On March 31, 2014, the Wilmington Regional Office of the Division of Energy, Mineral and Land
Resources (DEMLR) conducted a file review inspection of Riggsfield Subdivision in Onslow County to
determine the status of compliance with the State Stormwater Management Permit Number SW8
080830 issued on October 8, 2008. DEMLR file review and site inspection revealed that the site is
compliant with the terms and conditions of this permit. Please find a copy of the completed form
entitled "Compliance Inspection Report" attached to this letter, which summarizes the findings of the
recent inspection. This inspection is a follow up inspection from previous inspections on November 7,
2011; April 4, 2012; and March 19, 2014. Deficiencies previously identified have been corrected.
Please be advised that you are required to comply with the terms, conditions and limitations of your
Stormwater Management Permit under Title 15A North Carolina Administrative Code 2H .1003 and
North Carolina General Statute 143-214.7, including operation and maintenance of your permitted
stormwater system. Violations of your Stormwater Management Permit may be subject to the
assessment of civil penalties of up to $25,000 per day per violation.
If the project has changed its name, ownership, or mailing address, it is your responsibility to submit a
completed and signed Name/Ownership Change form to DEMLR at least 30 calendar days prior to
making the changes. Please include the name, mailing address and phone number of the person or
entity that is now responsible for this permit on the Name/Ownership Change form.

On March 19, 2014, the Wilmington Regional Office of the Division of Energy, Mineral and Land Resources (DEMLR)
conducted a file review for the subject project to determine the status of compliance with the State Stormwater
Management Permit Number SW8 080839 issued on October 8, 2008. DEMLR file review revealed that the site is
not compliant with the terms and conditions of this permit. Please find a copy of the completed form entitled
"Compliance Inspection Report" attached to this letter, which summarizes the findings of the recent inspection.
As indicated in the attached inspection report, the following deficiencies must be resolved:
1. Please submit the Designer's Certification for the rock pad which was installed to address the
erosion issue per our October 11, 2013 email. Once this document is received, the project will be in
compliance.
Please inform this Office in writing before April 2, 2014, of the specific actions that will be undertaken and the time
frame that will be required to correct the deficiencies. Failure to provide the requested information, or to respond to
this letter by the due date, may initiate enforcement action including the assessment of civil penalties of up to
$25,000 per day. If a written plan of action is not submitted to this office by Date then DEMLR staff will re -inspect the
site and issue a Notice of Violation if the listed deficiencies have not been addressed.
If the project has changed its name, ownership, or mailing address, it is your responsibility to submit a completed and

On November 7, 2011 and April 4, 2012, Kelly Johnson of the Wilmington Regional Office of the
Division of Water Quality (DWQ) inspected Riggsfield Subdivision in Onslow County to
determine compliance with Stormwater Management Permit Number SW8 080830 issued on
October 8, 2008. A letter was mailed to you on November 8, 2011 asking you to remove the
pipe between lots 7 and 8,.to submit deed restrictions, and to submit a certification that the
project has been constructed within substantial compliance of its permit. You submitted
recorded deed restrictions and a certification on November 22, 2011. The Division of Land
Resources and the Division of Water Quality Wetlands Unit have inspected the site within the
last month and have reported that the pipe between lots 7 and 8 is still in place. Please remove
the pipe.
Please inform this Office in writing before May 4, 2012, of the specific actions that will be
undertaken and the time frame that will be required to correct the deficiencies. Failure to provide
the requested information, or to respond to this letter by the due date, may initiate enforcement
action including the assessment of civil penalties of up to $25,000 per day. If a written plan of
action is not submitted to this office by December 8, 2011 then DWQ staff will re -inspect the site
and issue a Notice of Violation if the listed deficiencies have not been addressed.

As indicated in the attached inspection report, the following deficiencies must be resolved:
1. Pipe: The lot line swale between lots 7 and 8 has been piped, and it needs to be a
swale per the approved plans. Pipes are only allowed in low density projects if they are
necessary to transport water underneath impervious surfaces such as driveways,
sidewalks or roads. Please ensure that the swale is returned to its permitted condition
as shown in the attached pictures.
2. Deed Restrictions: Please submit a copy of the recorded deed restrictions per Section
II(9) of your permit.
3. Certification: Please submit a certification that the project has been constructed as
was permitted per Section II(7) of your permit.
Please inform this Office in writing before December 8. 2011, of the specific actions that will be
undertaken and the time frame that will be required to correct the deficiencies. Failure to provide
the requested information, or to respond to this letter by the due date, may initiate enforcement
action including the assessment of civil penalties of up to $25,000 per day. If a written plan of
action is not submitted to this office by December 8, 2011 then DWQ staff will re -inspect the site
