RE: KENNEDY PROPERTY, MOSS LAKE, 49 HERITAGE LANE, SHELBY, N C
Dear Ms. Higgins,
13-090(2
€CE
OCT 152013
Enclosed please find revised plans for the Kennedy Property located on Moss Lake, Cleveland County, N C. Revisions have
been made based on comments from your Request For Additional Information letter to Kennedy dated September 17, 2013.
You requested the information below:
1. Plans have been modified to result in an impact of approximately 360 linear feet. Two sections of modular block seawall
impact 338 linear feet. Riprap placed to protect two existing trees will makeup the balance of the impact. The rest of the
unprotected shoreline will remain slightly eroded sandy "beach ".
2. Photos are included to to show the sections of shoreline that are to be addressed.
3. The application has been modified to reflect the total impact of both seawall and riprap. Riprap will be placed to address
eroded conditions around the exposed tree roots. Less than 200 square feet of riprap will be used. Half will be below normal pool
elevation. Half will be above.
I trust that this information addresses the issues that resulted in the original application being put on -hold.
Please advise.

Subject: REQUEST FOR ADDITIONAL INFORMATION
Moss Lake, 49 Heritage Lane, Shelby NC
Dear Mr. Kennedy:
On August 26, 2013, the Division of Water Resources (Division) received your application dated August 20,
2013, requesting a 401 Water Quality Certification from the Division for your project. The Division has
determined that your application is incomplete and cannot be processed. The application Is on -hold until all
of the following information is received:
1. The application and plan propose 648 linear feet of shoreline stabilization impacts. To be covered
under a General Permit 198200030 from the US Army Corps of Engineers and General Water Quality
Certification # 3898 from the Division of Water Resources, the impacts must no more than 500 linear
feet. Please revise and resubmit your application and plan. If you wish to propose 648 linear feet of
impact, you must apply for an Individual Permit from the USACE and an individual Water Quality
Certification from the Division.
2. To be covered under a Water Quality Certification, you must provide that shoreline stabilization is
necessary to protect your property. The current application says that there is slight erosion on the
shoreline. Please provide evidence of erosion or information that shoreline stabilization is needed.
3. The plan indicates that some riprap will be placed around existing trees at breaks in the proposed wall.
Include these impact amounts above and below the normal pool in your proposal.
Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for
the proper consideration of the application. If all of the requested information is not received in writing within
