Dear Mr. Brantley:
Please accept this letter as the Town of Troy's response to your letter received in
this office on September 20, 2021, in regards to the two (2) separate NOV's
detailed in NOV-2021-LR-0048.
The first Notice of Violation detailed in NOV 2021-LR-0048 pertained the
submission of the September 2020 DMR. The daily log book has an entry on 10-
26-21 that states "Finished eDMR for September". The town's ORC for the
wastewater treatment facility, Mr. Bryan Bowles, normally enters this when the
DMR has been finished to have another record of it. It's possible that when Mr.
Bowles certified the report, it didn't take. I haven't been able to determine a
definite cause. However, as evidence, I am attaching a screen shot of the log
book entry.
The second Notice of Violation detailed in NOV 2021-LR-0048 pertained to the
November 2020 DMR being submitted 23 days late. With regards to the DMR
being late, the DMR was certified on 12-22-20. Mr. Bowles had been waiting
until the following week due to the Christmas Holiday to have the public works
director submit the report. However, on the evening of 12-29-20 Mr. Bowles
began showing symptoms of Covid 19 and didn't return to work until 1-11-21. It
was not noticed that the November DMR had not been submitted until Mr.
Bowles logged into the system to prepare the DMR for December that he
realized that the November report had not been submitted.

As I have alluded to in previous correspondences with you and your office in the
past, the town respects the mandates and the requirements that are associated
with operating this facility and have taken great strides to ensure that we have as
well as maintained system as possible and are confident that we have the best
people in place to assure that the facility is operating at the highest levels. While
the operations of the town's wastewater facility are of the highest importance, just
as important is the town's responsibility of ensuring timely and accurate
reporting. As is evident by the accompanying documentation and the fact that
illness did play a factor, the town takes its roles and responsibilities of reporting
seriously, however, these events have led to the town to reemphasize to all staff
that better communication and follow-through is needed to ensure compliance.
