Dear Ms. Karoly:
Thank you for your letter dated December 21, 2006 to Mr. Carl R. Dawson, Jr., P. E., Public Works
Director of the City of Raleigh. Mr. Dawson has asked that I respond to your request for additional
information for the referenced project. The following information is in response to the concerns
expressed in your letter. I have listed your concerns in Italics for convenience in reviewing the City's
response.
1. Please clearly indicate Zone 1 and Zone 2 on the site plans, and show all temporary impacts
to buffers within both zones (Zone 1 was the only zone shown on the plan sheets).
• The enclosed revised Sheet 1 of 2 has been revised and now reflects both Zone 1 and Zone 2
on the plan sheets. A revised Sheet 2 of 2 has also been included which is an enlargement of
the work area shown on Sheet 1 of 2, and Zone 2 cannot be shown on the enlargement
because of the scale of the drawing.

I am enclosing five copies of this letter (including this copy) for your distribution to DWQ staff along
with five copies of Sheets 1 and 2 of 2 the plans. Also, I am enclosing five copies of revised Page 12 of
13 of the Pre-Construction Notification (PCN) form. It was determined that the square footage in Zones 1
and 2 required revision from what was indicated in the previously submitted PCN form. A copy of the
plan sheets and Page 112 of 13 of the PCN form is also being transmitted to the United States Army
Corps of Engineers.
It should be noted that this project is not for a development activity, but rather to stabilize an existing
problem that is contributing to degradation of water quality in the Perry Creek Watershed of the Neuse
River Basin. The activities for this project are intended to provide long-term protection for the
approximate 100-foot length of stream bank that has severely eroded and continues to experience active
erosion. This stabilization project will restrain further erosion, thereby improving water quality in the
Perry Creek Watershed that flows into the Neuse River.
Your consideration of this information for issuance of the Section 401 Water Quality Certification and
Neuse Buffer Basin Riparian Buffer Rules Authorization Certificate is greatly appreciated. Please contact

X. Proposed Impacts on Riparian and Watershed Buffers (required by DWQ)
It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to
required state and local buffers associated with the project. The applicant must also provide
justification for these impacts in Section VII above. All proposed impacts must be listed herein,
and must be clearly identifiable on the accompanying site plan. All buffers must be shown on a
map, whether or not impacts are proposed to the buffers. Correspondence from the DWQ
Regional Office may be included as appropriate. Photographs may also be included at the
applicant's discretion.

additional 20 feet from the edge of Zone 1.
The bank reconstruction within zone one of the buffer will i~act approximately 3,000 sg.ft. of
buffer. An additional 3980 sq.ft. of impacts will occur in zone one due to temporary construction
access to perform the work and an area designated for staging of materials. The S00 sq.ft. of
impacts in zone 2 will only be temporary for construction access and a portion of the sta>;in>;
area. Currently the buffer area in zone one has little to no woody vegetation, only grass. Zone 1
will be enhanced with the planting of riparian seed mix and woody vegetation on the top of the
bankfull bench terrace slopes, and terrace top to a distance of 10' beyond the top of bank with
this repair project. Zone 2, which is currentlygrasses, will be returned to its original condition.
If buffer mitigation is required, please discuss what type of mitigation is proposed (i.e., Donation
of Property, Conservation Easement, Riparian Buffer Restoration /Enhancement, Preservation or
Payment into the Riparian Buffer Restoration Fund). Please attach all appropriate information as
identified within 15A NCAC 2B .0242 or .0260.
