CHARLOTTE-MECKLENBURG UTILITIES November 18, 2005 Mr. Ronald Hall J&B Development and Management, Inc. 9179 Davidson Highway Concord, NC 28027 SUBJECT: WATER AND SANITARY SEWER FLOW ACCEPTANCE PARK SOUTH STATION TAX PARCEL #173-061-01 C-MU# 600-05-582 Dear Mr. Hall: In response to your request, a flow acceptance study of the subject site has been completed and it has been determined that the discharge from this project does not transmit through areas of SSO concern by the NCDENR, Division of Water Quality. Please see attached map. Upon completion and acceptance of all necessary sewer lines, Charlotte -Mecklenburg Utilities (C-MU) agrees to accept the gravity sewage flow of 161,690 gallons per day (851 residential units x 190 gpdfunit) from this project, by means of the existing 42-inch sewer main, for transmission to the McAlpine Creek Wastewater Treatment Plant; NPDES permit number NC0024970, for treatment. This acceptance of flow is based on the existing capacity of the designated publicly owned treatments works; which is contingent upon final acceptance and issuance of a discharge permit from the appropriate focal, State, or Federal Agency, whichever might have control. Upon completion and acceptance of all necessary water mains, C-MU agrees to furnish water to the subject project. The water quality to the subject project is regulated by the State Drinking Water Act Amendments of 1986 and The Water Supply Management Plan, dated January 2000, (WSMP # 00- 00251 & PWS ID # 0160010), on file with the Public Water Supply Section of NCDENR. However, C-MU cannot guarantee a constant pressure or quality of flow. This agreement is also contingent upon approval by the Division of Environment, Health, and Natural Resources. C-MU does not expect any of the above conditions to preclude water or sewer service to the subject site. However, the applicant should understand that due to the involvement of other agencies and continuing growth of the water and sewer system, the ability to provide service for future projects cannot be guaranteed nor reserved. Connection to the C-MU system is accepted on a first come, first served basis. If you have any questions, please contact me at (704) 391-5129. At the developer's request, lots were removed from Phase 3 (WQ0031682) and added to Phase 1. of the project. The new sewer configuration is depicted on sheet 36A of the attached drawing. The total number of lots fir the entire project (Phase 1, Phase 2 and Phase 3) only increased by one lot and the total linear feet of sewer in the project will remain approximately the same. Due to the changes in lots for each phase, 1 sent a letter (see attached) to Charlotte - Mecklenburg Utilities on October 17, 2007 requesting new flow acceptance letters for each phase. Once I receive the new flow acceptance letters, 1 will fi rward a copy to your office. Please feel free to contact me (704) 782-7800 if you need additional information or want to discuss this issue further. 1 appreciate your help in this matter. Sincerely, R. Changes occurred in the project's sanitary sewer system which affected the number of units allocated to each phase. I discussed the changes with Ms. Dee Browder at the NCDENR Mooresville Regional Office and she advised me to obtain new flow acceptance letters accurately reflecting the number of units in each phase. The adjusted number of units per phase is as follows: Phase 1 = 249 units (originally 216) Phase 2 = 183 units (originally 160) Phase 3 = 420 units (originally 475) Please feel free to contact me (704) 782-7800 if you need additional information or want to discuss this issue further.
