Mr. Chambless,
On November 17, 2021, the Division of Water Resources (Division) received your application
requesting a 401 Water Quality Certification from the Division for the subject project. The Division
has determined that your application is incomplete and cannot be processed. The application is on
hold until the following items are addressed:
1. Please clarify the total amount of proposed impacts below the normal pool lake level/normal
water level and above the normal pool lake level/normal water level. Impacts should be listed
in square feet. From the drawing submitted with the application, it appears that proposed
impacts are:
a. 3’ of stabilization below lake x 68’ of shoreline = 204 square feet of impact below water
level
b. 4’ of stabilization above lake x 68’ of shoreline = 272 square feet of impact above water
level
Please confirm if these totals are correct and if there are any additional impacts that should
be accounted for below and above water level. [15A NCAC 02H .0506(b)(1)] [15A NCAC 02H
.0502(c)]
Pursuant to Title 15A NCAC 02H .0502(c), the applicant shall furnish all of the above requested
information for the proper consideration of the application. If all of the requested information is not
received, the Division will be unable to approve the application and it will be returned.
Please contact me if you have any questions. You may provide your response via email or mail to the
