Johnson, Wcjoski, and Hamstead, Enclosed is a request for Nationwide Permit 929 for the Lake Norman -Perth Road site on 39 acres located on Perth Road and River Highway in Mooresville, NC. The site is a proposed residential development and consists of three streams and three wetlands. A Preliminary Jurisdictional Determination Request was submitted on July 16, 2021 for the proposed project. Please refer to the Jurisdictional Determination Information section for information on onsite surface waters. As shown on the attached exhibits, the proposed project will include permanent impacts to two streams and one wetland for fill due to grading and a road crossing. Rindner, PLLC. design, and location/orientation of the proposed lots and access routes. Total permanent impacts proposed include 205 linear feet of stream impact (Streams A and B) and 0.019 acres of wetland impacts (Wetland Q. Existing grades and required roadway connections have limited the potential of reducing surfacewater impacts further without sacrificing stability and safety of the site. As noted in the Design Alternatives and engineer correspondence sections, limiting stream impacts through the use of 34 foot headwalls would present a safety concern as the sidewalk and roadway would be adjacent to this wall. Additional grading has been incorporated in the proposed to limit the safety concerns at this crossing. Existing drainage and grades, including the required roadway connections, limited the practical locations for BMP installation and further reduced the potential for avoidance of surface water impacts due to these design constraints and safety requirements. Stacking requirements and the associated offset from the entrance limited the potential of moving the BMP further upslope due to the required road alignment. Additionally, impacts to the proposed wetland are associated with the fill slope of the dam as well as fill required for appropriate lateral grades which support the proposed surrounding residential structures. Avoidance of the wetland area would have required large retaining walls and introduced structural instability to the slope of the dam. Please refer to the Engineer Correspondence section and the Avoidance and Minimization narrative for additional information and communication regarding the requirements and encumbrances considered in determining the proposed roadway connections. The applicant has demonstrated avoidance and minimization efforts in which 79% of the 0.09 acres of onsite wetlands and 86% of the 1,479 linear feet onsite streams will be avoided. Due to limited site impacts, no mitigation is proposed. Also enclosed is a copy of our Threatened/Endangered Species Evaluation and concurrence letter from the Fish & Wildlife Service for the site. No listed species were identified within the project area and we believe that there will be no effect on listed species, or their critical habitat as designated under Section 7 of the Endangered Species Act. Please refer to the Threatened and Endangered Species Evaluation Section for additional details on the terrestrial species evaluation and FWS concurrence. Spectrum Property Perth Road - Threatened /Endangered /Protected Species Evaluation SPECIES DESCRIPTIONS: One plant species with federal protection is listed as potentially occurring in Iredell County: Dwarf -flowered Heartleaf (Hexastylis nanif/ora), listed as Threatened, grows in acidic soils along bluffs and adjacent slopes, in boggy areas next to streams and creek heads, and along the slopes of nearby hillsides and ravines. Two animal species with federal protection are listed as potentially occurring in Iredell County: Bog Turtle (Clemmys muhlenburgii), listed as Threatened, occurs in bogs, fens, marshy meadows and other wetlands with emergent vegetation. Northern Long-eared Bat (Myotis septentrionalis), listed as Federally Threatened. During summer, northern long-eared bats roost singly or in colonies underneath bark, in cavities, or in crevices of both live and dead trees. Males and non -reproductive females may also roost in cooler places, like caves and mines. It has also been found, rarely, roosting in structures like barns and sheds. Northern long-eared bats spend winter hibernating in caves and mines, called hibernacula. RESULTS: The site features an old farm homesite with barns, shed and outbuildings, and is primarily covered with young, successional mixed pines and hardwoods and narrow stream buffer of an unnamed tributary to Lake Norman. There are typical turf grass roadside shoulders and ditches along River Hwy 150 and the old connector road. There are a few large trees around the old home and farm buildings, but the rest of the site is covered in young pines and hardwoods from old field succession and timber harvesting. Tree species occurring are Short -leaf Pine (Pinus echinata), Virginia Pine (P. virginiana), Loblolly Pine (P. taeda), Sweetgum (Liquidambar styraciflua), Tulip Poplar (Liriodendron tulipifera), White Oak (Quercus alba), Red Oak (Q. rubra), Southern Red Oak (Q. falcata), Mockernut Hickory (Carya tomentosa), Red Maple (Acer rubra), and Black Gum (Nyssa sylvatica), Persimmon (Diospyros virginiana). Shrubs include Russian Olive (Elaeagnus umbellate) and Chinese Privet (Ligustrum sinense). Vines present are Japanese Honeysuckle (Lonicera japonica), Virginia Creeper (Parthenocissus quinquefolia), Muscadine (Vitis rotundifolia), and Poison Ivy (Toxicodendron radicans). Sparse herbs present include Christmas Fern (Polystichum acrostichoides), Ebony Spleenwort (Asplenium platyneuron), and Japanese Stilt Grass (Microstegium vimineum). WEPG concludes Dwarf Flowered Heartleaf (Hexastylis nanif/ora) does not occur on the site. Due to extensive disturbance on site from past and present land management practices, there is no suitable habitat for Bog Turtles (Clemmys muhlenbergii) on site, and no bog Turtles were observed. WEPG concludes Bog Turtle (Clemmys muhlenbergii) does not occur on the site. • Comparing this site location to the USFWS Asheville office's website (http-//www.fws.gov/asheville/htm Is/project_review/N LE B_in_WNC. htm I) WEPG concludes the site meets the "exempt" criteria which requires no further action under section 7 of the Endangered Species Act for the Northern Long-eared Bat. RECOMMENDATIONS: Based on the site investigation and the review of available data, WEPG did not identify any protected species occurring on the subject property. We submit the following comments in accordance with the provisions of the Fish and Wildlife Coordination Act, as amended (16 U.S.C. 661-667e); the National Environmental Policy Act (42 U.S.C. §4321 etseq.); and section 7 of the Endangered Species Act of 1973, as amended (16 U.S.C. 1531-1543) (Act). Project Description According to the information provided, the Applicant proposes to construct a mixed use development on approximately 31 acres in Mooresville, North Carolina and anticipates that authorization from the U.S. Army Corps of Engineers will be required. Onsite habitats are dominated by successional mixed forest. Surrounding land cover is composed of mixed forest, and residential developments along Lake Norman. Federally Listed Endangered and Threatened Species Suitable summer roosting habitat may be present in the project area for the federally threatened northern long-eared bat (*otis septentrionalis). However, the final 4(d) rule (effective as of February 16, 2016), exempts incidental take of northern long-eared bat associated with activities that occur greater than 0.25 miles from a known hibernation site, and greater than 150 feet from a known, occupied maternity roost during the pup season (June 1 — July 31). Based on the information provided, the project (which may or may not require tree clearing) would occur at a location where any incidental take that may result from associated activities is exempt under the 4(d) rule. Although not required, we encourage the Applicant to avoid any associated tree clearing activities during this animal's maternity roosting season from May 15 — August 15. The information provided indicates that suitable habitat is not present onsite for any other federally protected species. In accordance with the Act, it is the responsibility of the appropriate federal agency or its designated representative to review its activities or programs and to identify any such activities or programs that may affect endangered or threatened species or their habitats. if it is determined that the proposed activity may adversely affect any species federally listed as endangered or threatened, formal consultation with this office must be initiated. Erosion and Sediment Control Measures to control sediment and erosion should be installed before any ground -disturbing activities occur. Grading and backfilling should be minimized, and existing native vegetation should be retained (if possible) to maintain riparian cover for fish and wildlife. Disturbed areas should be revegetated with native vegetation as soon as the project is completed. Ground disturbance should be limited to what will be stabilized quickly, preferably by the end of the workday. Natural fiber matting (coir) should be used for erosion control as synthetic netting can trap animals and persist in the environment beyond its intended purpose. Low Impact Development The Service is concerned about the potential stormwater-mediated impacts to streams and wetlands onsite. Where detention ponds are used, storm -water outlets should drain through a vegetated area prior to reaching any natural stream or wetland area. Detention structures should be designed to allow for the slow discharge of storm water, attenuating the potential adverse effects of storm -water surges; thermal spikes; and sediment, nutrient, and chemical discharges. Since the purpose of storm -water -control is to protect streams and wetlands, no storm -water -control measures or best management practices should be installed within any stream (perennial or intermittent) or wetland. We recommend that retention ponds be located at least 750 feet from small wetlands to minimize hydrologic disturbance and ecological function. Webb & Associates No. 21-649-157 Dear Mr. Caldwell: BACKGROUND During October 2021, R.S. Webb & Associates (RSWA) conducted a cultural resources literature review for Spectrum Companies' Perth Road development tract in the Doolie Community, Iredell County, North Carolina. The project area is located north of the intersection of Perth Road and State Route (SR) 150 (River Highway), also known as the Doolie Community, in southwestern Iredell County (Figure 1). For this study, a cultural resource is defined as a discrete area of human activity that is at least 50 years old. Cultural resources include, but are not limited to, archeological sites, historic structures, military earthworks, mines/mining features, historic cemeteries, and historic landscape features. The purpose of the current study was to determine if previously recorded cultural resources are located within the project area. METHODOLOGY Through the State Historic Preservation Office's (SHPO) HPOWEB database, information was reviewed regarding National Register of Historic Places (NRHP) properties, Iredell County surveyed -only historic resources, local landmarks, state study -list sites and historic resources determined by the SHPO to be eligible for the NRHP. The North Carolina Office of State Archaeology (OSA) provided RSWA with information via email regarding archeological sites within 1.0 kilometer (km) of the project area. This information included site forms, location maps and partial or full reports. Historic county maps were examined online through North Carolina Maps, a collaboration of the University of North Carolina, the State Archives of North Carolina, and the Outer Banks History Center. Historic aerial photography and additional historic maps were accessed through Historicaerials.com, Earthexplorer.usgs.gov, Legacy.lib.utexas.edu/maps/, and/or Alabamamaps.ua. edu. Findings - Cultural Resources Literature Review, Perth Road Tract, Iredell County, North Carolina Page 2 October 22, 2021 The following primary sources were found to be useful in searching for historic resources within and adjacent to the project area: • 1891 Official Military Atlas of the Civil War (Davis et al. reprinted, 1983) • 1893 USGS Statesville Sheet 30-minute quadrangle • 1910 USDA Statesville Sheet Soil Map • 1917 Kenney Map of Iredell County • 1922 Post Office Department Map of Iredell County • 1938 and 1968 State Highway and Public Works Commission Maps of Iredell County • 1951, 1965, 1983 aerial photographs of Iredell County • 1970 USGS Lake Norman North, NC 7.5-minute quadrangle • 1985-2018 Google Earth aerial photography. RESULTS Previous Archeological Investigations: OSA records indicate one previous cultural resources investigation project within 1.0 km of the study tract (Figure 1). One of 37 selected Lake Norman lakeshore survey areas was located approximately 500 m northwest of the current study tract (Tibbetts and Southerlin 2003) (Figure 1). Previous Architecturallnvestigations: According to SHPO personnel, the North Carolina HPOWEB database is the definitive source of all architectural survey information for Iredell County. National Register of Historic Places: There are no NRHP-listed historic properties located within 1.0 km of the current study tract. The NRHP-listed Johnson -Neel House is located south of SR 150 (River Highway) approximately 1.8 km southeast of the study tract. Iredell County Historic Resources: The HPOWEB database indicates no study -list sites, local landmarks, or properties determined eligible for the NRHP within 1.0 km of the study tract. The database shows 17 surveyed -only historic properties within 1.0 km of the study tract, all located along or near the SR 150 corridor. There are two surveyed -only historic resources within the study tract; these properties include a circa 1959 house/office building (Resource No. 1630) and a circa 1875 house (Resource No. 1631). Surveyed -only resources are also located south of SR 150 at the study tract (Resource No. 1090/Berea Church and Cemetery) and south of SR 150, approximately 200 m southeast of the study tract (Resource No. 1632) (Figure 1). The HPOWEB database indicates that all of these recorded resources were evaluated by SHPO in 2014 and all were found to be ineligible for the NRHP. Recorded Archeological Sites: OSA archeological site records identify two recorded archeological sites within 1.0 km of the project area, neither of which is within 600 m of the study tract. The closest recorded site, 31ID328, is a mixed prehistoric and historic surface artifact scatter 660 m northwest of the project area that has not been assessed for NRHP eligibility status (Figure 1). Revolutionary War Actions/Features: There was one reported Revolutionary War military engagement in Iredell County; no such events occurred in Catawba County (west), and two engagements took place in Lincoln County (southwest). The closest Revolutionary War military event was at Tarrant's Tavern (February 1, 1781), located about 7 km southeast of the project area. This tavern served as a rendevous point for numerous Patriot militia companies that scattered in the Findings - Cultural Resources Literature Review, Perth Road Tract, Iredell County, North Carolina Page 3 October 22, 2021 wake of recent actions to the south and southwest. The gathering militia were dispersed again by attacking British cavalry and the tavern was destroyed the following day by British infantry as they marched northeast toward Salisbury (Rowan County) (Lewis 2021). Civil War Actions/Features: A review of The Official Military Atlas of the Civil War (Davis et al. 1983) indicates no major battle or campaigns located in Iredell County. Broad -scale maps ofmilitary movements across the southeastern United States indicate extensive cavalry operations north, east and west of the study tract; none are depicted within 8 km of the project area (Davis et al. 1983). Historic Cemeteries: Reviewed USGS topographic maps show one cemetery mapped within 1.0 km of the project area. Berea Church and Cemetery are located south of SR 150, approximately 80 m south-southwest of the project area (Figure 1). Structures on Historic Maps and Aerial Photographs: The 1893 USGS map and the 1910 soil map show that Perth Road from the north reached the SR 150 corridor further east than the current intersection; a single building located north of SR 150 (and none south of the road near the project area) as the road began a northward arc, apparently at or near the study tract, with the label "Doolie". The 1917 Kenney Map, however, shows the Perth Road/SR 150 intersection at the project area with an offest (east) "private road" leading further southward. This map shows "owners' residences" in all four quadrants of the intersection with a church and school located southwest (in the arc of SR 150). The name J.S. Fischer was placed northeast of the intersection of Perth Road and SR 150 (Figure 1) and the only nearby Doolie name was placed south of SR 150, more than 1.6 km west of the project area. The county highway from 1938 shows the westward bend of Perth Road as it approached SR 150 from the north via the study tract, the offset road leading further south (aka Doolie Road), and the label "Dooleys" located above the northern arc of SR 150, west of the study tract (Figure 1). The 193 8 map shows a store/business located northwest of the intersection (in the study tract), a building located north of SR 150 at Doolie Road (possibly in the study tract), a church/cemetery located south of SR 150, and a dwelling located west of Perth Road at or near the northeastern study tract corner boundary (Figure 1). The 1968 highway map illustrates additional residential development along the western side of Perth Road, from the project area northward, but it suggests little other changes to the distribution of roads and buildings. The 1970 USGS map shows the Perth Road/SR 150 intersection with Doolie Road offset to the east and running southward from the project area. Two dwellings appeared northwest of the road intersection (in the study tract) and a dwelling with an outbuilding is shown northeast of the intersection (also in the study tract). A church/cemetery and a dwelling were present south of SR 150 at the study tract. Buildings also appeared along the SR 150 corridor west of the project area and east of Doolie Road (southeast of the project area); no buildings appeared along Perth Road near the northern project area boundary as depicted on the 1938 and 1968 highway maps (Figure 1). Aerial photographs from 1951 show the disjoined road intersection at the project area with groups of several buildings located on either side of Perth Road in the study tract; a single building also appeared west of Perth Road, at or near the northern study tract boundary (Figure 1). The eastern and southern parts of the study tract appeared in either cultivation, pasture, or new -growth woods, while the central -northwestern section was in mature woods. Aerial photographs dating to 1965 Findings - Cultural Resources Literature Review, Perth Road Tract, Iredell County, North Carolina Page 4 October 22, 2021 show no change in the southern part of the study tract; a building previously noted at the northern study tract boundary was absent by 1965. Aerials taken in 1983 indicate no change to the distribution of buildings in the study tract, but only areas east of Perth Road were still under cultivation by that time. Aerial photographs dating to 1998 show buildings still present in the southern part of the project area with increased woods west of Perth Road and cultivation or pasture located east of the road. Aerial photographs from 2006 indicate a new road course along the eastern study tract boundary and a conventional four-way intersection was present at the crossing of Perth Road (north), SR 150 (east and west) and Doolie Road (south) (Figure 1). This construction isolated the building complex east of the road (in the project area) from historically associated agricultural land to the east and northeast, where modern residential/commercial development was initiated by 2006. CONCLUSIONS There are no NRHP-listed properties, determined -eligible properties, study -listed resources, designated local landmarks, cemeteries, or recorded archeological sites located within the study tract. There are, however, two surveyed -only historic resources are located within the study tract (Resource Nos. 1630 and 1631). Two additional resources are located within 200 m of the study tract south of SR 150 (Resource No. 1090/Berea Church and Cemetery and Resource No. 1632). All of these properties have been evaluated by the SHPO in 2014 and all determined to be ineligible for the NRHP. Review of historic maps and aerials indicates that one residence could have been present in the study tract by 1893 as part of the Doolie crossroads community, which included the project area.
