Sullins, Director Division of Water Quality July 25, 2007 DWQ Project # 04-1818, Ver. 2 Franklin County Subject Property: Town of Louisburg - 2004 Sewer Improvements Ut to Tar River [030301, 28-(24.7), WSV, NSW] REQUEST FOR MORE INFORMATION Dear Sir or Madam: On Jure 2~; 2007, the Division of Water Quality (DWQ) received your application dated Apri130, 2007 to permanently impact 0.018 acres of 404/wetland, temporarily impact 0.71 acres of 404/wetland, permanently impact 80 linear feet of perennial stream, and permanently impact 3,600 square feet (ft2) of Zone 1 of the Tar-Pamlico River basin protected riparian buffers and 4,000 square feet (ftZ) of Zone 2 of the Tar-Pamlico River basin protected riparian buffers, to construct sewer line improvements at the site. On July 20, 2007, the DWQ received additional information from you, however, the DWQ has determined that your application remains incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetland, streams and/or buffers on the subject property. Therefore, unless we receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and 2B .0233(8) and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. You indicated in your correspondence dated July 20, 2007, and received by the DWQ on July 20, 2007, that impacts for the project have been reduced. Please submit updated impact tables from your Pre-Construction Notification application. As previously requested, DWQ's rules require that we certify that the project will not result in "cumulative impacts, based on past or reasonably anticipated future impacts, that cause or will cause a violation of downstream water quality standards" NCAC 2H .0506(b)(4), and therefore, we requested a qualitative secondary and indirect cumulative impact analysis be performed and submitted to the DWQ. Alternatively, one way to address this concern is to have the Town of Louisburg commit to requiring on-site stormwater management measures (such as level spreaders, bioretention or constructed wetlands) for the additional development when those parcels are developed. However, the Division is open to other approaches that would give us the assurance that downstream water quality would be protected from the cumulative impacts of this project. If we do not receive this requested information within 30 calendar days of the date of this letter, your project will be withdrawn and you will need to reapply with a new application and a new fee. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
