Effective August 1, 2013, the State Stormwater program was transferred from the Division of Water
Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous
references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are
modified. Please note that this letter (permit) references DFNILR as the Division responsible for issuance
of the permit.
Permit Correction
The Wilmington Regional Office issued the Town of Kure Beach a permit for the subject project on
October 8, 1998 and recently discovered it contained an error. This permit correction is to clarify that the
expiration date listed on page 2 of this permit is correct. The second paragraph of the cover letter
incorrectly identified that this permit did not have an expiration date.
Permit Extension
On August 5, 2009, the Governor signed Session Law 2009-406. This law impacted any development
approval issued by the former Division of Water Quality under Article 21 of Chapter 143 of the General
Statutes, which was current and valid at any point between January 1, 2008, and December 31, 2010 The
law extended the effective period of any stormwater permit that was set to expire during this time frame
to three (3) years from its current expiration date. On August 2, 2010, the Governor signed Session Law
2010-177, which granted an extra year for a total of four (4) years extension. Accordingly, this permit,
which was set to expire on October 8, 2008, shall now be effective from the date of issuance until October
8, 2012, which includes all available extensions.
Renewal Request
Per 15A NCAC 2111003(h) (the stormwater rules), applications for permit renewals shall be submitted
180 days prior to the expiration of a permit and must be accompanied by a processing fee, which is
currently set at S505.00. Please complete and submit a renewal application prior to December 16, 2016.

This project is subject to the conditions and limitations as specified in the original permit. Please be
advised that you are required to comply with the terms, conditions and limitations of the Stormwater
Management Permit under Title 15A North Carolina Administrative Code 2H .1003 and North Carolina
General Statute 143-214.7 until you submit the required Name/Ownership Change Form to the Division
and receive approval from the Division to transfer the permit. This includes providing the necessary
operation and maintenance of the permitted stormwater system. The Name/Ownership Change Forms are

The operation of the stomnvater treatment system without a valid and active permit and/or failure to
operate and maintain the stormwater treatment system, are violations of NCGS 143 Article 21 and may
result in appropriate enforcement action. If you have any questions, need additional copies of the permit

No problem. I'm just glad to get the information to where it needs to go. Here's a pdf of the letter that sent in mid -
September to 522 Anchor Way regarding SW8 961234 but was returned in mid -October as "No mail receptacle unable to
forward". I can update this letter if given a current mailing address.
There also seems to be two other Kure Dunes permits:
- SW8 920807 — Kure Dunes Phase II issued to Town of Kure Beach. The latest version of this permit dated
October 8, 1998 has conflicting information regarding the expiration of the permit. The cover letter says it does
not expire, however the permit says it expired on October 8, 2008. Being a high density permit with
underground infiltration devices, it should have had an expiration date.
- SW8 950709 — Kure Dunes Phase III issued to Kure Beach Associates (a dissolved LLC). The latest version of this
permit dated October 8, 1998 has the same conflicting information on the expiration date. However, this one
being solely an offsite permit should not have an expiration date. Being that the permittee is dissolved, the
permit will have to be transferred to the HOA (or other responsible entity), likely under the provisions of SL
2013-121.
I will likely issue corrections to clarify that SW8 920807 has an expiration date and that SW8 950709 does not. Please
let me know if you have any questions or concerns.
