The focus of the investigation was to assess animal waste concerns originating from the onsite meat processing facility operated by Mr. Terry Khan. The findings from that investigation were addressed in a Notice of Violation (NOV-2020-DV-0468) letter dated October 23, 2020. This Notice was reissued and dated for April 20, 2021. The following is a listing of the subsequent investigations, resulting additional violations, and required corrective actions: I. Follow Up Visit April 1, 2021 On April 1, 2021, DWR staff Rebecca Chandler and Caitlin Caudle conducted another follow up visit with Mr. Khan to assess remedial actions subsequent to NOV-2020-DV-0468. At the time of this follow up, Mr. Khan had installed an earthen berm below the animal holding pens that was collecting animal waste. Division of Water Resources staff also noted that channelized wastes in a relic field ditch had visibly accumulated and the field appeared to be inundated. The area was visibly saturated with wastewater. Upon further investigation, DWR staff found two non - permitted waste pits upstream of the relic field ditch. At the time of discovery, the waste pits were actively overflowing and discharging into wetlands that ultimately discharge into an unnamed tributary (UT) to Rich Fork Creek. The junction box had been uncovered and the lid removed. A trench leading from the junction box to a small pit had been dug, with wastewater standing in the pit. From the junction box, PVC pipes carried wastewater below ground, downslope, until the pipe reemerged on the ground surface. A corrugated pipe had been loosely attached to the PVC pipe, allowing wastewater to discharge directly to the ground surface and overland flow downslope. The wastewater captured by the corrugated pipe was carried downslope to an earthen trench that led to a non -permitted waste pit approximately 5 feet deep and 20 square feet in area, and a second non -permitted waste pit approximately 2 feet deep and 40 square feet in area. Wastewater was overtopping the berm of the shallow non -permitted waste pit and comingling with wetlands. II. Sampling Visit April 5, 2021 On April 5, 2021, DWR staff Rebecca Chandler and Caitlin Caudle returned to collect surface water samples and further investigate the status of the non -permitted waste pits and the existing kill -room septic tank for wastewater collected at this facility. Prior to this site visit DWR staff had the understanding that all wastewater, industrial and domestic, generated at this facility were entering the kill -room septic tank. The property is bordered by Rich Fork Creek, which is protected as a Class C water according to the NC Surface Water Classification. Class C waters are to be protected for secondary recreation, fishing, wildlife, fish consumption, aquatic life including propagation, survival and maintenance of biological integrity, and agriculture. Samples were collected from four locations: Rich Fork upstream of the non -permitted storage ponds and UT convergence (Upstream), downstream of the convergence of the UT with Rich Fork (Downstream), at the discharge of wastewater into the UT, and from the surface of one of the unpermitted waste pits. Samples were analyzed for fecal coliform, nutrients (ammonia, nitrate, total kjeidahl nitrogen, phosphorus), biological oxygen demand (BOD), and turbidity. Follow Up visit April 15, 2021 On April 15, 2021, DWR staff Rebecca Chandler and Caitlin Caudle returned to the site to meet with yourself and Jason Koontz of Davidson County Department of Environmental Health. In discussion with you, it was stated that two separate systems were originally installed onsite: one subsurface septic disposal system for domestic wastewater, and a separate subsurface disposal system connected to the exposed, concrete kill -room septic system. You stated that the kill -room septic system was installed in 1973. Mr. Koontz confirmed the location of the domestic septic tank for the meat processing facility and determined with best professional judgement that the domestic septic system was in -tact and operable. At the time of this visit, it was apparent that steps had been taken to remove evidence of conveyance of wastewater from the existing kill -room septic tank to the non - permitted waste pits. A trench approximately one foot deep had been dug to partially drain the non -permitted waste pit, creating an additional outlet to the water of the State. IV. Violations 1. As described in Items I and III, creating an outlet into the waters of the State without a valid permit is a violation of North Carolina General Statute 143-215.1(a)(1). 2. As described in Item I, altering, extending, or changing the construction or method of operation of any sewer system, treatment works, or disposal system within the State. without a valid permit is a violation of North Carolina General Statute 143-215.1(a)(3). 3. As described in Item II, causing any waste, directly or indirectly, to be discharged to or in any manner intermixed with the waters of the State in violation of the water quality standards applicable to the assigned classifications is a violation of North Carolina General Statute 143.215.1(a)(6). V. Required Corrective Actions The Division requests that you take the following required actions to properly remediate the violations included herein: 1. If not already completed, immediately stop any wastes from discharging to surface waters, onto ground surface, and/or the non -permitted waste pits from the concrete tank. Any wastewater remaining in the non -permitted waste pits should be properly removed (i.e. pumped back to the concrete septic for pump and haul removal) and no longer allowed to overflow or drain to waters of the State. The non -permitted waste pits should be cleaned out and backfilled to grade. Waste must not leave the kill -room septic Page 4 of 4 at any time other than being properly pumped and hauled. Any outlet of the kill -room septic tank must be permanently repaired. 2. Take actions necessary to begin pumping and hauling the industrial wastewater for proper treatment and disposal at a permitted facility as soon as possible. 3. DWR inspectors determined that the previous subsurface disposal system for the kill - room septic has been altered, is no longer intact or operable, and therefore unable to properly dispose of the industrial wastewater. It is the understanding of DWR that Davidson County Health Department is working with you to permit a permanent Pump and Haul for the industrial wastewater under the authority of the North Carolina Department of Health and Human Services. VI. Required Response Accordingly, you are directed to respond in writing within thirty (30) calendar days of receipt of this Notice. Your response should be sent to my attention at the letterhead address and must include specific plans and timeline for permanently addressing violations included herein. This Office is considering sending a recommendation for enforcement to the Director of the Division of Water Resources regarding these issues and any future/continued violations that may be encountered. This office requires that the violations, as detailed above, be abated immediately and properly resolved. Pursuant to G.S. 143-215.6A, these violations and any future violations are subject to a civil penalty assessment of up to a maximum of $25,000.00 per day for each violation. Incident Questions : The initial complaint investigation found that animal waste was being washed out of holding pens and flowing downslope. The waste was channelizing and flowing downslope towards a stream. The facility operator installed a berm below the barns to capture animal waste. A follow up visit resulted in two illegal waste pits being discovered and a failing septic tank originally installed to manage the wastewater produced from the kill room. The septic tank had a lid installed and was reportedly pumped on a regular basis. The tank collects wastewater from the kill room floor and a washdown area for the gut bins. The tank has a baffle in it. Kill -room wastewater (industrial wastewater) is piped from the tank to a junction box that had been dug out and the lid removed. There was a small trench that led to a pit. The purpose of this pit appeared to be capturing excess industrial wastewater during high flows. The industrial wastewater then left the junction box, was piped downslope by gravity using white PVC pipe, where a black corrugated pipe was attached to the end of the white PVC pipe. Industrial wastewater was leaving the white pipe and traveling directly downslope through overland flow and entering a marshy area. The industrial wastewater that was captured by the black pipe was being carried downslope by gravity to two unpermitted, unlined, earthen waste pits. Once the pipe ended an unlined, earthen, hand dug trench was carrying industrial wastewater into the first unpermitted waste pit, that was >5ft deep and 20-sq feet in area. Industrial wastewater was then flowing through another unlined, earthen trench to a larger, shallow lagoon —2ft deep and 40-sq ft in area. Industrial wastewater was overtopping the lagoon embankment and intermingling with surface waters. The discharge was then flowing under a fence, into a shallow trench in a pasture, and collecting before the discharge left the property. The operator had constructed a berm at the end of the pasture with the intent of stopping industrial wastewater from leaving the property. As a result, the facility operator had created a large area saturated by industrial wastewater. There was still evidence that during rainfall or high flow events industrial wastewater was leaving the property. DWR staff told the facility owner that no more industrial wastewater should be flowing to the unpermitted waste pits and the industrial wastewater contained in the unpermitted waste pits should properly be removed by pumping back up to the septic for removal. A follow up visit was conducted on 4/15/2021 with the property owner and the Davidson County Department of Environmental Health. The DEH representative confirmed that another septic tank existed and collects all domestic wastewater generated at the facility. The facility owner had removed the black corrugated pipe conveyance and covered the PVC pipe it connected to with sticks, brush, and a plastic bag. The junction box was also covered with a lid, but during the course of the visit the junction box became covered with industrial wastewater. It appeared that the hand dug trench carrying industrial wastewater from the black corrugated pipe to the lagoons had been filled with dirt and brush. There was a --1ft deep trench dug in the corner of the shallow unpermitted waste pit embankment with the purpose of emptying the lagoons.
