Dear Gainey:
On March 11, 2011, David Cox of the Wilmington Regional Office of the Division of Water
Quality (DWQ) inspected Waste Industries 421 site in New Hanover County to determine
compliance with Stormwater Management Permit Number SW8 880213 issued on August 4,
1997. DWQ file review and site inspection revealed that the site is not compliant with the terms
and conditions of this permit. Please find a copy of the completed form entitled "Compliance
Inspection Report" attached to this letter, which summarizes the findings of the recant
inspection.
As indicated in the attached inspection report, the following deficiencies must be resolved:
1. The State Stormwater Permit must be renewed by June 30, 2011. This permit expired on
August 4, 2007.
2. Remove sediment out of both infiltration basins and restore approved depths as
discussed onsite.
Please inform this Office in writing before May 4, 2011, of the specific actions that will hp
undertaken and the -time frame that will be required to correct the deficiencies. Failure to provide
the requested information, when required, may initiate enforcement action including the
assessment of civil penalties of up to $25,000 per day. If a written plan of action is not
submitted to this office by May 4, 2011, then DWQ staff will re -inspect the site and issue a
Notice of Violation if the listed deficiencies have not been addressed.
Please be reminded that if any ownership or name change has occurred it is the permittee's

8. Corrective:
Sediment traps 13-16 were removed. Swale appeared to be stable and areas were the sediment traps were located
were excelsior matted. The drop inlet on the south side of the crossing in this area was removed. This is not
shown on the approved plans.
The Swale in front of lot 119 in the area of the Fire Hydrant needs additional excelsior mat installed.
Swales and -pipes at the corner of Deer 1I111 Drive and Gentle Slope Drive in front of lots 112-114 have been changed
and are no longer installed as per plan. Swale on the east side of Gentle Slope Drive in front of lot 114 runs directly
into the wetlands. This swale was sodded and matted. Ensure that this swale is completely stable to prevent any
sediment from being discharged into the wetlands.
Silt fence around the wetland areas need to be maintained. Roman stated this work would be performed on MA I
Driveway pipe and driveway installed off of Deer Hill Drive do not appear on the approved plan.
Drop inlets on the side of New Hope Place by lots 104 and 110 do not appear to be installed as per the approved
plan.
Road side swales throughout the Phase I/H area were observed washing and need to be repaired and stabilized.
Sediment trap rock filters throughout the site should be maintained as needed. Ensure that rock filters are not
holding back water and can drain down.
Revised plans and calculations need to be submitted to this office for review showing all changes to the swales and
pipes. This should have been done prior to making any changes in the field.
Will drainage changes affect NC DENR Storm Water Permit?

Report". The report summarizes the findings of a recent inspection of the project's stormwater controls
conducted on September 16, 1993 to determine compliance with Stormwater Certification Number 880213
issued on June 7, 1988.
A summary of the findings and comments are noted under Section 6 of the report. Appropriate
action, if required, should be completed by October 28, 1993. Please inform this Office by letter when

Dear Mr. Howard:
On July 26, 1991 I received a Notice of Violation for Stormwater Project
#880213 issued to Waste Industries, Inc., New Hanover County dated July
23, 1991.
We are pleased that Ms. Alexis Finn brought this to our attention through
her inspection of our facility. We (Waste Industries, Inc.) were totally
unaware that this storm water certification and drawings ever existed.
Somehow during the development of our facility, the communication between
Waste Industries, Inc., H.S. Annis, Architect and Mr. Henry Webster, P.E.,
failed and this important certification was overlooked.
We are currently taking bids on correcting our .facility by installing the
three infiltration basins and monitoring wells in accordance with the
certification issued on July 7, 1988. The project will be completed
within 45.days of the date of this letter and an engineer's certification
will be forwarded to your office by October 3, 1991.

On July 7, 1988, a Certification of Compliance with
Stormwater Regulations, Number 880213, was issued to Mr. Henry
Webster, P.E., for Waste Industries, Inc. located on S.R. 421 in
New Hanover County. On July 12, 1991, Regional Office Staff
conducted a compliance inspection of the subject project's
stormwater facilities and found none existed. The plans and
specifications approved by this Office required the subject
site's stormwater runoff to be routed to 1 of 3 infiltration
basins. The lack thereof establishes violations with 15A NCAC
2H.1003(a)(7).
It is requested you provide this Office with a written
response to this Notice before August 19, 1991. Your reply
should identify specific corrective actions which will be
undertaken to resolve these deficiencies and provide a timetable
for the completion of the corrective actions. Failure to
satisfactorily complete the corrective action in a timely matter
may result in assessment of civil penalties and/or revocation of
the Stormwater Certification issued for Waste Industries, Inc. on
July 17, 1988.

Dear David:
When you called our office Friday, July 12, 19911 and told us
that an inspection by the Division of Enviror►mental Management
had found that the project was not in compliance with the site
permit, I had no idea what could possibly be out of compliance.
After review of my files, I can only guess what happened three
years ago on the site plan approval process. This office hared a
consultant, Mr. Henry Webster, to prepare site plan drawings and
acquire all site plan approval, permits for the project. After
the site Arlan was prepared, Mr. Webster submitted it for approval
to the Department of Natural Resources and Community Development
and received an approval letter dated February 17, 1988. As pact
of that approval letter a comment was attached stating additional
permits may be necessary from tither agencies. Mr. Webster noted
at that time that he knew of no other permit required but would
look into it.
It appears that Mx. Webster did find an additional permit was
required and prepared a drawing and obtained an approval setter
dated June 7, 1988. At this point the project was nearly
complete and a copy of the June 7, 1988, approval letter and a
drawing was sent to my office from Mr. Webster with a note
attached that reads "copy of storm water approval letter and
drawing for your files." It appears due to the hate time in
construction that this was thought to be part of the original
site permit already obtained and that Mr. Webster was cleaning
out his files. This office filed the letter and drawing with no
additional action taken.
