On behalf of DR Allen & Son, Inc., I hereby submit the attached NPDES Application for
Coverage under General Permit NCG02 for a proposed sand and gravel mine located near the
end of Gainey Road (SR2221) in Cumberland County. While the permitted acreage at the site
will be 201.5 acres, only 116 acres will be affected as part of the proposed mining operation. Nc
pit dewatering is proposed and no washing of material or plant process water will be generated.
Our methods for capture and treatment of surface water runoff during the initial and ongoing
site development are described in detail in the attached NPDES application and the attached
mine plan sheets. We have also attached our $100 stormwater permit application processing
fee to initiate the review of our application.
Copies of the detailed mining permit application form and its attachments have been
filed separately with DEMLR's Mining Program for its review in issuing the mining permit. Your
staff may want to review this information as well as it provides additional details regarding the
proposed mining operation.

Hanson Aggregates Tract; Gainey Road; Cumberland County
Dear Mr. Allen:
Per your direction, Land Management Group (LMG) performed a wetland delineation of the
approximately 201-acre parcel located off of Gainey Road in Fayetteville, Cumberland County,
NC. Our work included a review of available maps (county soil survey, USGS topographic
quadrangle, etc.) and aerial photographs as well as a site evaluation. LMG staff visited the site
in April of 2021 to perform the delineation. Our on -site evaluation included assessments of
the three parameters (soils, hydrology, and vegetation) that identify the limits of wetlands as
defined in the 2010 Regional Supplement to the Corps of Engineers (COE) Wetland Delineation
Manual: Atlantic and Gulf Coastal Plain Region (Version 2.0). We also followed the Navigable
Waters Protection Rule established in 2020 to define potential jurisdictional and non -
jurisdictional waters. The following is a summary of our findings.
Based upon observations noted at the time of our field evaluation, it is our opinion that
approximately 9.2 acres of the tract (5%) consist of jurisdictional wetlands as regulated by the
COE. Additionally, 7.7 acres (4%) of the site contain non -jurisdictional wetlands that would not
be regulated by the COE but could still be regulated by the State (NC Division of Water
Resources). These areas exhibit conditions that satisfy the three criteria required for the
determination of wetlands. In particular, indicators of hydrology, wetland vegetation, and
hydric soils were identified. Non -jurisdictional wetlands meet the definition of wetlands, but
do not appear to have a direct connection to downstream waters of the U5. Approximately
19.7 acres of upland dug borrow areas were also observed (but not flagged) on site.
Additionally, a ditch that is approximately 520 LF in length was noted within the tract. This
ditch did not have an ordinary high water mark and it is our opinion that it is non -jurisdictional.
The remaining portion of the site consists of more well -drained soils and vegetation
characteristic of uplands.

considered to be wetlands and waters. Our findings are based upon site evaluations, field

notes, and data gathered using a non -survey grade GPS unit. Therefore, it should be noted
that upland/wetland acreages are to be considered preliminary. Review and approval of the
delineation by the COE and a survey prepared by a Professional Licensed Surveyor are
recommended prior to specific site planning.
