Foster, II, Mayor Town of Kure Beach Post Office Box 3 Kure Beach, North Carolina 28449 Subject: Certification of Compliance with Stormwater Regulations Stormwater Project No. 920807 Kure Dunes, Phase II New Hanover County Dear Mayor Foster: This Certification is pursuant to the application for Kure Dunes, Phase lI received on July 15, 1992, with additional information received on November 30, 1992. Based on our review of the project plans and specifications, we have determined that the Kure Dunes, Phase II stormwater control system complies with the Stormwater Regulations set forth in Title 15A NCAC 2H.1003(i). The lots numbered 30R-33R and 34-54 are limited to 70% of the lot area as built -upon surface (Deed restrictions attached). The runoff will be treated in a detention pond sized to achieve 90% reduction in Total Suspended Solids, and in exfiltration trenches for a portion of the entrance road and for Lots 31R-33R. Any modification of the plans submitted to this Office or further development of this site will require an additional Stormwater Submittal/Modification and approval prior to initiation of construction. Modifications include but are not limited to; project name changes, transfer of ownership, redesign of built -upon surfaces, addition of built -upon surfaces, redesign or further subdivision of the project area. This Certification shall be effective from the date of issuance until rescinded. The project shall be constructed and maintained in accordance with the plans and specifications approved by the Wilmington Regional Office. This Certification does not supersede any other permit or approval. This could include the Division of Coastal Management under CAMA requirements, The Division of Environmental Management under Wetland 401 Water Quality Certification and/or a Dredge and Fill Permit and/or a Sewer Extension/Collection Permit, U.S. Army Corps of Engineers 404 Wetland Permit, local County or Town Agency permits under their local ordinances, or others that may be required. Deed restrictions have been received and recorded with the Office of the Register of Deeds. A copy of the recorded restrictions, including deed book and page number, has been forwarded to this Office. Future phases are included in the design, however, plans must be submitted for those phases before they are built to check the routing and to verify that the number of lots previously accounted for in the pond design is not exceeded. A professional engineer must certify that the stormwater system has been installed in accordance with the approved plans and specifications upon completion of construction. The attached certification should be received by this Office within 30 days of completion of construction. A preliminary review of that information has determined that the submittal for the subject project is not complete. Per our conversation on November 12, 1992, the following information is needed to continue the stormwater review: 1. I do not understand how the exfiltration system B will work. The only inlet into the system is at the lowest point of the system. Even with the overflow set at elevation 16.8, which is the end elevation of line B-1, you still will be trying to make water flow uphill. 2. A portion of lots 33 and 34 are not being caught by the swale. The swale should be extended up the north property line and a restricted easement agreement placed on Lots 31, 32, and 33 to keep that swale functioning as designed. 3. The roadside exfiltration system is fine except for needing seasonal high water table information in that area. 4. Deed restrictions limiting the built -upon area for the project must be signed and notarized before the Certification can be issued. Entrance Road System (Recharge System "A"): (1) The entrance road exfiltration system has to be separated from stormwater from lots 21 and 22. The stormwater from these two lots is routed under the entrance road and into the outlet ditch northward towards Spotters Court. (2) The entrance road exfiltration system is broken into three separate systems because of the grade of the road. Each system consists of a drop inlet on each side which is piped into an exfiltration trench. The systems at Stations 1+85 and 2+35 are set so after the first inch is stored any additional stormwater will overflow out of the drop inlet westward towards US 421. The exfiltration system at Station 1+05 has a piped overflow which passes stormwater in excess of one inch to the grassed roadway ditch. �������� B. The Owner has decided not to provide restrictive covenants on limited built -upon area. Instead, the built -upon area will be increased to 70 percent of the lot area, which is the maximum the Town of Kure Beach zoning allows. A copy of the Town's ordinance which limits impervious area is at- tached. By increasing pond depth to 7.5feet, the increased area can be accommodated. See the revised calculations. 2. The pond slopes have been checked and clarified to maintain the required 3 to 1 slope. 3. The pond outlet structure has been moved 20 feet farther west from the outlet in lieu of placing a baffle at the pond inlet. 4. The outlet deice has been revised to show an orifice opening required for Phase II and future area undeveloped. In addi- tion, we have calculated storage and orifice size require- ments for future Area A developed only and then the total future area developed. The riser overflow will remain at the required height for the fully developed condition. Orifice sizes at storage height for each condition are as follow: a. Match lines are shown on Sheets 1 and 2. In addition, Plan Sheet No. 5 shows the composite project area. The catchment area for the pond and exfiltration system is delineated on this sheet. 2. Included as required is an hydraulic conductivity test provided by Soil Tech Engineering, including the seasonal high water table. This information is shown as Attachment No. 2. In addition, the ground elevation at the test loca- tion of Lots 25 and 28 is 15.00 and 14.4 respectively. This gives a seasonal high water table of 12.00 and 11.4 at each location. The exfiltration system was raised to Elevation 14.00 to accommodate this new information. 3. Runoff in excess of one inch is to be bypassed into a new roadway ditch along U.S. Highway 421. The exfiltration sys- tem has been revised and has two overflows. A description of the revision is addressed in Item 8. The proposed exfiltration system is located within a public utility easement dedicated to the Town. This easement is recorded in the New Hanover County Registry under Map Book 27, Page 94. In addition, please find attached a copy of the driveway permit from NCDOT. 6. The off -site runoff of 1.72 acres is located in the south- west corner and is shown on Plan Sheet 3. A smaller scale map (Attachment No. 5) is included which shows topo informa- tion for this area. 7. The topographic contours shown on the plans were both exist- ing and proposed contours as per the plan legend. However, the proposed contours have now been revised from the initial review set in order to address Item 8 of the comments. 8. Plan Sheets 1 and 2 have been revised to show proposed finish grades which will help establish routing of stormwater to the detention pond and exfiltration system. a. With the exception of Lots 31, 32, and 33, all stormwater from Phase II lots can be routed to the detention pond. These three lots have been added to the exfiltration system first by adding Drop Inlet No. 14 which is routed to a new infiltration line. Drop Inlet No. 15 provides the required overflow from this system. A second exfiltration pipe and stone have been added to accommodate the stormwater. The plans and design calculations have been revised to reflect these changes. b. Plan Sheet No. 5 shows the approximate delineation of the catchment areas. 9. The majority of the property affected by Phase II was filled two feet or more by the construction of the Dow Chemical facility prior to World War II. Any wetlands now existing would be centered around the outlet ditch west of "N" and Fourth Avenues and would be less than one-third of an acre. 10. Drop Inlet No. 1 needs to remain as shown. A future pipeline will be located opposite the most western cul-de- sac. The outlet structure can be moved westward 20 feet.
