Dear Mr. Brantley:
Please accept this letter as the Town of Troy's response to your letter received in
this office on October 17th, 2021, in regards to the NOV detailed in NOV-2021-
LV-0724.
The violations that were noted in the NOV were a result of a one-time event that
occurred as the Town of Troy was attempting to assist Montgomery County's
water plant and not from a town industrial user. The nitrogen and ammonia hits
that the Troy wastewater plant received were due to the receiving of Alum sludge
from the county's hauler. The hauler that Montgomery County had contracted
with (Hurley's Back Hoe Service) was instructed to bring the Alum sludge to the
wastewater treatment plant's drying beds, where it could have been
appropriately treated and disposed of. However, instead of doing this, the hauler
proceeded to empty alum sludge into one of the town's manholes, which fed
directly into the town's treatment facility. This event occurred on June 28th. This
event was communicated to the state upon notification of what happened.
As a result of this event, ammonia levels at the treatment plant spiked the
following week. This spike resulted in both the weekly average and the monthly
average Nitrogen/Ammonia concentrations to exceed the permitted allotment.
The ORC at the town's wastewater plant attempted to balance the plant by
adding lime to bring the pH back into balance, along with adding polymer to
assist in getting the solids to settle out, however the levels were still high.

The Town of Troy, after knowledge of what occurred, contacted the county and
ceased any further acceptance of the alum sludge. It was also communicated to
the county that a determination would be made whether they would receive a
fine for this incident.
The Town of Troy respects the mandates and the requirements that are
associated with operating this facility and have taken great strides to ensure that
we have as well as maintained system as possible. In addition, the town
confident that we have the best people in place to assure that the facility is
operating at the highest levels. While the operations of the town's wastewater
facility are of the highest importance, this event occurred while attempting, in
good faith, to assist another system with a problem that they were having.
