Stormwater Plan Comment Response
Dear Ms. Johnson:
We received your request for additional information dated 12/7/15 for the subject project and offer the following
remedies:
Signature Authority [er 1511 ATCAC 21-1 021-1. 1003C(1)]: 7 he regulations require the either the President or Dice
President of corporation sign the application documents. The North Caroline Secretary of.State lists Samuel Burns as the
President of Seaside Townhomes, Inc, but does not list any other individuals. Please either submit documentation that Mr.
117ilkes is the Vice President as is shown on the application, or have Mr. Bums sign the documents.
a. The documents have been signed by Mr. Burns and have been included with this
submittal.
Impervious Area: The master permit, SI178 960516, allows 80% of the lot area to be impervious. The previous permit
was written for 317,292 square feet of impervious for the 428,195 square foal lot. I will put the increase on the application
as "fuukure". (1 he "fuduar"on the form will inrease from 40,493 sf to 65,757 sf.)
a. Duly noted.
Plans:
a. Project Arra: Please show the entire 9.83 ac to be permitted on the plan (as was shown on sheet Cl of the 2006
plans, but that sheet is changing.)
i. The revised sheet has been included with this submittal and is now numbered
C6.0. Previously submitted sheet C6.0 is now C6.1. Both revised sheets have
been included with this submittal. These sheets as well as the previously
permitted sheet should be kept in the set for reference.
b. Full Set: I17ill the plans submitted fuullp nplac e the plans permitted in 2006, or do some of those 2006 plans need
to be brought into the full set?
i. As most of the development has been constructed and only the rear portion is
being affected by the permit modification as well as the name of the engineering
firm and sheet numbering system the revised sheets and previously permitted
sheets should be incorporated into one set of plans to avoid confusion.

The Wilmington Regional Office received a modified Stormwater Management Permit Application for
Dockstreet Townhomes on January 6, 2016. A preliminary review of that information has determined
that the application is not complete. The following information is needed to continue the stormwater
review:
1. Signature Authority [per 15A NCAC 2H 02H.1003(e)(1)]: The regulations require that either the
President or Vice President of a corporation sign the application documents. The North Carolina
Secretary of State lists Samuel Burns as the President of Seaside Townhomes, Inc., but it does not
list any other individuals. Please either submit documentation that Mr. Wilkes is the Vice
President as is shown on the application, or have Mr. Burns sign the documents.
2. Impervious Area: The master permit, SW8 960516, allows 80% of the lot area to be impervious.
The previous permit was written for 317,292 square feet of impervious for the 428,195 square
foot lot. I will increase the impervious allowed to 342,556 square feet, which is 80%. I will put
the increase on the application as "future". (The "future" on the form will increase from 40,493sf
to 65,757sf)
3. Plans:
a. Project Area: Please show the entire 9.83ac to be permitted on the plan (as was shown on
sheet CI of the 2006 plans, but that sheet is changing.)
b. Full Set: Will the plans submitted fully replace the plans permitted in 2006, or do some
of those 2006 plans need to be brought into the full set?
Please keep in mind that changing one number may change other numbers and require the calculations,
supplements, and other supporting documentation to be updated. Verify all numbers are correct to ensure
consistency in the application documents.
Please note that this request for additional information is in response to a preliminary review. The
requested information should be received in this Office prior to February 15, 2016, or the application
will be returned as incomplete. The return of a project will necessitate resubmittal of all required items,
including the application fee.
If you need additional time to submit the information, please email or fax your request for a time
extension to the Division at the address and fax number at the bottom of this letter. Please note that a
second significant request for additional information may result in the return of the project.
The construction of any impervious surfaces, other than a construction entrance under an approved
Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject to enforcement
action pursuant to NCGS 143-215.6A.

the subject project on October 22, 2015. A preliminary review of that information has determined that the
application is not complete. The following information is needed to continue the stormwater review:
Modification: This project was submitted as a Plan Revision, but since it is converting a non -
subdivided project into a subdivided project it is a modification. Please submit a full
modification package including the application, $505 fee, deed restrictions, plans showing the
subdivision lines, and the other applicable documents listed on the application. I have not gone
through the file in detail because I will need the modification documents to do so. When they are
submitted, I will review them and be back in touch.

2. Drainage Easement to be Abandoned: Sheet C3 shows a drainage easement to be abandoned.
This permit, SW8 060126, drains offsite to SW8 960516 — The Village at Sunset Beach. Please
ensure that the drainage plans for SW8 060126 and SW8 960516 are consistent. I do not see
record on SW8 960516 that that pipe has been relocated.
Please keep in mind that changing one number may change other numbers and require the calculations,

Please see the attached letter which we discussed earlier. Also, it looks like you are moving the 48" pipe? Where is thal
pipe going? I think it was that pipe that collapsed a few years ago. We got a lot of calls about it, and so I put together
the attached notes from what I could find in the SW8 960156 file. I just want to make sure that its location is consistent
between this permit and the master, SW8 960156. 1 don't know what ever happened to the pipe.

Chris,
I have a general question on this one. It looks like you are going to take the "back" row of townhomes and convert them
to single family homes. There are currently 4 buildings with a total of 27 townhomes (7, 7, 7, and 6 per building), and
there will now be 16 single family homes. This was submitted as a Plan Revision and the application says that the
impervious allocations haven't changed. The current permit isn't subdivided, though? There aren't any allocations per
lot in the permit, and there are no deed restriction requirements in the permit. Am I looking at this wrong? It looks like
you plan to subdivide, re -allocate, deed restrict, etc?

There is a permit for Dock Street Townhomes (SW8 060126) that drains offsite to the Village at Sunset Beach. You may
remember a few years ago that there was a 48" pipe that collapsed underneath a townhome. Has that pipe been
relocated (or is there a plan to relocate it)?
I don't see a change for it on the SW8 960156 plans. (See first two sheets attached). Dock Street is showing it on a
current application to be relocated, but it doesn't show where it will go. The rest of the attached file contains my 2013
notes from the two files, SW8 960516 and SW8 060126, trying to piece together what to do with that pipe when we
started getting complaint calls about it. I just want to make sure that the two permit show the pipe in the same place. I
have written the attached letter to the Dock Street applicant (East Coast Engineering) asking them the same question, so
FYI.

STORMWATER PLAN REVISON
The original site is a 9.83-acre tract located on Sunset Blvd. (NC 179) in Seaside Village, Sunset
Beach, North Carolina. The original proposed development on the site consisted of eighteen
townhomes, roads and parking areas, and the installation of water and sewer to serve the multi-
family buildings and was permitted in January 2006, under Stormwater Permit #SW8 060126.
Construction was partially completed in early 2007.
Four of the eight townhomes were constructed and utilities were installed. The remaining four
multi -family buildings will be replaced by sixteen single-family homes. These sixteen single family
homes will now be referred to as Seaside Village Subdivision.
The proposed roadway is fundamentally the same with minor modifications to accommodate on -street
parking and a mailbox area. The stormwater runoff will be directed to the existing off -site stormwater
pond (permitted by SW8 960516) as permitted in the original plan via curb and gutter, curb inlets,
roofline gutters and underground piping.

The DWM/UST Section is a regulatory Division, we do not act as an environmental consulting firm. If you do additional
environmental assessment on your property and petroleum contamination, above NC state action levels for Soil and/or
Groundwater are encountered then a report may be submitted to my attention and I can direct the Responsible Party
(in this case the RP may be the owner of the storm water drain but that would need to be determined) to proceed with
cleanup activities.
As the excavation pit was not open at the time of the site visit I conducted, the DWM could not observe Soil and/or
Groundwater contamination. And as there are not Soil or Groundwater lab results we cannot direct additional work at
this time.
I have also copied Brad Newland of the Air Quality Section on this email and attached a copy of your Indoor/Residential
air quality sampling results. I am not sure if he can add any additional comments to the comments that the lab already
made in the summary of lab results.
Brad ... if after looking over the attached lab results, is there any other information that you can offer for this
site. Thanks for your help in this matter.

A "site observation?"
Assuming there actually remains any contamination after years of spilliage from the severed pipe front to back
of the 7602-6 Townhome, IT WOULD BE IN THE SOIL UNDER THE HOUSE! We already know the air
was "contaminated" while we lived there, with enough toxins to make us all severely ill; the hospital records
show how sick we actually were.
Furtheremore, what residual toxins still remain in the pipe under ground as it sits today? A "site observation"
proves nothing and does not serve any cause to insure safety and inhabitability in that unit for anyone. This
hardly satisfies the remaining questions in this case, and I find this new revelation altogether very
disappointing. More tests need to be conducted.

A site visit has been conducted at 7602-6 High Market Street. The excavation pit was filled in and no
observations of petroleum soil or groundwater contamination was observed. Therefore the UST section will not
be making this into an incident case.
I had sent your air quality sample results to the UST Sections epidemiologist and our lab specialist, after
looking over the data they concluded that the air quality does not correlate to a petroleum release. And that the
quality of the air was typical to find when there has been a storm water release. Therefore, the UST Sections
epidemiologist will not conducted a Health Risk Evaluation (HRE) for this site, as it does not relate to a
petroleum release.

(permit attached). Is your particular row of townhomes under a different development name? I scanned in
most of the plan of SW8 960516 (attached). (We have a small scanner so I could not get the whole thing in the
frame.) I also cross-referenced that permit to find related permits (see the summary). I do not see where your
particular section of that development was included in the permitted plan. If there is an alternate name, I can
search for that. But, if not, I do not think that the permit was updated to show the details of your townhome.

I was referred to you by Robert N. Jones from the Inspector Generals Office.
Please check in to the following.
My home was built over a 4ft storm water drain pipe that runs from Hwy 904
through a shopping center with a gas station then turns and runs front to back
of the dwelling out to a retinsion pond and that pond feeds to another pond. After heavy rains a sink hole developed
behind my garage and one in front of the house. After excavating down to the pipe it was found that the 4' pipe had
collapsed down to 2'.
The pipe failed under my house. My family got sick. We had the air tested and 21
toxic chemicals were found in the house air.The Town of Sunset Beach nor the
developer has tested the soil or water runoff. They have not investigated where
these chemical are coming from. Some of the chemicals found indicate they may
have come from toxic backfill or some industrial site and/or leaking gas tanks.
Found in the air were: Xylene (para, meta), Ethyl Benzene, Touene, Formaldehyde,
Tetrachloroethene (also Perchloroethylene)1,2-dichloroethane, Ethyl acetate,
butonone, acetone, isopropanol, ethanol, chloromethene, DiMethyl ether, Butane,
Acetaldehyde, Butane 2-methyl, Hexanal, a-pinene,B-pinene, limonene and nonanal
(also called pelargonaldehyde or nonanaldehyde.
We believe that not only is the water toxic but the soil also.
The location of the house is 7602 High Market Street Unit 6, Sunset Beach, NC 28468.
Picture #3 shows how the pipe has collapsed. I know it is like that all under my house and going out to the pond but I am
not sure what it is like coming through the shopping center. I would like the soil at/around my house tested and would like
the water in the retention pond leading to the other pond tested to see if the chemicals are going into the ground water.

We received your request for additional information dated 12/7/15 for the subject project and offer the following
remedies:
Signature Authority [per 15A ATCAC 21-1 021-1. 1003E(1)]: The regulations require the either the President or Vice
President of a corporation sign the application documents. The North Caroline Secretary of State lists Samuel Burns as the
President of Seaside Townhomes, Inc., but does not list any other individuals. Please either submit documentation that Mr.
Vilkes is the Vice President as is shown on the application, or have Mr. Bars sign the documents.
a. The documents have been signed by Mr. Bums and have been included with this
submittal.
Impervious Area: The matter permit, SII18 960316, allows 80% of the lot area to be impervious. The previous permit
was written far 317,292 squarefeet of impervious for the 428,195 squarefoot lot. I will put the increase on the application
as ydun ". (The 'Yuture" on the form will increase from 40,493 sf to 65,757 of)

The Wilmington Regional Office received a modified Stormwater Management Permit Application for
Dockstreet Townhomes on January 6, 2016. A preliminary review of that information has determined
that the application is not complete. The following information is needed to continue the stormwater
review:
I. Signature Authority [per 15A NCAC 2H 02H.1003(e)(1)]: The regulations require that either the
President or Vice President of a corporation sign the application documents. The North Carolina
Secretary of State lists Samuel Burns as the President of Seaside Townhomes, Inc., but it does not
list any other individuals. Please either submit documentation that Mr. Wilkes is the Vice
President as is shown on the application, or have Mr. Burns sign the documents.
2. Impervious Area: The master permit, SW8 960516, allows 80% of the lot area to be impervious.
The previous permit was written for 317,292 square feet of impervious for the 428,195 square
foot lot. 1 will increase the impervious allowed to 342,556 square feet, which is 80%. I will put
the increase on the application as "future". (The "future" on the form will increase from 40,493sf
to 65,757sf)
3. Plans:
a. Project Area: Please show the entire 9.83ac to be permitted on the plan (as was shown on
sheet C1 of the 2006 plans, but that sheet is changing.)
b. Full Set: Will the plans submitted fully replace the plans permitted in 2006, or do some
of those 2006 plans need to be brought into the full set?
Please keep in mind that changing one number may change other numbers and require the calculations,
supplements, and other supporting documentation to be updated. Verify all numbers are correct to ensure
consistency in the application documents.
Please note that this request for additional information is in response to a preliminary review. The
requested information should be received in this Office prior to February 15, 2016, or the application
will be returned as incomplete. The return of a project will necessitate resubmittal of all required items,
including the application fee.
If you need additional time to submit the information, please email or fax your request for a time
extension to the Division at the address and fax number at the bottom of this letter. Please note that a
second significant request for additional information may result in the return of the project.
The construction of any impervious surfaces, other than a construction entrance under an approved
Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject to enforcement
action pursuant to NCGS 143-215.6A.

the subject project on October 22, 2015. A preliminary review of that information has determined that the
application is not complete. The following information is needed to continue the stormwater review:
1. Modification: This project was submitted as a Plan Revision, but since it is converting a non -
subdivided project into a subdivided project it is a modification. Please submit a full
modification package including the application, $505 fee, deed restrictions, plans showing the
subdivision lines, and the other applicable documents listed on the application. I have not gone
through the file in detail because I will need the modification documents to do so. When they are
submitted, 1 will review them and be back in touch.
2. Drainage Easement to be Abandoned: Sheet C3 shows a drainage easement to be abandoned.
This permit, SW8 060126, drains offsite to SW8 960516 —The Village at Sunset Beach. Please
ensure that the drainage plans for SW8 060126 and SW8 960516 are consistent. I do not see
record on SW8 960516 that that pipe has been relocated.
Please keep in mind that changing one number may change other numbers and require the calculations,

Please see the attached letter which we discussed earlier. Also, it looks like you are moving the 48" pipe? Where is that
pipe going? I think it was that pipe that collapsed a few years ago. We got a lot of calls about it, and so I put together
the attached notes from what I could find in the SW8 960156 file. I just want to make sure that its location is consistent
between this permit and the master, SW8 960156. 1 don't know what ever happened to the pipe.

I have a general question on this one. It looks like you are going to take the "back" row of townhomes and convert them
to single family homes. There are currently 4 buildings with a total of 27 townhomes (7, 7, 7, and 6 per building), and
there will now be 16 single family homes. This was submitted as a Plan Revision and the application says that the
impervious allocations haven't changed. The current permit isn't subdivided, though? There aren't any allocations per
lot in the permit, and there are no deed restriction requirements in the permit. Am I looking at this wrong? It looks like
you plan to subdivide, re -allocate, deed restrict, etc?

There is a permit for Dock Street Townhomes (SW8 060126) that drains offsite to the Village at Sunset Beach. You may
remember a few years ago that there was a 48" pipe that collapsed underneath a townhome. Has that pipe been
relocated (or is there a plan to relocate it)?
I don't see a change for it on the SW8 960156 plans. (See first two sheets attached). Dock Street is showing it on a
current application to be relocated, but it doesn't show where it will go. The rest of the attached file contains my 2013
notes from the two files, SW8 960516 and SW8 060126, trying to piece together what to do with that pipe when we
started getting complaint calls about it. I just want to make sure that the two permit show the pipe in the same place. I
have written the attached letter to the Dock Street applicant (East Coast Engineering) asking them the same question, so
FYI.

STORMWATER PLAN REVISON
The original site is a 9.83-acre tract located on Sunset Blvd. (NC 179) in Seaside Village, Sunset
Beach, North Carolina. The original proposed development on the site consisted of eighteen
townhomes, roads and parking areas, and the installation of water and sewer to serve the multi-
family buildings and was permitted in January 2006, under Stormwater Permit #SW8 060126.
Construction was partially completed in early 2007.
Four of the eight townhomes were constructed and utilities were installed. The remaining four
multi -family buildings will be replaced by sixteen single-family homes. These sixteen single family
homes will now be referred to as Seaside Village Subdivision.
The proposed roadway is fundamentally the same with minor modifications to accommodate on -street
parking and a mailbox area. The stormwater runoff will be directed to the existing off -site stormwater
pond (permitted by SW8 960516) as permitted in the original plan via curb and gutter, curb inlets,
roofline gutters and underground piping. —

The DWM/UST Section is a regulatory Division, we do not act as an environmental consulting firm. If you do additional
environmental assessment on your property and petroleum contamination, above NC state action levels for Soil and/or
Groundwater are encountered then a report may be submitted to my attention and I can direct the Responsible Party
(in this case the RP may be the owner of the storm water drain but that would need to be determined) to proceed with
cleanup activities.
As the excavation pit was not open at the time of the site visit I conducted, the DWM could not observe Soil and/or
Groundwater contamination. And as there are not Soil or Groundwater lab results we cannot direct additional work at
this time.
I have also copied Brad Newland of the Air Quality Section on this email and attached a copy of your Indoor/Residential
air quality sampling results. I am not sure if he can add any additional comments to the comments that the lab already
made in the summary of lab results.
Brad ... if after looking over the attached lab results, is there any other information that you can offer for this
site. Thanks for your help in this matter.

A "site observation?"
Assuming there actually remains any contamination after years of spilliage from the severed pipe front to back
of the 7602-6 Townhome, IT WOULD BE IN THE SOIL UNDER THE HOUSE! We already know the air
was "contaminated" while we lived there, with enough toxins to make us all severely ill; the hospital records
show how sick we actually were.
Furtheremore, what residual toxins still remain in the pipe under ground as it sits today? A "site observation"
proves nothing and does not serve any cause to insure safety and inhabitability in that unit for anyone. This
hardly satisfies the remaining questions in this case, and I find this new revelation altogether very
disappointing. More tests need to be conducted.

A site visit has been conducted at 7602-6 High Market Street. The excavation pit was filled in and no
observations of petroleum soil or groundwater contamination was observed. Therefore the UST section will not
be making this into an incident case.
I had sent your air quality sample results to the UST Sections epidemiologist and our lab specialist, after
looking over the data they concluded that the air quality does not correlate to a petroleum release. And that the
quality of the air was typical to find when there has been a storm water release. Therefore, the UST Sections
epidemiologist will not conducted a Health Risk Evaluation (HRE) for this site, as it does not relate to a
petroleum release.

Has the storm drain been fixed? Is the hole still open?
2. When were the air quality samples collected inside your home? Was is during storm drain restoration

I have attached documents that may help you. The Red Line documents are letters to NCDENR. The Doc
scans are the modified permit.
You may want to know that in the original plans they showed the pipes side by side. That is not the case.
One of the pipes is between the buildings the collapsed pipe is under the house.

(permit attached). Is your particular row of townhomes under a different development name? I scanned in
most of the plan of SW8 960516 (attached). (We have a small scanner so I could not get the whole thing in the
frame.) I also cross-referenced that permit to find related permits (see the summary). I do not see where your
particular section of that development was included in the permitted plan. If there is an alternate name, I can
search for that. But, if not, I do not think that the permit was updated to show the details of your townhome.�

My home was built over a 4ft storm water drain pipe that runs from Hwy 904
through a shopping center with a gas station then turns and runs front to back
of the dwelling out to a retinsion pond and that pond feeds to another pond. After heavy rains a sink hole developed
behind my garage and one in front of the house. After excavating down to the pipe it was found that the 4' pipe had
collapsed down to 2'.
The pipe failed under my house. My family got sick. We had the air tested and 21
toxic chemicals were found in the house air.The Town of Sunset Beach nor the
developer has tested the soil or water runoff. They have not investigated where
these chemical are coming from. Some of the chemicals found indicate they may
have come from toxic backfill or some industrial site and/or leaking gas tanks.
Found in the air were: Xylene (para, meta), Ethyl Benzene, Touene, Formaldehyde,
Tetrachloroethene (also Perchloroethylene)1,2-dichloroethane, Ethyl acetate,
butonone, acetone, isopropanol, ethanol, chloromethene. DiMethyl ether, Butane,
Acetaldehyde, Butane 2-methyl, Hexanal, a-pinene,B-pinene, limonene and nonanal
(also called pelargonaldehyde or nonanaldehyde.
We believe that not only is the water toxic but the soil also.
The location of the house is 7602 High Market Street Unit 6, Sunset Beach, NC 28468.
Picture #3 shows how the pipe has collapsed. I know it is like that all under my house and going out to the pond but I am
not sure what it is like coming through the shopping center. I would like the soil at/around my house tested and would like
the water in the retention pond leading to the other pond tested to see if the chemicals are going into the ground water.
