The. Wilmington Regional Office received a complete modified Stormwater Management Permit
Application for SPEC - Leland on February 15, 2013. Staff review of the plans and
specifications has determined that the project, as proposed, will comply with the Stormwater
Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding Permit No. SW8 051143,
dated March 8,2013, for the construction, operation and maintenance of the BMP's and the
built -upon areas associated with the subject project.
This permit shall be effective from the date of issuance until March 8, 2021, and shall be subject
to the conditions and limitations as specified therein. Please pay special attention to the
conditions listed in this permit regarding the Operation and Maintenance of the BMP(s),
recordation of deed restrictions, procedures for changes of ownership, and transferring the
permit. Failure to establish an adequate system for operation and maintenance of the
stormwater management system, to record deed restrictions, or to transfer the permit, will result
in future compliance problems.
The following modifications are included and covered by this permit:
o The addition of a constructed wetland to treat the area of high density created by the
construction of a piped collection system.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the
right to request an adjudicatory, hearing by filing a written petition with the Office of
Administrative Hearings (OAH). The written petition must conform to Chapter 150E of the North
Carolina General Statutes, and must be filed with the OAH within thirty (30) days of receipt of
this permit. You should contact the OAH with all questions regarding the filing fee (if a filing fee
is required) and/or the details of the filing process at 6714 Mail Service Center, Raleigh, NC

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of
North Carolina as amended, and other applicable Laws, Rules, and Regulations

FOR THE
construction, operation and maintenance of an overall 30% low density development
with one (1) constructed wetland to treat the higher density areas, in compliance with
the provisions of Title 15A NCAC 2H .1000 (hereafter referred to as the "stormwater
rules') and the approved stormwater management plans and specifications and other
supporting data as attached and on file with and approved by the Division of Water
Quality and considered a part of this permit.
This permit shall be effective from the date of issuance until March 8, 2021 and shall be
subject to the following specified conditions and limitations:
1. DESIGN STANDARDS
1. This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
2. This permit covers the construction of a total of 42,236 square feet of built -upon
area (BUA), which includes 35,509 square feet of BUA within the drainage area
of the constructed wetland and 6,727 square feet of BUA within the remaining
low density area.
3. The overall tract built -upon area percentage for the project must be maintained at
no more than 30% per the requirements of Section .1005 of the stormwater rules.
4. The stormwater system proposed to treat the runoff generated by the designated
high density area has been approved for the management of stormwater runoff
as described in Section 1.10 on page 3 of this permit.
5. The low density portions of this project will maintain a minimum 30 foot wide
vegetated buffer between all impervious areas and surface waters.

6. Within the low density portions of the permitted project, all roof drains shall
terminate at least 30 feet from the mean high water mark of surface waters.
Within the low density portions of the permitted project, the only runoff
conveyance systems allowed will be vegetated conveyances such as swales with
minimum side slopes of 3:1 (H:V) as defined in the stormwater rules and as
shown on the approved plan.
Within the low density portions of this permitted project, no piping is allowed
except that minimum amount necessary to direct runoff beneath an impervious
surface such as a road or to provide access.
The runoff from all built -upon area within the drainage area of the permitted high
density stormwater system must be directed into the permitted stormwater
control system.

II. SCHEDULE OF COMPLIANCE
The permittee shall not allow any person, including the permittee, to alter any
part of the approved stormwater management system or fill in, alter, or pipe any
of the vegetated conveyances shown on the approved plans, except for minimum
driveway crossings, unless and until the permittee shall have submitted a
modification to the permit and received approval from the Division of Water
Quality.
2. The permittee is responsible for monitoring the project on a routine basis and
verifying that the proposed built -upon area does not exceed the maximum
allowed by this permit.

3. The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit. Within the time frame
specified in the notice, the permittee shall submit a written time schedule to the
Director for modifying the site to meet minimum requirements. The permittee
shall provide copies of revised plans and certification in writing to the Director
that the changes have been made.
4. The stormwater management system shall be constructed in its entirety,
vegetated and operational for its intended use prior to the construction of any
built -upon surface.
5. The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed
below:
a. Any revision to the approved plans, regardless of size.
d. Redesign or addition to the approved amount of built -upon area.
e. Further development, subdivision, acquisition, or sale of the project area,
in whole or in part. The project area is defined as all property owned by
the permittee, for which Sedimentation and Erosion Control Plan approval
or a CAMA Major permit was sought.
f. Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan.
g. Construction of any designated future development areas.
6. The Director may determine that other revisions to the project should require a
modification to the permit.
7. All stormwater collection and treatment systems must be located in either
dedicated common areas or recorded easements. The final plats for the project
must be recorded showing all such required easements, in accordance with the
approved plans.
During'construction, erosion shall be kept to a minimum and any eroded areas of
the system will be repaired immediately. If the stormwater system was used as
an Erosion Control device, it must be restored to design condition prior to
operation as a stormwater treatment device, and prior to occupancy of the
facility.
Upon completion of construction, prior to issuance of a Certificate of Occupancy,
and prior to operation of this permitted facility, a certification must be received
from an appropriate designer for the system installed certifying that the permitted
facility has been installed in accordance with this permit, the approved plans and
specifications, and other supporting documentation. Any deviations from the
approved plans and specifications must be noted on the Certification.
10. This permit shall become void unless the facilities are constructed in accordance
with the conditions of this permit, the approved plans and specifications, and
other supporting data.
11. The permittee shall at all times provide and perform the necessary operation and
maintenance procedures as specified in the signed Operation and Maintenance
Agreement, such that the permitted stormwater management system functions
as designed and permitted.

12. Records of maintenance activities must be kept by the permittee and made
available upon request to authorized personnel of DWQ. The records will indicate
the date, activity, name of person performing the work and what actions were
taken.
13. Prior to transfer of the permit, the stormwater facilities will be inspected by DWQ
personnel. The facility must be in compliance with all permit conditions. Any
items not in compliance must be repaired or replaced to design condition prior to
the transfer. Records of maintenance activities performed to date will be
required.
14. Built upon area includes, but is not limited to, structures, asphalt, concrete,
gravel, brick, stone, slate, coquina and parking areas, but does not include
raised, open wood decking, or the water surface of swimming pools.
III. GENERAL CONDITIONS
This permit is not transferable to any person or entity except after notice to and
approval by the Director. The Director may require modification or revocation and
reissuance of the permit to change the name and incorporate such other
requirements as may be necessary. At least 30 days prior to an ownership
change, or a name change of the permittee or of the project, or a mailing address
change; the permittee shall submit a completed and signed Name/Ownership
Change form to the Division of Water Quality accompanied by appropriate
documentation as listed on the form. The approval of this request will be
considered on its merits, and may or may not be approved.
2. The permittee is responsible for compliance with all of the terms and conditions
of this permit until such time as the Director approves the transfer request.
Neither the sale of the project, in whole or in part, nor the transfer of common
area to a third party, shall be considered an approved permit transfer.
3. Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to enforcement action by the Division of Water Quality, in
accordance with North Carolina General Statute 143-215.6A to 143-215.6C.
4. The issuance of this permit does not preclude the Permittee from complying with
and obtaining any and all permits or approvals as required by any statutes, rules,
regulations, or ordinances, which may be imposed by any other Local, State or
Federal government agency having jurisdiction. Any activities undertaken at this
site prior to receipt of the necessary permits or approvals to do so is considered
a violation of NCGS 143-215.1, and subject to enforcement procedures pursuant
to NCGS 143-215.6.
5. Any person or entity found to be in noncompliance with the provisions of this
stormwater permit or the requirements of the stormwater rules under 15A NCAC
02H.1000 as amended under Session Law 2008-211, is subject to enforcement
procedures as set forth in N.C.G.S. 143, Article 21.
6. In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action,
including those as may be required by this Division, such as the construction of
additional or replacement stormwater management systems.
The permit issued shall continue in force and effect until revoked or terminated.
The permit may be modified, revoked and reissued or terminated for cause. The
filing of a request for a permit modification, revocation and re -issuance or
termination does not stay any permit condition.

8. The issuance of this permit does not prohibit the Director from reopening and
modifying the permit, revoking and reissuing the permit, or terminating the permit
as allowed by the laws, rules, and regulations contained in Title 15A of the North
Carolina Administrative Code, Subchapter 2H.1000; and North Carolina General
Statute 143-215.1 et. al.
9. Unless otherwise shown, permanent seeding requirements for the stormwater
control must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual.
10. The permittee grants permission to DENR staff to access the property during
normal business hours for the purposes of inspecting the stormwater facilities for
compliance.
11. Approved plans, application, supplements, and specifications for this project are
incorporated by reference and are enforceable parts of the permit.
12. A copy of the approved plans and specifications shall be maintained on file by
the Permittee at all times. At the time the permit is transferred to a new owner,
the permittee shall forward the approved plans to the new owner.
13. The permittee shall submit a permit renewal request at least 180 days prior to the
expiration date of this permit. The renewal request must include the appropriate
documentation and the processing fee.

VI. SUBMITTAL REQUIREMENTS
Only complete application packages will be accepted and reviewed by the Division of Water Quality (DWQ).
A complete package includes all of the items listed below. A detailed application instruction sheet and BMP
checklists are available from http://portal.ncdenr.org/web/wq/ws/su/statesw/forms dots. The complete
application package should be submitted to the appropriate DWQ Office. (The appropriate office may be
found by locating project on the interactive online map at http://portal.ncdenr.org/web/wq/ws/su/maps.)
Please indicate that the following required information have been provided by initialing in the space provided
for each item. All original documents MUST be signed and initialed in blue ink. Download the latest versions
for each submitted application package from ham://portal.ncdennorg/web/wq/ws/su/statesw/forms does.
1. Original and one copy of the Stormwater Management Permit Application Form.
2. Original and one copy of the signed and notarized Deed Restrictions & Protective Covenants

6. A USGS map identifying the site location. If the receiving stream is reported as class SA or the
receiving stream drains to class SA waters within'h mile of the site boundary, include the'fi
mile radius on the map.

SITE DESCRIPTION
This + 3.94 acre site is located at the end of Thomas Garst Lane in the Town of Leland. This
project consisted of clearing, grading, and installation of infrastructure for a proposed 12,100 SF
Daycare Facility. The disturbed area for this project is +/- 3.5 acres and the total amount of
impervious area compared with the total project boundary is 24.6%. The erosion control plan
identifies the appropriate measures to be implemented for erosion control purposes during
construction of the infrastructure associated with this development.
SOILS
The soils onsite consist of Mandarin Fine Sand and Muckalee Loam series soils. The Mandarin
series soils consist of somewhat poorly drained, flat sandy soils with a Hydrologic soils grouping
of C. The Muckalee series soils consists of poorly drained soils on low flood plains with a
Hydrologic soils grouping of D.
STORM DRAINAGE DESIGN
The primary stormwater measure for this project is a proposed Stormwater Wetland located at
the front of the property. The stormwater will be conveyed via overland sheet flow and closed
conduit system to the proposed stormwater wetland that is designed to treat the first 1.5" of
rainfall. The stormwater from this site discharges to the Brunswick River, Classification SC. A
SH WT determination was performed by ECS Limited on September 25, 2012 and the SH WT
depth at the proposed stormwater wetland was determined to be 14". The ECS Report is
attached.

EROSION CONTROL PLAN FOR
SPEC DAYCARE - LELAND
Area to be disturbed: +/- 3.5 acres

This project consisted of clearing, grading, and installation of infrastructure for a

EROSION CONTROL MEASURES: This project will primarily control erosion with the
use of a temporary construction entrance, outlet protection at the ends of culverts,
temporary silt fence surrounding the site and a sediment basin.
The contractor shall install, maintain and remove upon completion the silt fence as
necessary to prevent any sediment from leaving the project limits. This will include any
temporary stockpile areas if necessary. Contractor shall clean and restore to pre -
construction conditions any areas that may inadvertently be damaged due to the failure of
the erosion control measures.
SCHEDULING OF WORK: Clearing and grubbing shall be scheduled and performed in
such a manner that fine grading operations and erosion control practices can follow
immediately thereafter. Excavation and embankment operations will be conducted such
that cuts and fills will be completed to final grades in a continuous operation. All
construction areas not otherwise protected shall be planted with permanent vegetative
cover in accordance with the specifications within 15 working days after completion of
active construction.
MINIMUM AREAS TO BE DISTURBED: Only those areas necessary for timely and
proper completion of the project shall be stripped of native vegetation. The angle for
graded sloped and fills shall be no greater than the angle which can be retained by
vegetative cover or other adequate erosion control devices or structures. Slopes left
exposed will, within 21 calendar days of completion of any phase of grading, be planted
or otherwise provided with ground cover, devices, or structures sufficient to restrain
erosion. All other areas to be stabilized within 15 working days of cease of any phase of
activity.
PLACEMENT OF SEDIMENT CONTROL DEVICES: All devices (temporary
diversions, sediment fences, construction entrances, etc.) for sediment control shall be
constructed prior to beginning clearing and grubbing on the site.
FINAL COVER: As soon as practicable after finished grades have been established, all
operations in connection with establishing final ground cover shall be performed. Any

inactive disturbed ground area to remain denuded more than 15 working days shall be
temporarily seeded in accordance with the temporary seeding schedule as noted on the
plans. All slopes to be stabilized within 21 calendar days.
SEQUENCE OF CONSTRUCTION
1. Install temporary construction entrance as shown on erosion & sediment control plan.
2. Install perimeter controls (sediment basin, silt fence, tree protection fencing, etc.) as
shown on the erosion & sediment control plan. This step needs to be completed prior to
upslope land disturbing activities.
3. Once perimeter controls and sediment trapping measures are installed clear and grub
site within limits of disturbance.
4. Upon bringing the site to rough grade, stabilize all areas with temporary vegetation if
left undisturbed for 15 working days and all slopes within 21 calendar days.
5. Upon bringing the parking area to subgrade elevations, stabilize the areas by placing
stone base as early as possible.
6. For temporary vegetative stabilization of all denuded areas see note referencing the
erosion control program and specifications.
7. After construction operations have ended and all disturbed areas have stabilized,
mechanical sediment controls shall be removed. Sediment from temporary sediment
trapping devices shall be disposed of by spreading on the site or hauling away if not
suitable for ,fill. All denuded areas are to be permanently stabilized with permanent
vegetation.
8. Prior to using the sediment basin as an stormwater wetland it shall be mucked out.

ECS Carolinas, LLP (ECS) recently conducted an estimation of the Seasonal High Water Table
(SHWT) for the proposed stormwater best management practice (BMP) area at the proposed
SPEC Daycare Facility in Leland, Brunswick County, North Carolina. This letter, with
attachments, is the report of our estimation.
Field Testing
On September 25, 2012, ECS met with Mr. Garry Pape with GSP Consulting in order to locate
the requested boring location. ECS then conducted an exploration of the subsurface soil and
groundwater conditions at one requested location shown on the attached Boring Location Plan
(Figure 1). The purpose of this exploration was to estimate the SHWT of the in place soils for
the design of for the proposed stormwater BMP area. ECS explored the subsurface soil and
groundwater conditions by advancing one hand auger boring into the existing ground surface at
the requested boring location. ECS visually classified the subsurface soils and obtained
representative samples of each soil type encountered. ECS recorded the SHWT and
groundwater level observed at the time of each hand auger boring. The attached SHWT sheet
provides a summary of the subsurface conditions encountered at each hand auger boring
location.
The groundwater level and the SHWT were estimated at each boring location below the existing
grade elevation. Below is a summary of each boring location.

The Wilmington Regional Office received and accepted a modified State Stormwater
Management Permit Application for SPEC - Leland on November 26, 2012. A preliminary in-
depth review of that information has determined that the application is not complete. The
following information is needed to continue the stormwater review:
I� The drainage area and impervious area listed in Section IV.10 of the application is not
consistent with the impervious area listed in the wetland supplement. Section IV.10 of
the application should have 1 drainage area for the proposed wetland and if any other
impervious areas remain outside this drainage area, a second drainage area for the
remainder of the property.
V 2. Please confirm the total surface area of the wetland and provide additional details in the
calculations to support the surface areas of the various wetland zones. The total
wetland surface area is considered to include the deep pools, shallow water, and
shallow land at the temporary pool elevation, currently set at 13 ft. According to the
calculations, the surface area at an elevation of 13 ft is 5,155 ftZ; however the
supplement reports the wetland surface area as being 4,510 ft2. Once the surface areas
have been confirmed, the provided volume is based on the surface area at the
permanent pool elevation (currently 12 ft), which according to the calculations is 3,775
ftZ, and the surface area at the temporary pool elevation (13 ft).
�3 ' Please increase the number of plants to be provided in the shallow water area to meet
the 50 plants per 200 ftZ area. With the shallow water area being 1883 ft2, a minimum
number of 471 plants will be necessary. (1883 ftZ / 200 ftZ * 50 = 471 plants)
4. Please provide additional grading details, including contours and/or spot elevations, in
order to support the drainage area delineation. Additionally, please include the roof
drain collection lines or include a note on the plans indicating that all roof runoff will be
directed to the stormwater collection system.
5. Please confirm the information presented in the cross-section table on sheet C-5. The
information presented in this table is not consistent with the information presented in the
supplement and calculations. For instance, the Shallow Water Elevation is listed as 11.0
ft on C-5, but is shown as 11.5 in the supplement.
Please remember that a change to one number may have a domino effect on other numbers.

The only other thing is if DWQ would accept the site the way it is in that the inlet discharges to a swale (don't know the
length of said swale) that flows into a dry detention basin. Other than that the only thing that could be done is to
repave the parking lot to sheet flow the runoff over the retaining wall then through the swales.

Here is the current situation. Right now the stormwater is collected in the parking lot by and inlet that discharges the
stormwater through the retaining wall into a swale that directed the water to a dry detention area. The only corrective
action I could see to do would be to remove the inlet and storm pipe and to repave the parking lot so that the
stormwater sheet flows to the edges of the parking area where it flows over the retaining wall and then through the
grassed swales to the dry detention area. I welcome your thoughts on the situation. Thanks. — Garry

The Wilmington Regional Office received a complete modified Stormwater Management Permit
Application for SPEC - Leland on February 15, 2013. Staff review of the plans and
specifications has determined that the project, as proposed, will comply with the Stormwater
Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding Permit No. SW8 051143,
dated March 8,2013, for the construction, operation and maintenance of the BMP's and the
built -upon areas associated with the subject project.
This permit shall be effective from the date of issuance until March 8, 2021, and shall be subject
to the conditions and limitations as specified therein. Please pay special attention to the
conditions listed in this permit regarding the Operation and Maintenance of the BMP(s),
recordation of deed restrictions, procedures for changes of ownership, and transferring the
permit. Failure to establish an adequate system for operation and maintenance of the
stormwater management system, to record deed restrictions, or to transfer the permit, will result
in future compliance problems.
The following modifications are included and covered by this permit:
The addition of a constructed wetland to treat the area of high density created by the
construction of a piped collection system.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the
right to request an adjudicatory hearing by filing a written petition with the Office of
Administrative Hearings (OAH). The written petition must conform to Chapter 150E of the North
Carolina General Statutes, and must be filed with the OAH within thirty (30) days of receipt of
this permit. You should contact the OAH with all questions regarding the filing fee (if a filing fee

construction, operation and maintenance of an overall 30% low density development
with one (1) constructed wetland to treat the higher density areas, in compliance with
the provisions of Title 15A NCAC 2H .1000 (hereafter referred to as the "stormwater
rules') and the approved stormwater management plans and specifications and other
supporting data as attached and on file with and approved by the Division of Water
Quality and considered a part of this permit.
This permit shall be effective from the date of issuance until March 8, 2021 and shall be
subject to the following specified conditions and limitations:
I. DESIGN STANDARDS
This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
2. This permit covers the construction of a total of 42,236 square feet of built -upon
area (BUA), which includes 35,509 square feet of BUA within the drainage area
of the constructed wetland and 6,727 square feet of BUA within the remaining
low density area.
3. The overall tract built -upon area percentage for the project must be maintained at
no more than 30% per the requirements of Section .1005 of the stormwater rules.
4. The stormwater system proposed to treat the runoff generated by the designated
high density area has been approved for the management of stormwater runoff
as described in Section 1.10 on page 3 of this permit.
5. The low density portions of this project will maintain a minimum 30 foot wide
vegetated buffer between all impervious areas and surface waters.

Within the low density portions of the permitted project, all roof drains shall
terminate at least 30 feet from the mean high water mark of surface waters.
Within the low density portions of the permitted project, the only runoff
conveyance systems allowed will be vegetated conveyances such as swales with
minimum side slopes of 3:1 (H:V) as defined in the stormwater rules and as
shown on the approved plan.
Within the low density portions of this permitted project, no piping is allowed
except that minimum amount necessary to direct runoff beneath an impervious
surface such as a road or to provide access.
The runoff from all built -upon area within the drainage area of the permitted high
density stormwater system must be directed into the permitted stormwater
control system.

II. SCHEDULE OF COMPLIANCE
The permittee shall not allow any person, including the permittee, to alter any
part of the approved stormwater management system or fill in, alter, or pipe any
of the vegetated conveyances shown on the approved plans, except for minimum
driveway crossings, unless and until the permittee shall have submitted a
modification to the permit and received approval from the Division of Water
Quality.
2. The permittee is responsible for monitoring the project on a routine basis and
verifying that the proposed built -upon area does not exceed the maximum
allowed by this permit.

3. The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit. Within the time frame
specified in the notice, the permittee shall submit a written time schedule to the
Director for modifying the site to meet minimum requirements. The permittee
shall provide copies of revised plans and certification in writing to the Director
that the changes have been made.
4. The stormwater management system shall be constructed in its entirety,
vegetated and operational for its intended use prior to the construction of any
built -upon surface.
5. The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed
below:
a. Any revision to the approved plans, regardless of size.
d. Redesign or addition to the approved amount of built -upon area.
e. Further development, subdivision, acquisition, or sale of the project area,
in whole or in part. The project area is defined as all property owned by
the permittee, for which Sedimentation and Erosion Control Plan approval
or a CAMA Major permit was sought.
f. Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan.
g. Construction of any designated future development areas.
6. The Director may determine that other revisions to the project should require a
modification to the permit.
7. All stormwater collection and treatment systems must be located in either
dedicated common areas or recorded easements. The final plats for the project
must be recorded showing all such required easements, in accordance with the
approved plans.
8. During'construction, erosion shall be kept to a minimum and any eroded areas of
the system will be repaired immediately. If the stormwater system was used as
an Erosion Control device, it must be restored to design condition prior to
operation as a stormwater treatment device, and prior to occupancy of the
facility.
9. Upon completion of construction, prior to issuance of a Certificate of Occupancy,
and prior to operation of this permitted facility, a certification must be received
from an appropriate designer for the system installed certifying that the permitted
facility has been installed in accordance with this permit, the approved plans and
specifications, and other supporting documentation. Any deviations from the
approved plans and specifications must be noted on the Certification.
10. This permit shall become void unless the facilities are constructed in accordance
with the conditions of this permit, the approved plans and specifications, and
other supporting data.
11. The permittee shall at all times provide and perform the necessary operation and
maintenance procedures as specified in the signed Operation and Maintenance
Agreement, such that the permitted stormwater management system functions
as designed and permitted.

12. Records of maintenance activities must be kept by the permittee and made
available upon request to authorized personnel of DWQ. The records will indicate
the date, activity, name of person performing the work and what actions were
taken.
13. Prior to transfer of the permit, the stormwater facilities will be inspected by DWQ
personnel. The facility must be in compliance with all permit conditions. Any
items not in compliance must be repaired or replaced to design condition prior to
the transfer. Records of maintenance activities performed to date will be
required.
14. Built upon area includes, but is not limited to, structures, asphalt, concrete,
gravel, brick, stone, slate, coquina and parking areas, but does not include
raised, open wood decking, or the water surface of swimming pools.
III. GENERAL CONDITIONS
This permit is not transferable to any person or entity except after notice to and
approval by the Director. The Director may require modification or revocation and
reissuance of the permit to change the name and incorporate such other
requirements as may be necessary. At least 30 days prior to an ownership
change, or a name change of the permittee or of the project, or a mailing address
change; the permittee shall submit a completed and signed Name/Ownership
Change form to the Division of Water Quality accompanied by appropriate
documentation as listed on the form. The approval of this request will be
considered on its merits, and may or may not be approved.
2. The permittee is responsible for compliance with all of the terms and conditions
of this permit until such time as the Director approves the transfer request.
Neither the sale of the project, in whole or in part, nor the transfer of common
area to a third party, shall be considered an approved permit transfer.
3. Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to enforcement action by the Division of Water Quality, in
accordance with North Carolina General Statute 143-215.6A to 143-215.6C.
4. The issuance of this permit does not preclude the Permittee from complying with
and obtaining any and all permits or approvals as required by any statutes, rules,
regulations, or ordinances, which may be imposed by any other Local, State or
Federal government agency having jurisdiction. Any activities undertaken at this
site prior to receipt of the necessary permits or approvals to do so is considered
a violation of NCGS 143-215.1, and subject to enforcement procedures pursuant
to NCGS 143-215.6.
5. Any person or entity found to be in noncompliance with the provisions of this
stormwater permit or the requirements of the stormwater rules under 15A NCAC
02H.1000 as amended under Session Law 2008-211, is subject to enforcement
procedures as set forth in N.C.G.S. 143, Article 21.
6. In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action,
including those as may be required by this Division, such as the construction of
additional or replacement stormwater management systems.
The permit issued shall continue in force and effect until revoked or terminated.
The permit may be modified, revoked and reissued or terminated for cause. The
filing of a request for a permit modification, revocation and re -issuance or
termination does not stay any permit condition.

The issuance of this permit does not prohibit the Director from reopening and
modifying the permit, revoking and reissuing the permit, or terminating the permit
as allowed by the laws, rules, and regulations contained in Title 15A of the North
Carolina Administrative Code, Subchapter 2H.1000; and North Carolina General
Statute 143-215.1 et. al.
Unless otherwise shown, permanent seeding requirements for the stormwater
control must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual.
10. The permittee grants permission to DENR staff to access the property during
normal business hours for the purposes of inspecting the stormwater facilities for
compliance.
11. Approved plans, application, supplements, and specifications for this project are
incorporated by reference and are enforceable parts of the permit.
12. A copy of the approved plans and specifications shall be maintained on file by
the Permittee at all times. At the time the permit is transferred to a new owner,
the permittee shall forward the approved plans to the new owner.
13. The permittee shall submit a permit renewal request at least 180 days prior to the
expiration date of this permit. The renewal request must include the appropriate
documentation and the processing fee.

SITE DESCRIPTION
This + 3.94 acre site is located at the end of Thomas Garst Lane in the Town of Leland. This
project consisted of clearing, grading, and installation of infrastructure for a proposed 12,100 SF
Daycare Facility. The disturbed area for this project is +/- 3.5 acres and the total amount of
impervious area compared with the total project boundary is 24.6%. The erosion control plan
identifies the appropriate measures to be implemented for erosion control purposes during
construction of the infrastructure associated with this development.
SOILS
The soils onsite consist of Mandarin Fine Sand and Muckalee Loam series soils. The Mandarin
series soils consist of somewhat poorly drained, flat sandy soils with a Hydrologic soils grouping
of C. The Muckalee series soils consists of poorly drained soils on low flood plains with a
Hydrologic soils grouping of D.
STORM DRAINAGE DESIGN
The primary stormwater measure for this project is a proposed Stormwater Wetland located at
the front of the property. The stormwater will be conveyed via overland sheet flow and closed
conduit system to the proposed stormwater wetland that is designed to treat the first 1.5" of
rainfall. The stormwater from this site discharges to the Brunswick River, Classification SC. A
SHWT determination was performed by ECS Limited on September 25, 2012 and the SHWT
depth at the proposed stormwater wetland was determined to be 14". The ECS Report is
attached.
EROSION CONTROL PLAN FOR
SPEC DAYCARE - LELAND
Area to be disturbed: +/- 3.5 acres
This + 3.94 acre site is located at the end of Thomas Garst Lane in the Town of Leland.
This project consisted of clearing, grading, and installation of infrastructure for a
proposed 12,100 SF Daycare Facility. The disturbed area for this project is +/- 3.5 acres
and the total amount of impervious area compared with the total project boundary is
24.6%. The primary stormwater measure for this project is a proposed Stormwater
Wetland located at the front of the property. The stormwater will be conveyed via
overland sheet flow and closed conduit system to the proposed stormwater wetland that is
designed to treat the first 1.5" of rainfall. The stormwater from this site discharges to the
Brunswick River, Classification SC.
EROSION CONTROL MEASURES: This project will primarily control erosion with the
use of a temporary construction entrance, outlet protection at the ends of culverts,
temporary silt fence surrounding the site and a sediment basin.
The contractor shall install, maintain and remove upon completion the silt fence as
necessary to prevent any sediment from leaving the project limits. This will include any
temporary stockpile areas if necessary. Contractor shall clean and restore to pre -
construction conditions any areas that may inadvertently be damaged due to the failure of
the erosion control measures.
SCHEDULING OF WORK: Clearing and grubbing shall be scheduled and performed in
such a manner that fine grading operations and erosion control practices can follow
immediately thereafter. Excavation and embankment operations will be conducted such
that cuts and fills will be completed to final grades in a continuous operation. All
construction areas not otherwise protected shall be planted with permanent vegetative
cover in accordance with the specifications within 15 working days after completion of
active construction.
MINIMUM AREAS TO BE DISTURBED: Only those areas necessary for timely and
proper completion of the project shall be stripped of native vegetation. The angle for
graded sloped and fills shall be no greater than the angle which can be retained by
vegetative cover or other adequate erosion control devices or structures. Slopes left
exposed will, within 21 calendar days of completion of any phase of grading, be planted
or otherwise provided with ground cover, devices, or structures sufficient to restrain
erosion. All other areas to be stabilized within 15 working days of cease of any phase of
activity.
PLACEMENT OF SEDIMENT CONTROL DEVICES: All devices (temporary
diversions, sediment fences, construction entrances, etc.) for sediment control shall be
constructed prior to beginning clearing and grubbing on the site.
FINAL COVER: As soon as practicable after finished grades have been established, all
operations in connection with establishing final ground cover shall be performed. Any
inactive disturbed ground area to remain denuded more than 15 working days shall be
temporarily seeded in accordance with the temporary seeding schedule as noted on the
plans. All slopes to be stabilized within 21 calendar days.
SEQUENCE OF CONSTRUCTION
1. Install temporary construction entrance as shown on erosion & sediment control plan.
2. Install perimeter controls (sediment basin, silt fence, tree protection fencing, etc.) as
shown on the erosion & sediment control plan. This step needs to be completed prior to
upslope land disturbing activities.
3. Once perimeter controls and sediment trapping measures are installed clear and grub
site within limits of disturbance.
4. Upon bringing the site to rough grade, stabilize all areas with temporary vegetation if
left undisturbed for 15 working days and all slopes within 21 calendar days.
5. Upon bringing the parking area to subgrade elevations, stabilize the areas by placing
stone base as early as possible.
6. For temporary vegetative stabilization of all denuded areas see note referencing the
erosion control program and specifications.
7. After construction operations have ended and all disturbed areas have stabilized,
mechanical sediment controls shall be removed. Sediment from temporary sediment
trapping devices shall be disposed of by spreading on the site or hauling away if not
suitable for fill. All denuded areas are to be permanently stabilized with permanent
vegetation.
8. Prior to using the sediment basin as an stormwater wetland it shall be mucked out.

ECS Carolinas, LLP (ECS) recently conducted an estimation of the Seasonal High Water Table
(SHWT) for the proposed stormwater best management practice (BMP) area at the proposed
SPEC Daycare Facility in Leland, Brunswick County, North Carolina. This letter, with
attachments, is the report of our estimation.
Field Testing
On September 25, 2012, ECS met with Mr. Garry Pape with GSP Consulting in order to locate
the requested boring location. ECS then conducted an exploration of the subsurface soil and
groundwater conditions at one requested location shown on the attached Boring Location Plan
(Figure 1). The purpose of this exploration was to estimate the SHWT of the in place soils for
the design of for the proposed stormwater BMP area. ECS explored the subsurface soil and
groundwater conditions by advancing one hand auger boring into the existing ground surface at
the requested boring location. ECS visually classified the subsurface soils and obtained
representative samples of each soil type encountered. ECS recorded the SHWT and
groundwater level observed at the time of each hand auger boring. The attached SHWT sheet
provides a summary of the subsurface conditions encountered at each hand auger boring
location.
The groundwater level and the SHWT were estimated at each boring location below the existing
grade elevation. Below is a summary of each boring location.

The Wilmington Regional Office received and accepted a modified State Stormwater
Management Permit Application for SPEC - Leland on November 26, 2012. A preliminary in-
depth review of that information has determined that the application is not complete. The
following information is needed to continue the stormwater review:
0. The drainage area and impervious area listed in Section IV.10 of the application is not
consistent with the impervious area listed in the wetland supplement. Section IV.10 of
the application should have 1 drainage area for the proposed wetland and if any other
impervious areas remain outside this drainage area, a second drainage area for the
remainder of the property.
V 1. Please confirm the total surface area of the wetland and provide additional details in the
calculations to support the surface areas of the various wetland zones. The total
wetland surface area is considered to include the deep pools, shallow water, and
shallow land at the temporary pool elevation, currently set at 13 ft. According to the
calculations, the surface area at an elevation of 13 ft is 5,155 ftZ; however the
supplement reports the wetland surface area as being 4,510 ftZ. Once the surface areas
have been confirmed, the provided volume is based on the surface area at the
permanent pool elevation (currently 12 ft), which according to the calculations is 3,775
ftZ, and the surface area at the temporary pool elevation (13 ft).
�3�Please increase the number of plants to be provided in the shallow water area to meet
the 50 plants per 200 ftZ area. With the shallow water area being 1883 ft2, a minimum
number of 471 plants will be necessary. (1883 ftZ / 200 ftZ * 50 = 471 plants)
4. Please provide additional grading details, including contours and/or spot elevations, in
order to support the drainage area delineation. Additionally, please include the roof
drain collection lines or include a note on the plans indicating that all roof runoff will be
directed to the stormwater collection system.
5. Please confirm the information presented in the cross-section table on sheet C-5. The
information presented in this table is not consistent with the information presented in the
supplement and calculations. For instance, the Shallow Water Elevation is listed as 11.0
ft on C-5, but is shown as 11.5 in the supplement.
Please remember that a change to one number may have a domino effect on other numbers.
Please check all plans, calculations and forms to ensure that the numbers are consistent
throughout.

The only other thing is if DWQ would accept the site the way it is in that the inlet discharges to a swale (don't know the

Here is the current situation. Right now the stormwater is collected in the parking lot by and inlet that discharges the
stormwater through the retaining wall into a swale that directed the water to a dry detention area. The only corrective
action I could see to do would be to remove the inlet and storm pipe and to repave the parking lot so that the
stormwater sheet flows to the edges of the parking area where it flows over the retaining wall and then through the

When you get your head wrapped around it, can you provide a general timeframe briefly listing the actions that will be
taken to resolve the issues? Getting it resolved as soon as possible could take a week or a couple months. It would just
be helpful if we are all on the same page and timeline. The deadline for the plan of action is August 22, but if you need a
