ECS identified five jurisdictional tributaries traversing the site and a jurisdictional wetland area on the northwest portion of the site. Our client, Strata Solar Development, LLC, reduced the project footprint to 40 acres and excluded two jurisdictional tributaries and the jurisdictional wetland area from the project footprint. 1 b. The proposed road crossings are located at four locations along the jurisdictional tributary on the central portion of the site. These road crossing are critical to provide access during construction and for maintenance of the solar farm after construction. Other wetland impacts were avoided. 2. According to the drawings, the total discharge of fill material below the plane of ordinary high water will be 6 cubic yards As proposed, the project is authorized under Nationwide Permit 18 and does not require the submittal of a PCN form to the USACE. The subject site is located east of the residential dwelling located at 3850 NC Highway 17 in Emul, Craven County, North Carolina. Based on the jurisdictional determination (SAW - 2012 - 01454) issued on March 6, 2013, there are three jurisdictional tributaries traversing the site, and a relatively permanent water (RPW) along the northern boundary of the site. It is our understanding the USACE has determined these features to be Waters of the U.S. The proposed solar farm includes the placement of three (3) 46 -foot long culverts within the jurisdictional tributary on the central portion of the site. The placement of said culverts will result in 414 square feet of impacts to Waters of the U.S. The volume of material below the ordinary high water mark will be 6.0 cubic yards. Plan view and cross section site plans have been provided for your review. Based on our telephone conversation on October 9, 2013, the proposed activity is permissible under Nationwide Permit # 14. According to USACE requirements, pre - construction notification is not required for a NW -14 if impacts to Waters of the U.S. are less than 1/10 acre and there are no discharges to special aquatic sites. There are series of non- junsdictional ditches and jurisdictional tributaries (i e ditches) oriented north to south, and a RPW along the northern property of the site (see attached figures) Each of the features are man -made. (1) new information reveals impacts of this identified action that may affect listed species or critical habitat in a manner not previously considered; (2) this action is subsequently modified in a manner that was not considered in this review; or, (3) a new species is listed or critical habitat determined that may be affected by the identified action. However, the Service is concerned about the potential impacts the proposed action might have on aquatic species. Aquatic resources are highly susceptible to sedimentation. Therefore, we recommend that all practicable measures be taken to avoid adverse impacts to aquatic species, including implementing directional boring methods and stringent sediment and erosion control measures. An erosion and sedimentation control plan should be submitted to and approved by the North Carolina Division of Land Resources, Land Quality Section prior to construction. Erosion and sedimentation controls should be installed and maintained between the construction site and any nearby down - gradient surface waters. In addition, we recommend maintaining natural, vegetated buffers on all streams and creeks adjacent to the project site. The North Carolina Wildlife Resources Commission has developed a Guidance Memorandum (a copy can be found on our website at (http://%v%vw.fws.gov/raleigh) to address and mitigate secondary and cumulative impacts to aquatic and terrestrial wildlife resources and water quality.
