Dear Ms. Powell:
Please note that the Town of Garner is in receipt of the Notice of Compliance (NOC-2021-PC-1201)
Letter and Audit Report from the MS4 program audit that occurred on November 5, 2021.
This letter is to serve as the Town's acknowledgement of the requirements set forth in the NOC, as well
as the Town's intention to comply with those requirements. Staff will comply with these requirements
based upon the timeline as provided by Lauren Garcia on December 2, 2021, with the self evaluation of
permit components not reviewed by DEQ for compliance due by April 1, 2022 (Section B: Public
Education and Outreach, Section C: Public Involvement and Participation, Section E: Construction
Runoff Controls and Section H: Total Maximum Daily Loads), a Draft Stormwater Management Plan
(SWMP) utilizing the DEQ Phase II MS4 SWMP Template due April 1, 2022.

The Town already submitted a signed Final Draft SWMP for permit renewal on August 10, 2021 since
the one hundred and eighty (180) days prior to the permit expiration came before the audit. The Town of
Garner intends to respond to comments on the Draft Final SWMP and submit a final SWMP for DEQ
approval and final permit issuance. That final DEQ approved SWMP shall become an enforceable
component of the NPDES MS4 permit and an Annual Self -Assessment Template that corresponds to the
approved SWMP will be provided.
