The intent of this correspondence is to provide notice of proposed impacts to a jurisdictional tributary. The drainage features on the site are man -made agricultural ditches. They are not mapped on USGS or the printed version of the USDA Soil Survey. During our site visit with the U.S. Army Corps of Engineers ( USACE), an ordinary high water mark was observed. According to the jurisdictional determination (SAW - 2012 - 01454), the USACE determined the agricultural ditches are jurisdictional tributaries (a.k.a. Waters of the U.S.). The drainage features are not streams (correspondence from NCDENR -DWR attached). Therefore, the proposed impact calculations are referenced by area, not linear feet. Based on our review of the site plans, there are three proposed road crossings through the jurisdictional tributary on the central portion of the site. Three road crossings will impact 0.009 acres of the jurisdictional tributary on the central portion of the site. A total of 6.0 cubic yards of fill material will be placed below the plane of the ordinary high water mark within the drainage feature. According to the index of Nationwide Permits, a permittee must submit a pre - construction notification to the district engineer prior to commencing activity if the placement of fill material exceeds 10 cubic yards below the plane of the ordinary high water mark, or if the fill material is placed in a special aquatic site, including wetlands. For this project, amount of fill material is less than 10 cubic yards and it will not be placed in a special aquatic site or a wetland. Therefore, the proposed project appears to meet the requirements of Nationwide Permit #18 and the associated conditions set forth by the NCDENR -DWR. During the initial assessment, the site was approximately 60 acres. ECS identified five jurisdictional tributaries traversing the site and a jurisdictional wetland area on the northwest portion of the site. Our client, Strata Solar Development, LLC, reduced the project footprint to 40 acres and excluded two jurisdictional tributaries and the jurisdictional wetland area from the project footprint. 1b. The proposed road crossings are located at three locations along jurisdictional tributary on the central portion of the site These road crossing are critical to provide access during construction and for maintenance of the solar farm after construction Other wetland impacts were avoided. 2. According to the drawings, the total discharge of fill material below the plane of ordinary high water will be 6 cubic yards. As proposed, the project is authorized under Nationwide Permit 18 and does not require the submittal of a PCN form to the USACE. The subject site is located east of the residential dwelling located at 3850 NC Highway 17 in Emul, Craven County, North Carolina. Based on the jurisdictional determination (SAW - 2012 - 01454) issued on March 6, 2013, there are three jurisdictional tributaries traversing the site, and a relatively permanent water (RPW) along the northern boundary of the site. It is our understanding the USACE has determined these features to be Waters of the U.S. The proposed solar farm includes the placement of three (3) 46 -foot long culverts within the jurisdictional tributary on the central portion of the site. The placement of said culverts will result in 414 square feet of impacts to Waters of the U.S. The volume of material below the ordinary high water mark will be 6.0 cubic yards. Plan view and cross section site plans have been provided for your review. Based on our telephone conversation on October 9, 2013, the proposed activity is permissible under Nationwide Permit # 14. According to USACE requirements, pre - construction notification is not required for a NW -14 if impacts to Waters of the U.S. are less than 1/10 acre and there are no discharges to special aquatic sites. Amy, I am working on another site located east of 3850 Highway 17, south of Atkins in Craven County (lattlong, 35 2087 E, 77 0566 N) The site is currently used for agricultural purposes The current project Involves a proposed solar farm There are series of non jurisdictional ditches and jurisdictional tributaries (i e ditches) oriented north to south, and a RPW along the northern property of the site (see attached figures). Each of the features are man -made. Based on a review of the USGS mapping and Soil Survey, there is no swale, valley or blue line feature that would represent a stream The site appears to be located on an interstream divide. ECS did not complete a Stream Identification Form for this site. Although the features are jurisdictional according to USACE requirements, the State buffer requirements do not appear to apply to the site. Therefore, if you have projects that occur within the Raleigh Field Office's area of responsibility (see attached county list), you no longer need to contact the Raleigh Field Office for a list of federally - protected species. Our web page contains a complete and frequently updated list of all endangered and threatened species protected by the provisions of the Endangered Species Act of 1973, as amended (16 U.S.C. 1531 et seq.)(Act), and a list of federal species of concern' that are known to occur in each county in North Carolina. Based on the information provided and other information available, it appears that the proposed action is not likely to adversely affect any federally - listed endangered or threatened species, their formally designated critical habitat, or species currently proposed for listing under the Act at these sites. We believe that the requirements of section 7(a)(2) of the Act have been satisfied for your project. Please remember that obligations under section 7 consultation must be reconsidered if. (1) new information reveals impacts of this identified action that may affect listed species or critical habitat in a manner not previously considered; (2) this action is subsequently modified in a manner that was not considered in this review; or, (3) a new species is listed or critical habitat determined that may be affected by the identified action. However, the Service is concerned about the potential impacts the proposed action might have on aquatic species. Aquatic resources are highly susceptible to sedimentation. Therefore, we recommend that all practicable measures be taken to avoid adverse impacts to aquatic species, including implementing directional boring methods and stringent sediment and erosion control measures. An erosion and sedimentation control plan should be submitted to and approved by the North Carolina Division of Land Resources, Land Quality Section prior to construction. Erosion and sedimentation controls should be installed and maintained between the construction site and any nearby down - gradient surface waters. In addition, we recommend maintaining natural, vegetated buffers on all streams and creeks adjacent to the project site. The North Carolina Wildlife Resources Commission has developed a Guidance Memorandum (a copy can be found on our website at (http: /hvww.fws.gov /raleigh) to address and mitigate secondary and cumulative impacts to aquatic and terrestrial wildlife resources and water quality.
