All proposed infiltration areas and existing, active utility lines located within the proposed basin/trench
must be marked and flagged. If these areas are not flagged, the Soils Scientist reserves the right to
decline to do the investigation. If the proposed infiltration system will be located in an area of existing
pavement and there is no open area nearby, equipment capable of breaking through the impervious
layer must be provided. The soils investigation does not take the place of a soils report prepared by
an appropriate professional. The Soils Scientist will only verify the soil conditions that are reported in
the Soils Report, and make a determination as to the suitability of the site to meet the infiltration
design requirements under NCAC 2H.1000, and assumes no liability should the system fail.

The Division of Water Quality (DWQ) received a request from Lauren Acosta, Camp Lejeune
Environmental Office, to assist in a study to reduce Bird/Wildlife Aircraft Strike Hazard (BASH)
incidents at the Air Station. DWQ was asked to consider allowing the use of low profile, low
maintenance shrubs on the aquatic shelf of selected permitted wet detention ponds that have
high geese usage. The study approach proposes to decrease geese usage of the ponds by
planting shrubbery that will create cover for geese predators and steepen the takeoff/landing
angles for the geese. Basically the theory states that if the geese have to walk through high
vegetation, where predators could be hiding, to access a nearby feeding area, or if the angle of
takeoff and landing is too steep, then the geese may not find the pond a favorable habitat.
The study calls for the installation of four shrub species on the outer edge of the aquatic shelf,
Baccharis hamilifolia, Itea virginica, Lindera benzoin, and Ilex glabra. According to the
documentation submitted with the request, these species were chosen for the following reasons
1. The height should not exceed 4-5 feet above the top of the pond bank;
2. The fruits are not a significant food source for geese;
3. They can adapt to wet or dry growing conditions and low soil nutrients; and,
4. They are available for a December 2011/January 2012 planting period.

The Division is approving your request as proposed, subject to the following conditions:
1. Use as many non -deciduous shrub species as possible to avoid adding additional floating
debris to the pond.
2. Provide the Division with a copy of the final report of the study's conclusions.
3. Upon receipt of this approval letter send signed and dated copies of each "BASH Mitigation
— Stormwater Plantings Operation and Maintenance Agreement Addendum" to DWQ. This
agreement will be placed into the file for each stormwater project listed above and will
become an enforceable part of that permit.
4. Notify the Division immediately of any compliance issues or nuisance maintenance
conditions that arise as a result of the use of these shrubs.
5. If the Division concludes that the use of the shrubbery creates a compliance issue or leads to
nuisance maintenance conditions, then the Division may require that the shrubs be removed
and the pond be restored to its original design condition.

Our contractor has provided the following responses for your questions:
1. We are going with low profile. The cross section showed a maximum height of 8 feet until we knew exactly
what species of shrubs were available. The two species proposed for planting have a growth habit of 4-6 feet.
2. We only want to complete this project for the 5 ponds submitted. The other ones are not part of the pilot
project for a variety of reasons.
3. One of the shrubs, the ilex glabra is considered evergreen and should keep most leaves. The itea virginica, will
drop some leaves but they are small and should add little debris to the pond. If this turns out not to be the case
we will reassess at that time and remove the shrubs if necessary. As for providing predator cover in winter, the
shrubs will still be able to provide the predator cover geese are afraid of. Additionally, the purpose of the shrubs
is not to provide only predator cover but to break up the water land interface and obstruct takeoff and landing
angles of the geese (see more below).
4. We proposed shrubs over grass for three reasons: First we wanted a greater barrier to break up the water land
interface and secondly, we are hoping to obstruct takeoff and landing angles. They prefer gentle approaches
and takeoff and a steeper approach will deter to some degree. Lastly, these shrubs will be planted just outside
the water's edge in areas currently maintained as lawn to avoid any effect on the pond capacity.
5. Cameras will not be used but a BASH program employee will continue to monitor and document these areas for
geese usage.

1. Your original proposal was for "low -profile" shrubs that were going to be 3-6 feet in height. The cross-
section view you sent shows a shrub that is a total of 8 feet high. Is it necessary to have a shrub that is
8 feet tall? From the perspective of maintenance, a lower profile shrub would make it easier to inspect
and maintain without having to go to the trouble and time of removing and replanting.
2. You only submitted O&M documents for 5 of the 8 projects. Please submit addendum O&M documents
for SW8 970219, SW8 960501 and SW8 080126.
3. Please make sure to specify shrubs that keep their leaves over the winter. Deciduous shrubs that drop
their leaves in the winter will not provide the predator cover that the geese are afraid of and will add a
lot of floating debris to the pond, leading to an increased potential for clogging.
4. Is there a reason why you have not proposed the use of tall grasses on the vegetated shelf instead of
shrubs? The requirement to limit grass height to 6" is for the slopes, not the shelf.
5. Will video cameras be placed at these ponds to record long-term success in keeping the birds/geese
away?

II. Vegetation Considerations
The shrub species selected for planting were eaccharis hamilifolia, Itea virginica, Lindera benzoin, and
Ilex globro. These species were selected based on the following four criteria:
• Shrub height — shrubs should not exceed 4-5 feet above top of pond bank at full growth;
• Low wildlife food potential — fruits of the shrub provide little food source;
• Shrub adaptations —shrubs can live in either wet conditions or very dry, low soil nutrient
conditions depending on planting location;
• Plant availability— plants are available for December 2011/January 2012 planting period.
Shrubs will be planted at the water's edge determined by the permanent pool elevation. Plantings will
be spaced five feet apart and the remainder of the pond slopes will remain stabilized with grass.

case and require a copy of the study they are planning on conducting. We will add the 0 & M with all the drawings they
sent to each of these permits (see permit #'s below). And we should state that halfway through the study we would like
a tour of the ponds to observe how it is working.

The requested planting details, pond locations and generic diagrams are included as an attachment. The proposed plan
includes 8 wet detention ponds that had the highest amount of geese usage during the study period and were in close
proximity to the flight line. All of the ponds listed are active stormwater treatment measures and are currently

Will you be combining any groundcover with the scrubs? Do you have any drawings showing how they would be placed
and how they would keep the soil stable? If you can give me more information (diagrams, details on plantings and O &
M) I can probably give you an answer once I discuss with Raleigh.

MCB Camp Lejeune is currently working on a project to reduce BASH (Bird Animal Strike Hazard) from the flightline at
the New River Air Station. BASH is a high priority at all military airfields due to safety. The main attracting feature, for
birds, along our flightline is the many adjacent stormwater ponds. The project contractor has proposed the installation
of low profile, low maintenance shrubs along the aquatic shelf of each pond with a high amount of geese usage. The

shrubs proposed will be 3-6' in height and are native species. The O&M agreements require removal of shrubs and trees
from pond embankments. Would these plantings be in violation of these requirements? Also, would the Base need to
submit permit modifications? Any assistance you can provide would be greatly appreciated.
