of solids into any wetlands or surrounding waters.

12) Nothing in this permit authorizes any activity which has not received approval from the National Park
Service (NPS) for work within the Cape Hatteras National Seashore. The proposed work shall not
commence until the permittee has been issued a Special Use Permit from the NPS, and a copy of the
Special Use Permit is received by DCM.
13) The authorized activity shall not result in any permanent or temporary impacts to wetlands or waters of the
State.
14) This project shall conform to all requirements of the NC Sedimentation Pollution Control Act and the
N.C. Department of Transportation (NCDOT's) Memorandum of Agreement with the N.C. Division of
Energy, Minerals, and Land Resources.
15) The permittee and /or his contractor shall contact the DCM Transportation Field Representative to request
a preconstruction conference prior to project initiation.
16) This minor modification does not eliminate the need to obtain any additional permits, approvals or
authorizations that may be required.
17) If it is determined that additional permanent and /or temporary impacts are necessary that are not shown on
the attached workplan drawings or described in the authorized permit application, a permit modification
and /or additional authorization from DCM shall be required. In addition, any changes in the approved
plan may also require a permit modification and /or additional authorization from DCM. The permittee
shall contact a representative of DCM prior to commencement of any such activity for this determination
and any permit modification.
18) This minor modification shall be attached to the original of Permit No. 224 -87, which was issued on
11/20/87, as well as all subsequent modifications, renewals and letters of refinement, and copies of all
documents shall be readily available on site when a Division representative inspects the project for
compliance.
19) All conditions and stipulations of the active permit remain in force under this minor modification unless
altered herein.

and adjustment to the configuration of the previously authorized A jacks and sandbags around Bent
166, and (2) the installation of inlet floor armoring between Bents 162 and 166, all as depicted on the
attached workplan drawings.
2) Prior to the initiation of construction, the permittee shall contact the U.S. Coast Guard (USCG) to
determine if there are any USCG requirements for marking or mapping the location of the authorized

NOTE: This project will permanently impact approximately 0.24 acres of submerged inlet bottom.
9) The permittee and/or his contractor shall contact a DCM Field Representative in Elizabeth City to
request a preconstruction conference prior to project initiation.
10) This minor modification does not eliminate the need to obtain any additional permits, approvals or
authorizations that may be required. Such permits may include, but are not limited to, permits from the
N.C. Division of Water Resources, the U.S. Army Corps of Engineers and the U.S. Fish and Wildlife
Service. Any such permits shall be obtained prior to the initiation of construction.'
11) This minor modification shall be attached to the original of Permit No. 128 -04, which was issued on
8/26/04, as well as all subsequent modifications, letters of refinement, and renewals, and copies of all
documents shall be readily available on site when a Division representative inspects the project for
compliance.
12) All conditions and stipulations of the active permit remain in force under this minor modification unless
altered herein.
