I understand the line relocation is to be completed without a 404 impact, therefore a
modification for Section AA is not needed before it occurs. With that in mind, I believe
we can concur with Dave’s email below.

What you have reported is sufficient to document the occurrence. I cannot think of anything additional we
would need other than an estimated area impacted and a follow-up email once the work you requested is
completed. It’s commendable that NCDOT tracks occurrences of these types and makes notification. Of
course, if the Corps requires or needs anything further other than what we have requested, please forward
that information along.

Monte and Dave,
Monte, I’m emailing you since Andy is on vacation. We currently have Duke clearing trees and relocating lines on U-
2579AA and AB in preparation for the upcoming projects. We have a final design permit mod issued for AB. We do not
have a final design permit mod applied for or issued for AA.
Duke (or their contractor) cleared approximately 10 trees that were deemed ‘danger trees’ in the wetland at the
location circled on the attached plan sheet (permit site 5). Wood chips were placed in the wetland. These trees were
either dead or damaged, and they were concerned that they would fall onto the line that is being relocated. I have
attached a couple pictures and marked the photo point on the plan sheet. In the photo, our inspector is standing at the

edge of the wetland and looking towards it. The existing road slope is to the right of the photos for reference. The
wetland was staked and flagged. Clearing this area was not discussed with DOT beforehand. We have DOT inspectors
on site which is how we found the clearing after it was done. We have requested that the flagging be more visible or
that they utilize the orange fencing. We have also directed them to remove the wood chips and seed the area with
native riparian seed mix.
We had a previous incident on the same project a few months ago. We reported that incident to Dave and Andy. After
that incident, our inspectors have ensured that the wetlands were flagged ahead of clearing, and we had discussions
regarding proper wetland protocols with the Duke and their clearing contractor.
Should we add hand clearing to this area on our permit drawings to account for the additional clearing? Is there
anything else you would like us to do? Our apologies for the second occurrence.
