• The current permit lists the name of Chemetall Foote Corp. Since initial issuance of this
permit, a name change to Rockwood Lithium Inc. had occurred, with notification

Kings Mountain Facility, Cleveland County, North Carolina
Please accept this letter as official notification of a change in the individual
serving as the Responsible Signatory Official (RO) at Rockwood Lithium Inc.'s
(formerly Chemetall Foote Corporation) manufacturing facility located in Kings
Mountain, North Carolina. This request is necessitated by a recent change in the
Site Director at the plant.
The position of Site Director is responsible for making daily decisions that affect
the operation of the Kings Mountain plant and its potential impact to the
environment. As such, this position has served as the authorized Responsible
Official (RO) at this facility in the past and will continue to do so. Designation of
this position as the signatory agent meets the requirements set forth in Section
B.3 (a) and (b) of the site's NPDES Stormwater Permit referenced above.
With this notice, I authorize the new Site Director, Christian Mueller, to
serve as the primary signatory for all environmental permits at the Kings
Mountain facility.

There is no information available for Chloropicrin or Exxsol D-80. However, the Exxsol D-80
appears to be mostly hydrocarbons so if you come up with a TPH number it may be applicable.

For methyl bromide (CAS # 74-83-9) the benchmark was calculated to be
0.4 ug/L for the protection of aquatic life. This is a limited data value so use it with
caution. Connie suggested that you could request the use of the GC/MS method 601/624 to
analyze your samples. This is the approved method for methyl bromide and it would also
provide a screen for other pesticides. Metam sodium currently has no approved analytical
method as well as no data available on which to calculate a benchmark.

Hi Brian,
We have no data on which to calculate a benchmark for lithium. However, according to some of the information I've
seen, lithium appears to have a relatively low toxicity to aquatic life. I was able to find limited data for lithium chloride.
Again, it is not highly toxic with a benchmark value of 13 mg/L (this is a limited data value). The limited data tag is based
on the fact that one parameter in the equation had to be estimated (no data could be found) and the species the
benchmark is based on is only found in the western part of the country (however, the family is native to NC). As far as
our actual ability to test for lithium, I don't know whether the lab has a method to test for it or what compounds they
can pick up. You could contact them directly for that info if you are thinking of including lithium as a monitoring
parameter in you permit. Ellen Stafford would probably be the best lab person to contact for metals questions.

I'm permitting a chemical processing facility. Below is a description of some of their
onsite activities. They have lithium brines and lithium metal onsite. They wash drums that
have lithium metal in them. I don't know very much about lithium but would like to hear if
it can/should be monitored in stormwater and if we have any data to support a benchmark.

ADDITIONAL INFORMATION
I. General Description of onsite industrial activities.
The site is a diversified chemical processing I:acility.

e. pilot Facility - Produces developmental organometallic products in solvents.
2. Site Map

With respect to the stonmvater flows, there are 3 separate areas.
004 is on the Last Side of the plant. Runoff from that area flows through piping to a low point, where a
pipe carries the water under a plant road to SW Discharge Point 4, which discharges into Kings Creek.
Area OO5A discharges across the surface and through piping. All the run-off from this area drains into
piping in front of the Shipping building, and from there Flows under a road to a discharge in the area we
call the Sand Trap, The Sand Trap is simply an open area with no chemicals or equipment. It flows across
this area towards the South, where it enters a pipe that runs under a plant road and discharges into Kings
Creek.
Area 005B is primarily surface run-off that flows across the plant and a swale on the South side, above
Kings Creek, channels the flow to a [train pipe that runs under a plant road and then discharges into the
Sand Trap.
At one point, in previous permits, discharge point 005 was the only stormwater discharge point. The
problem was that it required a very significant rain fall event to get a discharge from pipe 005. Since there
was nothing in the Sand Trap area, we modified the permit to allow sampling and monitoring to occur at
Points 005A and 13.
3. Lithium brines outside
There is no secondary containment. The brine is in final product packagings that are inspected as part
of the Quality Management System. This inspection is done monthly. The maximum size of these
containers is 275 gallon totes. Most are 55 gallon and 30 gallon plastic drums. The brine stored in the
containers is neutral and has no ingredients that have RQ's. The brine in the final packagings is stored
in these areas, there is no processing, sampling or opening of containers.

4. Materials on site stored outdoors.
• HCI Bulk Storage Tank - 15,000 gallons, within containment.
• 1-1131 Bulk Storage Tank - 13,000 gallons, within containment, and wider roof, no sides
• Used Oil Tank - 1,000 gallons, in secondary containment.
• Diesel & Gasoline Tanks - 1,000 gallons, within containments, under roof, no sides
• Lithium Drum Wash - drums that had lithium metal are staged on a concrete pad until washed.
The pad is curbed and contained. No runoff from the pad. The neutralized washings are collected
in totes (275 gallon) for transfer to storage tanks. Adjacent to this area is the hexane storage area
where up to two 500 gallon transportable tanks are staged after delivery. These transportable
tanks contain hexane for use in the plant. The hexane is transferred to drums form the tanks.
These tanks are stored in a curbed area under a roof. The hexane in drums is stored in a building
(roof and walls) that has a containment.
• Bulk liquefied argon and carbon dioxide tanks. Cryogenic liquids.
• There are a number of empty cylinders for the shipment of product outside, around the Pilot
Facility. These cylinders arc kept closed.
• There are also several small tanks of cryogenic liquids (argon, nitrogen) staged around laboratory
areas, and two storage tanks for propane along with a storage rack for propane tanks for fork lifts.
There are compressed gas cylinders stored outside, adjacent to buildings. None appear to be any
issue related to stonnwater.
• There are a number of dumpsters on site. Some are equipped with covers, but some are not.

We are a little behind in getting out all of -our notices for renewal. I see from our
database that Ralph's permit, NCS000096, is valid until May 31, 2008. I think we
will have Ralph's notice out by the end of the year.
We are mounting a focussed effort (as of yesterday) to address a substantial backlog
of various tasks related to our individual stormwater permits, the NCSxxxxxx permits,
but I can't give Ralph a firm date for when we will have the renewal notice to him.
I advise Ralph to wait until we send him the renewal notice. I have confirmed that
his permit is in our system, and on that basis I expect we will not overlook
Chemetall when we catch up with renewal notices. I will today insert a copy of this
email into our file on NCS000096 as evidence that, so far, the delay in renewal is
attributable to DWQ, not Chemetall.
If he has not heard from us by Feb. 1, I would appreciate another contact, just to be
sure that there hasn'.t been a problem,at our end.

Enclosed please find a copy of the Compliance Evaluation Inspection Report for the inspection
conducted at the subject facility on April 29, 2008 by Ms. Donna Hood of this Office.
During the facility site review several pipe breaks in the fire suppression water supply line were
observed. Water leaking from this pipe was filling the storm water detention ponds, which would
negatively affect detention time during a storm event or accidental spill. It also causes excessive
water to be pumped from the creek during a time of serious drought in the State of North Carolina.
Please repair these Teaks as soon as possible.

Your facility is currently covered for stormwater discharge under NPDES Permit NCS000096. This permit expired on
May 31, 2008. North Carolina Administrative Code (15A NCAC 2H.0105(e)) requires that an application for permit
renewal be filed at least 180 days prior to expiration of the current permit. In order to assure your continued
coverage under your permit, you must apply to the Division of Water Quality (DWQ) for renewal of your.permit. To
make this renewal, process easier we are informing you that your permit will be expiring. Enclosed you will find an
individual permit renewal application form and supplemental information request.
Filing the application, form along with the requested supplemental information will constitute your application for
renewal of your permit. As stated above, the application form must be completed and returned along with all
requested information by June 5, 2009 in order for the permit to be renewed. Should your permit expire before the
renewed permit can be reissued continue to operate following the terms and schedule of the expired permit.
Failure to request renewal within the time period specified may result in a civil assessment of at least $500.00.
Larger penalties may be assessed depending on the delinquency of the request. Discharge of stormwater from your
facility without coverage under a valid stormwate'r NPDES permit would constitute a violation of NCGS 143-215.1 and
could result in assessments of civil penalties of up to $25,000 per day.
If the subject stormwater discharge to waters of the state has been terminated, please complete the enclosed
Rescission Request Form. Mailing instructions can be found on the bottom of the form. You will be notified when
the rescission process has been completed.

NPDES STORMWATER PERMIT
Two copies of each of the following shall accompany this submittal in order for the application to be considered complete:

1. A current Site Map from the Stormwater Pollution Prevention Plan. The location of
industrial activities (including storage of materials, disposal areas, process areas and
loading and unloading areas), drainage structures, drainage areas for each outfall,
building locations and impervious surfaces should be clearly noted.
2.. A summary of Analytical Monitoring results during the term of the existing permit
(if your permit required analytical sampling). Do not submit individual lab reports.
The summary can consist of a table including such items as outfall number,
parameters sampled, lab results, date sampled, and storm event data. H
3. A summary of the Visual Monitoring results. Do not submit individual monitoring
reports. The summary can consist of a table including such items as outfall number,
parameters surveyed, observations, and date monitoring conducted.
4. A summary of the Best Management Practices utilized at the permitted facility.
Summary should consist of a short narrative description of each BMP's in place at
the facility. If the implementation of any BMP's is planned, please include
information on these BMP's.
5. A short narrative describing any significant changes in industrial activities at the
permitted facility. Significant changes could include the addition or deletion of
work processes, changes in material handling practices, changes in material storage
practices, and/or changes in the raw materials used by the facility.
6. Certification of the development and implementation of a Stormwater Pollution
Prevention Plan for the permitted facility (Sign and return attached form).
If the final year analytical monitoring of the existing permit term has not been completed
prior to filing the renewal submittal, then the last years monitoring results should be submitted
within 30 days of receipt of the laboratory reports. (i.e. do not withhold renewal submittal
waiting on lab results)
Representative storm sampling may now be conducted anytime during the year (the April
to November window has been eliminated) and the representative rainfall event is now defined
as a storm event that measures greater than 0.1 inches and is preceded by at least 72 hours in
which no storm event measuring greater than 0.1 inches has occurred.

On reviewing the Draft Permit, I have some comments.
1. The new requirement for analyzing and reporting n-hexane is a concern since it is unlikely that n-
hexane would be present in KM's Stormwater Discharge.
• The largest container of hexane on site is only 500 gallons, so the greatest potential spill would be
that quantity.
• The hexane transfers are performed within containment.
• Hexane is very volatile, and quickly evaporates. A spill outside of containment would evaporate
within 30 minutes or an hour, so it is unlikely that there would be hexane residues from spills present
in stormwater.
• While n-hexane is a VOC and has issues relating to air releases, the best information I have at this
time does not indicate it is a significant issue with respect to releases to water.
The stormwater sample would have to be sent to a qualified laboratory for analysis, an added cost to
the facility.
2. The new requirement for analyzing and reporting oil and grease also requires that a sample be sent off
site for analysis. The largest tanks of oil on site is 500 gallons, and these are all within secondary
containment. The site has an active SPCC plan and program to verify the integrity of vessels of oil and
their containments.

D. If mining refuse is to be permanently disposed within the mining permit
boundary, the following information must be provided to and approved by the
Division of Lan&Res urces rip for to commencement of such disposal:

3. verification that a minimum of 4 feet of cover will be provided over the

11. An Annual Reclamation Report shall be submitted on a form supplied by the
Department by February 1 of each year until reclamation is completed and approved.
12. The operator shall notify the Department in writing mhe desire to delete, modify or
otherwise change any part of the mining, reclamation, or erosion/sediment control plan
contained in the approved application for a mining permit\or any approved revision to it.
Approval to implement such changes must be obtained from the Department prior to
on -site implementation of the revi "'ions.
13. The security, which was posted pursuant to N.C.G.S. 74-54 in the form of a $12,800.00
surety bond, is sufficient to cover the operation as indicated in the approved application.
This security must remain in force for this permit to be valid. The total affected land
shall not exceed the bond acreage.
14. A. Authorized representatives of the Division of Archives and History shall be
granted access to the site to determine the presence of significant \
archaeological resources.
B. Pursuant to N.C. G. S. 70 Article 3, 'The Unmarked Human Burial and Human
Skeletal Remains Protection Act," should the operator or any person in his
employ encounter human skeletal remains, immediate notification shall be
provided to the county medical examiner and the chief archaeologist, North
Carolina Division of Archives and History.

very carefully to ensure thorough understanding of the conditions and requirements it contains.
The draft permit contains the following significant changes from this facility's current permit:

1. Analytical monitoring parameters, pH and TSS have been maintained in this permit.
2. Analytical monitoring parameters, n-Hexane and Oil & Grease have been added to the analytical
monitoring requirements because they are potential pollutants from the site.
3. All analytical monitoring has been set to semi-annually during a representative storm event as defined in
Part II Section B. The permittee must also document the total precipitation for each event. If no discharge
occurs during the sampling period, the permittee must submit a monitoring report indicating "No Flow'
within 30 days of the end of the six-month sampling period. Additionally, samples must be taken a
minimum of 60 days apart, as specified in Table 2.
4. Benchmarks for analytical monitoring have been added to this draft permit. Exceedances of benchmark
values require the permittee to increase monitoring, increase management actions, increase record
keeping, and/or install stormwater Best Management Practices (BMPs) in a tiered program. If the
sampling results are above a benchmark value, or outside of the benchmark range, for any parameter at
any outfall then the facility shall follow the Tier 1 guidelines which require a facility inspection within
two weeks and implementation of a mitigation plan within two months. If during the term of this permit,
the sampling results are above the benchmark values, or outside of the benchmark range, for any specific
parameter at a specific discharge outfall two times in a row (consecutive), then the facility shall follow the
Tier 2 guidelines which require a repetition of the steps listed for Tier 1 and also immediately institute
monthly monitoring for all parameters at every outfall where a sampling result exceeded the benchmark
value for two consecutive samples.
5. You are required to collect all of the analytical and qualitative monitoring samples during representative
storm events as defined in Part II Section B. Qualitative monitoring is required regardless of
representative outfall status.
6. You are responsible for all monitoring until the renewal permit is issued. See Footnote 1 of Tables 1, 4,
and 5.

7. The flow reporting requirement has been removed per DWQ revised strategy. (The total rainfall
parameter is in this permit, however.)
8. Vehicle maintenance monitoring has been revised to semi-annually in order to coincide with analytical
and qualitative monitoring. This requirement appears in all Individual Stormwater permits, however it
only applies to facilities that do vehicle maintenance. If the facility, begins vehicle maintenance during the
permitted timeframe then the requirements shall apply.
Other permit changes:
1. Additional guidance is provided about the Site Plan requirements. The site map must now identify if the
receiving stream is impaired and if it has a TMDL established. It must also describe potential pollutants
in each outfall. The map requirements are stated more. explicitly. And, the site plan must contain a list of

Your facility is currently covered for stormwater discharge under NPDES Permit NCS000096. This permit
expires on August 31, 1999. In order to assure your continued coverage under your permit, you must apply to the
Division of Water Quality (DWQ) for renewal of your permit. To make this renewal process easier, we are
informing you in advance that your permit will be expiring. Enclosed you will find an individual permit renewal
application form, supplemental information request, and Stormwater Pollution Prevention Plan certification.
Filing the application form along with the requested supplemental information will constitute your application for
renewal of your permit. The application form must be completed and returned along with all requested
information within thirty days of receipt of this letter in order to constitute a timely renewal filing.
Recent legislation modified the fee structure for DWQ permits. Renewal fees have been eliminated and annual
fees have been changed. The new annual fee for your permit is now $715.00 (you will be invoiced later this year
for your annual fee.) A copy of the new fee schedule is enclosed in this package.
Failure to request renewal within the time period indicated may result in a civil assessment of at least $250.00.
Larger penalties may be assessed depending on the delinquency of the request. Discharge of stormwater from
your facility without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS
143-215.1 and could result in assessments of civil penalties of up to $10,000 per day.

Bill- I'm working on the NPDES permit renewal for the above facility. They are requesting removal of
Outfall 002 from the permit, since it was originally permitted for the discharge of stormwater from
industrial activities which are no longer in operation (Attachment 1). The last Compliance Sampling
Inspection conducted by Patricia Beam (Mooresville Region) concluded that 002 should be removed
from the NPDES permit, and be included in the stormwater permit (Attachment 2). I'm not sure what
she meant to be included in the stormwater permit, and she is no longer with the DWQ Regional office.
I talked with the facility (Ralph Hawk, Environmental Coordinator, 704-734-2698) and he wasn't sure
either. He said that their stormwater permit requires monitoring at 2 discrete stormwater discharge
points (4 and 5), but that the 002 outfall is downstream of any direct stormwater discharge point and
therefore may not be appropriate for stormwater monitoring.
I'm proceeding with drafting the NPDES permit with Outfall 002 removed. Bradley suggested I send
you the stormwater info to determine if any changes need to be made to the stormwater permit. Let me

Cyprus Foote Mineral Company is requesting the renewal of NPDES permit No. NC0033570. Enclosed
please find an application for renewal and a check in the amount of $250 to cover the renewal fee.
Cyprus Foote proposes the following modifications be made to the permit
Outfall 00 L
No permit modifications are recommended for Outfall 001 at this time. No changes to the process or
effluent have occurred since the last permit renewal.
Outfall 002:
Cyprus Foote is requesting the removal of Outfall 002 from the NPDES permit. Outfall 002 was
originally permitted for the discharge of stormwater originating from a mining/mineral plant process,
recycling system, and tailings pond. The mineral plant and associated ponds are no longer in operation;
no industrial activity is associated with the stormwater. Ms. Patricia Beam of the DWQ recommended
during the last Compliance Sampling Inspection that Outfall 002 be removed from the NPDES permit.
Because the only discharge from Cyprus Foote is boiler blowdown, no sludge is generated and, therefore,
the facility has no sludge management plan.

The facility was last inspected by Linda Vernon of this office on May 8, 1997.
PERMIT:
The permit for this facility became effective 3/l/94 and expires at midnight on 12/31/98,
Please be aware that the permit renewal application must be submitted at least 180 days prior to
permit expiration.
The facility is permitted for the discharge of stormwater from Outfall 002. Outfall 002
was originally permitted for the operation of a recycling wastewater system with intermittent
overflows from the tailings pond to Kings Creek when wet weather exceeded the facility's
recycling capabilities. Based upon correspondence from the company, the mineral plant,
recycling system, and tailings pond are no longer in operation. It is this Office's understanding
that Outfall 002 samples are often collected when no rain event has occurred; therefore, these
samples do not reflect stormwater run-off from the old reservoir. The Cyprus Foote Mineral
Company also has a Stormwater Permit, No. NCS000096. It is recommended that Outfall 002 be
deleted from the NPDES discharge permit and be included in Stormwater Permit No.
NCS000096. The "effluent" samples for Outfall 002 are collected instream at the Kings Creek
Weir No. 3, which the operator indicated is also the downstream sampling point for Outfall 001.
It is recommended that the sampling duplication also be addressed upon permit renewal.
FACILITY SITE REVIEW/OPERATIONS AND MAINTENANCE:
Cyprus Foote Mineral Company is permitted to discharge condensate, non -contact
cooling water and boiler blowdown water from Outfall 001, and to discharge stormwater from
Outfall 002 to Kings Creek- a Class C water in the Broad River Basin.
The process water sump, which the operator indicated consists of boiler blowdown
water, is pumped as needed. The pH of the wastewater is adjusted and recirculated through a
filter before discharge.
LABORATORY:
Laboratory analyses for pH, total suspended solids, settleable solids, turbidity, and
lithium are performed by the on -site certified laboratory. Documentation is maintained to verify
pH analyses are conducted within 15 minutes of sample collection. The laboratory was not
evaluated during the inspection. Toxicity tests are performed by Burlington Research Laboratory
in Burlington, N.C. The thermometer which the operator uses for on -site temperature
measurements is checked against a NIA 18gcrptation is maintained.
