Dear Ms. LeVei=;
This letter is to follow-up our meeting on February 27, 2001 concerning potential
settlement of the subject case. PTR, Inc. is proposing to stttls this matter with DENR as follows-
(1) a total payment to DENR in the amount of $6,592.28 pursuant to a Settlement Agreement
containing the standard no admission of any fact or liability provision, and (2) including a
provision in the Settlaxwnt Agreement which provides that the settlement is subject to FTR, Inc.
(or Parker Manufacturing, Inc., the current property owner) reaching agreement with the U S
Army Corps of Engineers ("Corps') aired taking within a spsaified period of time all agreed upon
sticps nrcessary to resolve to the Corps' satisfaction the alleged Clean Water Act violations
previously noted in correspondence from the Corps to Rocky Carter regarding the property at
issue,
Accordingly, as we discussed, this settlement can be viewed as l.)ENR receiving frill
payment of the $5,000 penalty assessed by DENR for violation of 15A NCAC 2B .0211(2) and
Rill payment of enforcement costs in the amount of $1,592.28. As we also discussed, it appears
that the basis for DENR's $4,000 penalty assessment for violation of 15A NCAC 2H .0501(b) is
ii; ;Fact PTR's failure to secure a § 401 water quality certification as required under the Clean
Water Act. Obtaining a § 401 cm ifieation is federal regtlirement, and DENR's rules provide the
mechanism for obtaining such 401 Cerktfleationwhen required under the Clean Water Act. Thus,
this element of DENR's penalty assessment will also be addressed vy melting tine SC«lCiilent
Agreement subject to ultimately satisfying the Corps with itgwd to any allcgod Clean 'Water Act
violation.
