Division personnel have reviewed and approved your application for renewal of the subject permit.
Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant
to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as
subsequently amended).
This permit contains two changes from the draft permit sent to you for review:
> In A. (1.) Effluent Limitations And Monitoring Requirements, footnote 3 for Total Residual
Chlorine has been modified by adding "The limit and monitoring of TRC are required only if
chlorine or chlorine derivatives are present in the wastewater."
> In A. (1.) Effluent Limitations And Monitoring Requirements, footnote 4 for composite sampling
has been modified by adding "A composite sample taken from the lagoon effluent overflow to
the wet well shall be considered to be a representative sample."
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty
(30) days following receipt of this letter. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of
Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless
such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may
require modification or revocation and reissuance of the permit. This permit does not affect the legal
requirements to obtain other permits which may be required by the Division of Water Quality or
permits required by the Division of Land Resources, the Coastal Area Management Act or any other
Federal or Local governmental permit that may be required.

3. The limit for total residual chlorine shall become effective upon completion of the installation of a
dechlorination system but no later than 18 months after the effective date of this permit. Monitoring and

if chlorine or chlorine derivatives are present in the wastewater.
4. The requirement for composite samples will begin 18 months after the effective date of this permit. Grab
samples shall suffice until that date. A composite sample taken from the lagoon effluent overflow to the wet
well shall be considered to be a representative sample.
5. Fluoride monitoring shall apply only if the facility backwashes with fluoridated, finished water.
6. TN is Total Nitrogen, which is TKN + NO3-N + NO2-N where TKN is Total Kjeldahl Nitrogen, NO3-N and NO2-N
are Nitrate and Nitrite Nitrogen, respectively.
7. Acute 24-hour Pass/ Fail Mysid Shrimp at 90%; March, June, September and December; refer to Special
Condition A (2).

A. (2.) ACUTE TOXICITY MONITORING (QUARTERLY)
The permittee shall conduct acute toxicity tests on a quarterly basis using protocols defined
in the North Carolina Procedure Document entitled "Pass/Fail Methodology For
Determining Acute Toxicity In A Single Effluent Concentration" (Revised -July, 1992 or
subsequent versions). The monitoring shall be performed as a Mysid Shrimp (Mysidopsis
bahia) 24 hour static test. The effluent concentration at which there may be at no time
significant acute mortality is 90% (defined as treatment two in the procedure document).
Effluent samples for self -monitoring purposes must be obtained during representative
effluent discharge below all waste treatment. The tests will be performed during the
months of _March, June, September, and December.

All toxicity testing results required as part of this permit condition will be entered on the
Effluent Discharge Monitoring Form (MR-1) for the month in which it was performed, using
the parameter code TGE3E. Additionally, DWQ Form AT-2 (original) is to be sent to the
following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences
Section no later than 30 days after the end of the reporting period for which the report is
made.
Test data shall be complete and accurate and include all supporting chemical/physical
measurements performed in association with the toxicity tests, as well as all dose/response
data. Total residual chlorine of the effluent toxicity sample must be measured and reported
if chlorine is employed for disinfection of the waste stream.
Should there be no discharge of flow from the facility during a month in which toxicity
monitoring is required, the permittee will complete the information located at the top of the
aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number,
county, and the month/year of the report with the notation of "No Flow" in the comment
area of the form. The report shall be submitted to the Environmental Sciences Section at
the address cited above.
Should the permittee fail to monitor during a month in which toxicity monitoring is
required, then monthly monitoring will begin immediately. Upon submission of a valid
test, this monthly test requirement will revert to quarterly in the months specified above.
Should any test data from either these monitoring requirements or tests performed by the
North Carolina Division of Water Quality indicate potential impacts to the receiving stream,
this permit may be re -opened and modified to include alternate monitoring requirements or
limits.
If the Permittee monitors any pollutant more frequently then required by this permit, the
results of such monitoring shall be included in the calculation & reporting of the data
submitted on the DMR & all AT Forms submitted.

NOTE: Failure to achieve test conditions as specified in the cited document, such as
minimum control organism survival and appropriate environmental controls, shall
constitute an invalid test and will require immediate follow-up testing to be completed no

The TRC of 13 micrograms per liter limit. Could we have added a footnote as on the fluoride
from appendix A. (1.)? We do not use system (chlorinate, fluoridated) water to backwash or
regenerate our filters/softeners.
• Composite sampling; I would like an explanation on how to achieve a proper
composite sample when the plant has neither a continuous flow nor constant volume
of effluent. Due to the nature of our influent being dependant upon the needs of the
filters/softeners, our effluent pumps run an average of <6 hours a day, and there is
some brief nominal drainage after the pumps shut down.
• Quarterly Whole Effluent Toxicity Monitoring; in appendix A. (1.) the measuring
frequency is listed as 2/month.

There are 11,239 acres and 6.7 stream miles of Class SA waters in subbasin 03-05-01 that
were assessed in the shellfish harvesting use support category in this subbasin, 6,631 acres
(59%) are considered impaired in the shellfish harvesting use support category. The upper
234 acres of Queens Creek are not supporting shellfish harvesting. This portion of Queens
Creek is DEH SS classified as prohibited/restricted and permanently closed to shellfish
harvesting. The middle 161 acres of Queens Creek are also not supporting shellfish
harvesting. This portion is DEH SS classified as conditionally approved -closed and was
closed to shellfish harvesting most of the assessment period. The lower 270.6 acres of
Queens Creek are rated partially supporting. This portion is DEH SS classified as
conditionally approved -open and was closed to shellfish harvesting 15.6 percent of the 5-year
assessment period.
PART II - BACKGROUND AND HISTORY
Facility was first permitted in 1993.
PART III - DESCRIPTION OF DISCHARGE AND TREATMENT WORKS

4) Date(s) and construction activities allowed by previous Authorizations to Construct issued in the
previous two years:
A to C granted on July 25, 2006 for the construction of two new 730,000 gallon lagoons lined
with 60 ml HDPE, installed in line with two existing 730,000 gallon lagoons, in conformity with
the project plan. Completion of construction was February 28, 2007 (per engineer's
certification).
5) Please provide a description of existing or substantially constructed wastewater treatment
facilities:
This water treatment plant utilizes conventional treatment (suspended solids settling), green sand
filtration for iron and manganese removal, ion exchange for calcium and magnesium removal,
carbon filtration for TOC removal. The facility backwashes with chemically treated potable
water. Potential treatment additives are potassium permanganate and chlorine for disinfection,
household cleaners (unidentified), sodium chloride and fluoridation. Treated water is used for
backwashing.
The facility has four lined lagoons with a 750,000 gallon capacity each. Influent can be
introduced to all four lagoons. Wastewater exits from the third lagoon only. Settling time may
be considerably shorter depending upon where the influent is introduced. Typically influent

would be introduced to the first lagoon to provide adequate detention time for settling. The
influent flow is 1300 gpm as a batch feed. There are no chemical additions to promote settling.
Effluent from the effluent vault is pumped using one 80 gpm pump and a 350 gpm pump.

7) Possible toxic impacts to surface waters: Chlorine, fluoride and various potential metals
such as copper, manganese, lead, and zinc.

9) Residuals handling and utilization/disposal scheme:
Solids will be removed from each lagoon and dewatered to pass the paint test, transported by
truck to the Onslow County Landfill. Lagoons will have solids removed every three years to
prevent reduction in detention/settling time.
Compliance history for this facility within the past permit cycle is as follows:
One violation in June 2003 for a TSS daily maximum exceedance resulting in one notice of
violation in the past permit cycle. Compliance history is good.

PART V - EVALUATION AND RECOMMENDATIONS
Please note the subbasin is not 030502. The subbasin for this segment of the White Oak Basin is
030501. Please make that change in the permit. The classification is correct.
This facility utilizes green sand filters as well as ion exchange. Please include all the permit

parameters, limits and monitoring frequencies per Table 4. Appendix B Monitoring Requirements
for Ion Exchange WTPS issued January 2004 by the permitting unit (see attachment). This facility
has a backwash discharge of greater than 0.5 MGD, therefore the monitoring frequencies shall be as
follows: if limited weekly, if not limited 2/month. This facility does utilize fluoridated water for
backwashing, therefore include the fluoride limit of 1800 µg/L with weekly monitoring (permit
application identified backwash discharge of 0.518 MGD) since this is not included in the ion
exchange permitting guidance document. TRC should have a limit of 13 µg/L since the discharge is

Hubert Water_ Treatment Plant
Effective February, 2006
A puinp and haul method of removing solids from the four (4) lagoons at Hubert will be
utiliied. Solids will be dewatered to pass the paint test and transported by truck to the
Onslow County Landfill.. The lagoons will be pumped every three (3) years so as not to
allow solids accumulation to interfere with detention time.
