Guidelines for Access: The staff of Wilmington Regional Office is dedicated to making public records in our custody readily
available to the public for review and copying. We also have the responsibility to the public to safeguard these records and to carry
out our day-to-day program obligations. Please read carefully the following guidelines signing the form:
1. Due to the large public demand for file access, we request that you call at least a day in advance to schedule an
appointment to review the files. Appointments will be scheduled between 9:00am and 3:00pm. Viewing time ends at
4:45pm. Anyone arriving without an appointment may view the files to the extent that time and staff supervision
is available.
2. You must specify files you want to review by facility name. The number of files that you may review at one time will
be limited to five.
4. You may make copies of a file when the copier is not in use by the staff and if time permits. Cost per copy is $.05 cents.

Dear Mr. Saucier:
On March 29, 2019, the Wilmington Regional Office of the Division of Energy, Mineral and Land
Resources (DEMLR) conducted a follow-up inspection of the subject project in preparation of
transferring the permit to a new owner. The Division had previously inspected the project on October
24, 2018 and found deficiencies, which were supposedly addressed. State Stormwater Management
Permit Number SW8 051143 was issued on January 5, 2006 and was subsequently modified and
reissued on March 8, 2013. DEMLR file review and site inspection revealed that the site is still not
in compliance with the terms and conditions of this permit. Please find a copy of the completed form
entitled "Compliance Inspection Report" attached to this letter, which summarizes the findings of the
recent inspection.
As indicated in the attached inspection report, the following deficiencies must be resolved:
1. The constructed wetland stormwater control measure has dead vegetation and debris within
the wetland which must be removed.
2. Cattails have taken over the wetlands and must be removed.
3. The originally approved grading plan and planting plan must be followed to restore the
wetland to design condition.
Please be advised that, unless other arrangements have been made with the proposed permittee,
you remain responsible for compliance with the terms, conditions and limitations of the Stormwater
Management Permit issued under Title 15A North Carolina Administrative Code 2H .1003 and North
Carolina General Statute 143-214.7, including the operation and maintenance of the permitted
stormwater system.
Failure to resolve the identified deficiencies, or to respond to this letter with a plan of action,
including a timeline to resolve the identified deficiencies, by May 8, 2019, are considered violations
of the permit. If the deficiencies are not resolved or if the requested plan of action is not submitted
to this office by the due date, then DEMLR staff will re -inspect the site and may issue a Notice of
Violation. Please also note that any individual or entity found to be in noncompliance with the
provisions of a stormwater management permit or the stormwater rules is subject to enforcement
action as set forth in NCGS 143 Article 21, including the assessment of civil penalties.

Inspection Summary:
A follow-up inspection of the project was conducted on March 29, 2019. The wetland still has maintenance issues that
prevent the transfer of the permit at this time.
The area around the wetland has been cleared, but dead vegetation and debris is still lying within the wetland. Please
remove all of the dead vegetation and debris from within the wetland itself.
The original wetland vegetation has apprarently died and cattails are taking over. Please remove the cattails and regrade
and replant the wetland vegetation as per the wetland planting plan which is part of the March 8, 2013 approved plan set.

had simply been cast into the wetland instead of being removed.

Effective August 1, 2013, the Slate Stormwater program was transferred from the Division of Water Quality
(DWQ) to the Division of Encrgy, Mineral and Land Resources (DL',MLR). All previous references to DWQ
will remain in older Stormwater permits issued prior to August 1, 2013 until they are modified. Please note
that this letter references DEMLR as the Division responsible for compliance with the permit.
On July 31, 2018, the Wilmington Regional Office of the Division of Energy, Mineral and Land Resources
(DEMLR) received final information regarding a request to transfer the subject permit to Excel Leland
Properties, Inc. Due to hurricane Florence, the required compliance inspection of the facility, located at 11 1
and 113 Thomas Garst Lanc, Leland, in Brunswick County, was delayed until October 24, 2018. State
Stormwater Management Permit Number SW8 051 143 was issued on January 5, 2006 and was subsequently
modified and reissued on March 8, 2013. DEMLR file review and site inspection revealed that the site is not
in compliance with the terms and conditions of this permit. Please find a copy of the completed form entitled
"Compliance Inspection Report" attached to this letter, which summarizes the findings of the recent
inspection.
As indicated in the attached inspection report, the following deficiencies must be resolved:
1. The constructed wetland stormwater control measure is overgrown with dense vegetation on the
slopes and in the deep pools that must be removed.
2. Access to the outlet structure is impeded by the woody overgrowth.
3. The wetland needs to be restored to design condition.
Please be advised that, unless other arrangements have been made with the proposed permittee, you remain
responsible for compliance with the terms, conditions and limitations of the Stormwater Management Permit
issued under Title 15A North Carolina Administrative Code 21-1 .1003 and North Carolina General Statute
143-214.7, including the operation and maintenance of the permitted stormwater system.

the site is compliant with the terms and conditions of this permit. Please find a copy of the

summarizes the findings of the recent inspection.
Please be advised that you are required to comply with the terms, conditions and limitations of
your Stormwater Management Permit under Title 15A North Carolina Administrative Code 2H
.1003 and North Carolina General Statute 143-214.7, including operation and maintenance of
your permitted stormwater system. Violations of your Stormwater Management Permit may be

On August 23, 2013, the Wilmington Regional Office of the Division of Energy, Mineral and
Land Resources (DEMLR) inspected SPEC - Leland in Brunswick County to determine
compliance with State Stormwater Management Permit Number SW8 051143 modified and re-
issued on March 8, 2013. DEMLR file review and site inspection revealed that the site is not in
compliance with the terms and conditions of this permit. Please find a copy of the completed
form entitled "Compliance Inspection Report" attached to this letter, which summarizes the
findings of the recent inspection.
As indicated in the attached inspection report, the following deficiencies must be resolved:
1. The constructed wetland BMP approved in the March 8, 2013 modification does not
appear to have been constructed. The plan of action dated September 14, 2012
indicated that the BMP construction would be completed by May 1, 2013. Please
remember that within 30 days of completing construction of the BMP, the designer's
certification must be submitted to the Division.
Please inform this Office in writing before September 27, 2013, of the specific actions that will
be undertaken and the time frame that will be required to correct the deficiencies. Failure to
provide the requested information, or to respond to this letter by the due date, may initiate
enforcement action including the assessment of civil penalties of up to $25,000 per day. If a
written plan of action is not submitted to this office by September 27, 2013 then DEMLR staff
will re -inspect the site and issue a Notice of Violation if the listed deficiencies have not been
addressed.

On July 9, 2012, the Wilmington Regional Office of the Division of Water Quality (DWQ)
inspected the SPEC — Leland in Brunswick County to determine compliance with
Stormwater Management Permit Number SW8 051143 issued on January 5, 2006.
DWQ file review and site inspection revealed that the site is not in compliance with the
terms and conditions of this permit. Please find a copy of the completed form entitled
"Compliance Inspection Report" attached to this letter, which summarizes the findings of
the recent inspection.
As indicated in the attached inspection report, the following must be completed to bring
this project into compliance:
1. Demonstrate that the project still meets the requirements of a low density project.
The parking lot was found to have not been constructed according to the
approved plans, which was to provide sheet flow to a grassed swale. Instead,
the grade of the parking lot is inverted with curb and gutter and has an inlet
collecting and directing the runoff to an undetermined location. Please keep in
mind that piping is not allowed except the minimal amount necessary to direct
runoff beneath impervious surfaces such as roads and driveways. If the piping is
found to be in excess of the minimal amount necessary, one of the following
actions must be completed:
a. Remove the piping and reconfigure the site to match the currently
approved plan.
b. Revise the plan to receive approval for the added piping keeping in mind
-that the site must still meet the requirements of a low density project.
c. Modify the permit to a high density project.
2. Upon completion of one of the items listed in item 1 above, provide a certification
acknowledging the project has been constructed in accordance with the plans
approved by DWQ.
Please inform this Office in writing before August 22, 2012, of the specific actions that
will be. undertaken and the time frame that will be required to correct the deficiencies.
Failure to provide the requested information, or to respond to this letter by the due date,
may initiate enforcement action including the assessment of civil penalties of up to
$25,000 per day. If a written plan of action is not submitted to this office by August 22,

On March 29. 2019. the Wilmington Regional Office of the Division of Energy, Mineral and Land
Resources (DEMLR) conducted a follow-up inspection of the subject project in preparation of
transferring the permit to a new owner. The Division had previously inspected the project on October
24, 2018 and found deficiencies, which were supposedly addressed. State Stormwater Management
Permit Number SW8 051143 was issued on January 5, 2006 and was subsequently modified and
reissued on March 8, 2013. DEMLR file review and site inspection revealed that the site is still not
in compliance with the terms and conditions of this permit. Please find a copy of the completed form
entitled "Compliance Inspection Report" attached to this letter, which summarizes the findings of the
recent inspection.
As indicated in the attached inspection report, the following deficiencies must be resolved:
1. The constructed wetland stormwater control measure has dead vegetation and debris within
the wetland which must be removed.
2. Cattails have taken over the wetlands and must be removed.
3. The originally approved grading plan and planting plan must be followed to restore the
wetland to design condition.
Please be advised that, unless other arrangements have been made with the proposed permittee,
you remain responsible for compliance with the terms, conditions and limitations of the Stormwater
Management Permit issued under Title 15A North Carolina Administrative Code 2H .1003 and North
Carolina General Statute 143-214.7, including the operation and maintenance of the permitted
stormwater system.
Failure to resolve the identified deficiencies, or to respond to this letter with a plan of action,
including a timeline to resolve the identified deficiencies, by May 8. 2019, are considered violations
of the permit. If the deficiencies are not resolved or if the requested plan of action is not submitted
to this office by the due date, then DEMLR staff will re -inspect the site and may issue a Notice of
Violation. Please also note that any individual or entity found to be in noncompliance with the
provisions of a stormwater management permit or the stormwater rules is subject to enforcement
action as set forth in NCGS 143 Article 21. including the assessment of civil penalties.

The area around the wetland has been cleared, but dead vegetation and debris is still lying within the wetland. Please
remove all of the dead vegetation and debris from within the wetland itself.
The original wettand vegetation has apprarently died and cattails are taking over. Please remove the cattails and regrade
and replant the wetland vegetation as per the wetland planting plan which is part of the March 8, 2013 approved plan set.

Effective August 1, 2013: the State Stormwater program was transferred from the Division of Water Quality
(DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous references to DWQ
will remain in older Stormwater permits issued prior to August 1, 2013 until they are modified. Please note
that this letter references DI --MLR as the Division responsible for compliance with the permit.
On July 31, 2018, the Wilmington Regional Office of the Division of Energy, Mineral and Land Resources
(DEN,ILR) received final information regarding a request to transfer the subject permit to Excel Leland
Properties, Inc. Due to I Iurricane Florence, the required compliance inspection of the facility, located at 1 11
and 113 Thomas Garst Lanc, Leland; in Brunswick County, was delayed until October 24, 2018. State
Stormwater Management Permit Number SW8 051143 was issued on January 5, 2006 and was subsequently
modified and reissued on March 8, 2013. DEN-ILR file review and site inspection revealed that the site is not
in compliance with the terms and conditions of this permit. Please find a copy of the completed form entitled
"Compliance Inspection Report" attached to this letter, which summarizes the Findings of the recent
inspection.
As indicated in the attached inspection report, the following deficiencies must be resolved:
1. The constructed wetland stormwatcr control measure is overgrown with dense vegetation on the
slopes and in the deep pools that must be removed.
2. Access to the outlet structure is impeded by the woody overgrowth.
3. The wetland needs to be restored to design condition.

On August 23, 2013, the Wilmington Regional Office of the Division of Energy, Mineral and
Land Resources (DEMLR) inspected SPEC - Leland in Brunswick County to determine
compliance with State Stormwater Management Permit Number SW8 051143 modified and re-
issued on March 8, 2013. DEMLR file review and site inspection revealed that the site is not in
compliance with the terms and conditions of this permit. Please find a copy of the completed
form entitled "Compliance Inspection Report" attached to this letter, which summarizes the
findings of the recent inspection.
As indicated in the attached inspection report, the following deficiencies must be resolved:
1. The constructed wetland BMP approved in the March 8, 2013 modification does not
appear to have been constructed. The plan of action dated September 14, 2012
indicated that the BMP construction would be completed by May 1, 2013. Please
remember that within 30 days of completing construction of the BMP, the designer's
certification must be submitted to the Division.
Please inform this Office in writing before September 27, 2013, of the specific actions that will
be undertaken and the time frame that will be required to correct the deficiencies. Failure to
provide the requested information, or to respond to this letter by the due date, may initiate
enforcement action including the assessment of civil penalties of up to $25,000 per day. If a
written plan of action is not submitted to this office by September 27, 2013 then DEMLR staff
will re -inspect the site and issue a Notice of Violation if the listed deficiencies have not been
addressed.

On July 9, 2012, the Wilmington Regional Office of the Division of Water Quality (DWQ)
inspected the SPEC — Leland in Brunswick County to determine compliance with
Stormwater Management Permit Number SW8 051143 issued on January 5, 2006.
DWQ file review and site inspection revealed that the site is not in compliance with the
terms and conditions of this permit. Please find a copy of the completed form entitled
"Compliance Inspection Report" attached to this letter, which summarizes the findings of
the recent inspection.
As indicated in the attached inspection report, the following must be completed to bring
this project into compliance:
1. Demonstrate that the project still meets the requirements of a low density project.
The parking lot was found to have not been constructed according to the
approved plans, which was to provide sheet flow to a grassed swale. Instead,
the grade of the parking lot is inverted with curb and gutter and has an inlet
collecting and directing the runoff to an undetermined location. Please keep in
mind that piping is not allowed except the minimal amount necessary to direct
runoff beneath impervious surfaces such as roads and driveways. If the piping is
found to be in excess of the minimal amount necessary, one of the following
actions must be completed:
a. Remove the piping and reconfigure the site to match the currently
approved plan.
b. Revise the plan to receive approval for the added piping keeping in mind
that the site must still meet the requirements of a low density project.
c. Modify the permit to a high density project.
2. Upon completion of one of the items listed 1n Item 1 above, provide a certification
acknowledging the project has been constructed in accordance with the plans
approved by DWQ.
Please inform this Office in writing before August 22, 2012, of the specific actions that
will be. undertaken and the time frame that will be required to correct the deficiencies.
Failure to provide the requested information, or to respond to this letter by the due date,
may initiate enforcement action including the assessment of civil penalties of up to
