Clarke I believe that it is time for DEM to resolve the issue of whether or not to grant a NPDES permit to John S. Clarke. There seems to be two major points of controversy in regard to allowing them to discharge into a u.t. of the Yadkin River. These are: 1) Where the discharge site will be located. 2) Whether or not there is actual flow for a designated discharge site. Regarding item 1, the Region sent a letter and map to Permits on 9-3-87 (Appendices A.1 and A.2) describing the point of discharge. I secured low -flow statistics for this site on 10-9-87. These are: DA = 0.18 square miles S7Q10 = 0.0 cfs 30Q2 = 0.07 cfs Under existing DEM procedure, a discharge at this site would be granted 5 mg/1 BOD5 and 2 mg/1 NH3-N limits. However, the consultant for John S. Clarke, Ralph Owens of Municipal Engineering in Raleigh, insists that this site is incorrect. He states that the original site submitted in April of 1986 (Appendices B.1 and B.2) is correct. The issue is further complicated by the fact that the Region did a field survey of the original site in June of 1986. Upon completion of the survey, a letter was sent to Meg Kerr stating that the drainage area used by USGS to calculate flows was incorrect (Appendix C.1). It appears that USGS had estimated 0.36 square miles while the Region had estimated 0.28 square miles. Also included was a map depicting the drainage area that the Region felt was correct (Appendix C.2). I recently had USGS recalculate the drainage area and flows for this site using the map sent by the Region. These are compared with the original USGS statistics: Estimates done on 11-19-87 DA =0.312 square miles S7Q10=0.051 cfs 30Q2 =0.129 cfs Original Estimates DA = 0.357 square miles S7Q10 = 0.058 cfs 30Q2 = 0.148 cfs In this case the secondary limits given under the original WLA would still apply. Furthermore, regardless of whether the discharge site is upstream or downstream of the dragstrip, it is my understanding that the Region feels that there is no flow at either site during low -flow conditions. Although I appreciate the Region's concern about approving a discharge to a zero -flow stream, DEM is required to use USGS low -flow statistics for evaluating limits. These statistics, however, can be amended if it can be documented that they are not representative of actual stream conditions. I have enclosed a copy of the procedure for proposing an amendment to flows at a discharge site (Appendix D). In conclusion, it is my recommendation that the Region satisfy itself that the actual discharge site is the location that Mr. Owens proposes and that it approve the secondary limits for this site. If the Region is going to investigate the accuracy of the USGS estimates for this site, then I further recommend that it ask that a reopener be put in the permit so that the limits can be changed if a zero -flow situation and water quality violations are documented. Clark Company Yadkin County On August 24, 1987, you requested that the subject permit be reissued in the name of Yadkin County. A review of the permit file revealed that the effluent limitations in the permit were for a discharge point located below the confluence of two unnamed tributaries. This point is located approximately 1200 feet below the dragstrip. Plans submitted, in conjunction with the name change, shows a proposed point of discharge to the unnamed tributary above the dragstrip. If it is the County's wish to discharge at this point, you will be required to meet more stringent limitations as shown on the attached proposed effluent sheets B-1 and B-2. If the County discharges below the confluence of the two unnamed tributaries the existing permit limits (Sheet A) would apply. Attached is a proposed reissued permit which contains revised effluent limitation pages reflecting the appropriate limits, depending on the point of discharge. If the County agrees to discharge at the confluence of the two tributaries (about 1200 feet downstream from the dragstrip) the permit will be immediately reissued in the County's name with effluent limits contained on Sheet A. If the County chooses to discharge at the upstream point and agrees to provide treatment works to produce the effluent limits shown on Sheet B-1 (Summer) and B-2 (Winter), the permit will immediately be reissued in the County's name. On this map is the longitude and latitude that the requested waste load was run. Attached are two waste load sheets with WSRO comments. It was our understanding that the waste loads had been run at the requested points by this Office. A new map has been attached which marks the spot where the Winston-Salem Regional Office understands that the permitted discharge is located. The new map has the longitide and latitude marked on it. This Office does not feel that it can recommend( the transfer of the permit until a wasteload has been run at the designated point of discharge. East Bend Yadkin County Meg, Steve and I took another look at the site yesterday (June 4, 1986). We have attached a map of the drainage area (red area with black tick marks). This is the area USGS gave the proposed flow. We do not believe this area will meet the requirements for flow. Mr. Henning indicated they believed they could obtain a right-of- way from the owner of the drive in theater without any problem. I have marked an X on the creek where his property ends. If you will check to see if this area will meet the requirements for flow and let Steve Mauney or myself know we would appreciate it. If you need further information please call.
