Dear Mr. Mazzarone:
Effective August 1, 2013 the State Stormwater program has been transferred from the Division of Water
Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous
references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are
modified. Please note that this permit will now reference DEMLR as the Division responsible for
issuance of the permit.
On August 5, 2009, the Governor signed Session Law 2009-406. This law impacted any development
approval issued by the former Division of Water Quality under Article 21 of Chapter 143 of the General
Statutes, which was current and valid at any point between January 1, 2008, and December 31, 2010. The
law extended the effective period of any stormwater permit that was set to expire during this time frame
to three (3) years from its current expiration date. On August 2, 2010, the Governor signed Session Law
2010-177, which granted an extra year for a total of four (4) years extension. Accordingly, this permit
shall now be effective from the date of issuance until February 2, 2021, which includes all available
extensions.
On July 29, 2019, the Wilmington Regional Office of the Division of Energy, Mineral and Land
Resources received a complete minor modification application for changes to the approved plans for
Stormwater Management Permit Number SW8 070103. It has been determined that the nature of the
proposed change meets the definition of a minor modification in that it does not result in an increase in
the size of the permitted stormwater control measure (SCM) and does not increase the amount of built -
upon area. Please refer to Attachment C for a detailed description of the current proposed minor
modification. We are forwarding you an approved copy of the modified plans for your files. Please
replace the old approved plan sheets with the new ones. Please replace the previously issued permit with
the revised permit, dated July 30, 2019, attached. This revised permit does not impose new or different
terms; it merely restates some of the previous terms to provide you with a better understanding of your
obligations under the permit.
Please be aware that all terms and conditions of the permit issued on February 2, 2007 and modified as
attached, remain in full force and effect. Please also understand that the approval of this minor
modification to the subject State Stormwater Permit is done on a case -by -case basis. Any other changes
to this project must be approved through this Office prior to construction. The approval of this minor
modification does not preclude the permittee from complying with all other applicable statutes, rules,
regulations or ordinances which may have jurisdiction over the proposed activity, and obtaining a permit
or approval prior to construction.

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North
Carolina as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

FOR THE
construction, operation and maintenance of one (1) wet detention pond in compliance with
the provisions of 15A NCAC 2H .1000 (hereafter referred to as the "stormwater rules') and
the approved stormwater management plans and specifications and other supporting data as
attached and on file with and approved by the Division of Energy, Mineral and Land
Resources (the "Division" or "DEMLR") and considered an enforceable part of this permit.
This permit shall be effective from the date of issuance until February 2, 2021, and shall be
subject to the following specified conditions and limitations:
I. DESIGN STANDARDS
1. This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data. The maximum amount of built -
upon area allowed for the entire project is 323,760 square feet.
2. This stormwater system has been approved for the management of stormwater runoff
as described in Section 1.6 of this permit. The stormwater control has been designed
to handle the runoff from 323,760 square feet of impervious area.
3. The tract will be limited to the amount of built -upon area indicated on page 3 of this
permit, and per approved plans. The built -upon area for the future development is
limited to 59,700 square feet.
4. All stormwater collection and treatment systems must be located in either dedicated
common areas or recorded easements. The final plats for the project will be recorded
showing all such required easements, in accordance with the approved plans.
5. The runoff from all built -upon area within the permitted drainage area of this project
must be directed into the permitted stormwater control system.
6. A vegetated filter strip is not required for this pond as it has been designed for a 90%
total suspended solids removal efficiency.

7. All runoff being directed into wetlands shall flow into and through those wetlands at a
non -erosive velocity.

II. SCHEDULE OF COMPLIANCE
1. The stormwater management system shall be constructed in its entirety, vegetated
and operational for its intended use prior to the construction of any built -upon surface.
2. During construction, erosion shall be kept to a minimum and any eroded areas of the
system will be repaired immediately.
3. The permittee shall at all time provide the operation and maintenance necessary to
assure the permitted stormwater system functions at the design condition. The
approved Operation and Maintenance Plan must be followed in its entirety and
maintenance must occur at the scheduled intervals including, but not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and re -vegetation of slopes and the vegetated filter.
d. Immediate repair of eroded areas.
e. Maintenance of all slopes in accordance with approved plans and
specifications.
f. Debris removal and unclogging of outlet structure, orifice device, flow spreader,
catch basins and piping.
g. Access to the outlet structure must be available at all times.
h. Maintenance of level spreader.
4. Records of maintenance activities must be kept and made available upon request to
authorized Division personnel. The records will indicate the date, activity, name of
person performing the work and what actions were taken.

5. Decorative spray fountains will be allowed in the stormwater treatment system, subject
to the following criteria:
a. The fountain must draw its water from less than 2' below the permanent pool
surface.
b. Separated units, where the nozzle, pump and intake are connected by tubing,
may be used only if they draw water from the surface in the deepest part of the
pond.
C. The falling water from the fountain must be centered in the pond, away from the
shoreline.
d. The maximum horsepower for a fountain in this pond is '/ HP horsepower.
6. The facilities shall be constructed, operated and maintained in accordance with the
provisions of this permit, the approved plans and specifications, and the supporting
documents attached to this permit and on file with the Division.
7. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and
prior to operation of this permitted facility, a certification must be received from an
appropriate designer for the system installed certifying that the permitted facility has
been installed in accordance with this permit, the approved plans and specifications,
and other supporting documentation. Any deviations from the approved plans and
specifications must be noted on the Certification. A modification may be required for
those deviations.
8. If the stormwater system was used as an Erosion Control device, it must be restored
to design condition prior to operation as a stormwater treatment device, and prior to
occupancy of the facility.
9. Access to the stormwater facilities shall be maintained via appropriate easements at
all times.
10. The permittee shall submit to the Director and shall have received approval for revised
plans, specifications, and calculations prior to construction, for any modification to the
approved plans, including, but not limited to, those listed below:
a. Any revision to any item shown on the approved plans, including the stormwater
management measures, built -upon area, details, etc.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area or to the
drainage area.
e. Further subdivision, acquisition, lease or sale of all or part of the project area.
The project area is defined as all property owned by the permittee, for which
Sedimentation and Erosion Control Plan approval or a CAMA Major permit was
sought.
f. Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan.
11. The permittee shall submit final site layout and grading plans for any permitted future
areas shown on the approved plans, prior to construction.
12. A copy of the approved plans and specifications shall be maintained on file by the
Permittee for a minimum of ten years from the date of the completion of construction.
13. The Director may notify the permittee when the permitted site does not meet one or
more of the minimum requirements of the permit. Within the time frame specified in
the notice, the permittee shall submit a written time schedule to the Director for
modifying the site to meet minimum requirements. The permittee shall provide copies
of revised plans and certification in writing to the Director that the changes have been
made.

III. GENERAL CONDITIONS
1. Any individual or entity found to be in noncompliance with the provisions of this
stormwater management permit or the requirements of the Stormwater rules is subject
to enforcement procedures as set forth in NCGS 143 Article 21.
2. Current Permittee Name or Address Changes: The permittee shall submit a
completed "Permit Information Update Application Form" (available on the Division
website) to the Division within 30 days to making any one or more of the following
changes:
a. A name change of the current permittee;
b. A name change of the project;
c. A mailing address change of the permittee;
3. Permit Transfer: This permit is not transferable to any person or entity except after
notice to and approval by the Director. The permittee shall submit a completed and
signed "Permit Transfer Application Form" (available on the Division website)
accompanied by the required fee and supporting documentation as listed on the form,
to the Division at least 60 days prior to any one or more of the following events:
a. The sale or conveyance of the project area in whole or in part, except in the
case of an individual lot sale that is made subject to the recorded deed
restrictions and protective covenants;
b. The assignment or conveyance of declarant rights to another individual or
entity;
c. The sale or conveyance of the common areas to a Homeowner's or Property
Owner's Association, subject to the requirements of NCGS 143-214.7(c2);
d. Dissolution of the partnership, corporate, or LLC entity, subject to NCGS 55-14-
05 or NCGS 57D-6-07 and 08;
e. Bankruptcy;
f. Foreclosure, subject to the requirements of Session Law 2013-121,
4. The permittee is responsible for compliance with all permit conditions until such time
as the Division approves the transfer request. Neither the sale of the project, in whole
or in part, nor the conveyance of common area to a third party constitutes an approved
transfer of the stormwater permit.
5. The issuance of this permit does not preclude the Permittee from complying with any
and all statutes, rules, regulations, or ordinances, which may be imposed by other
government agencies (local, state, and federal) having jurisdiction.
6. In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action, including
those as may be required by this Division, such as the construction of additional or
replacement stormwater management systems.
7. The permittee grants Division Staff permission to enter the property during normal
business hours for the purpose of inspecting all components of the permitted
stormwater management facility.
8. The permit issued shall continue in force and effect until the permittee files a request
with the Division for a permit modification, transfer, renewal, or rescission; however,
these actions do not stay any permit conditions.
9. Unless specified elsewhere, permanent seeding requirements for the stormwater
control must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual.
10. Approved plans and specifications for this project are incorporated by reference and
are enforceable parts of the permit.

11. A permit renewal request must be submitted at least 180 days prior to the expiration
date of this permit. The renewal request must include the appropriate application,
documentation and the processing fee as outlined in Title 15A NCAC 02H.1045(3).

3. All the built -upon area associated with the project is graded such that the runoff
drains to the system.
4. All roof drains are located such that the runoff is directed into the system.
5. The outlet/bypass structure elevations are per the approved plan.
6. The outlet structure is located per the approved plans.
7. Trash rack is provided on the outlet/bypass structure.
8. All slopes are grassed with permanent vegetation.
9. Vegetated slopes are no steeper than 3:1.
10. The inlets are located per the approved plans and do not cause short-circuiting
of the system.
11. The permitted amounts of surface area and/or volume have been provided.
12. Required drawdown devices are correctly sized per the approved plans.
13. All required design depths are provided.
14. All required parts of the system are provided, such as a vegetated shelf, and a
forebay.
15. The required system dimensions are provided per the approved plans.
16. The level spreader is provided per the approved plans.

Yep, you are right.
Bottom of pond is 8. Took that 7 off and added a 12.3 which is the bottom of the shelf elevation.

A couple of things:
1. The stage -storage table includes an incremental volume at an elevation of 8 implying that the bottom of the pond
is at an elevation of 7. The other application documents have the pond bottom starting at 8.
2. The surface area at the bottom of the veg. shelf (elev 12.4 ft) presented in the revised supplement is 1 sf off the
surface area associated with an elevation of 12 ft. Shouldn't the surface area at the bottom of the veg. shelf be
greater than the surface area at an elevation of 12 ft?
3. The surface area at the bottom of the pond presented in the revised supplement is associated with an elevation of
9 ft instead of either the 8 ft bottom elevation or the 9.5 ft top of sediment cleanout.
Can you double check the pond design?

I have had a chance to look through the submittal for the modification to this project. The only thing I couldn't find was
calcs or a stage storage table demonstrating how the permanent pool volume was determined. Can you either provide
calcs demonstrating how that was determined or point me to where I can find that in the submittal?

1. Project Description: The Project is proposed to be a residential town home
project 13.87 acre parcel with 78 units along Village Road. Infrastructure will include
construction of road, curb, gutter, storm drainage system, water, and sewer. The land
disturbing activity associated with the project will consist of clearing and grubbing of
vegetation, preservation of existing trees, grading of the site, and sediment and erosion
control measures such as a silt fence, gravel construction entrance, and the wet
detention pond will function as a sediment basin. The total area which will be disturbed
for this project is 12 acres. Total impervious area will be 6.56 AC for the proposed
construction of roads, sidewalks, and residential units. This project was previously
permitted in 2007 under SW8 070103. This minor modification is a result of slight
changes to the site layout but does not exceed the permitted impervious amount or the
surface area of the permanent pool.
2. Site Description: The project site is in Brunswick County, NC, located just off
of Village Road just north of intersection of Cleatwood Road. The property on which the
development will take place is currently in the Town of Leland corporate limits.
On site soils consist mainly of Leon and Baymeade soils. These soils are mainly loamy,
fine sands. Approximately 0.2 acres of wetlands are located on the parcel and have
been submitted for approval to the USACE. No wetlands will be impacted by the project
construction.
General slope of the site is from south to north towards the rear of the site.
Land use in the vicinity is residential, light commercial, and rural agricultural.
3. Adjacent Property: The areas adjacent to the project site are residential areas
and one commercial site that is currently used for mobile home rentals.
4. Drainage Considerations: There is an existing wetland area on the property
that is connected to Mill Branch Creek. There are ditches on site that feed into the
existing wetlands.
The road will be bounded with curb and gutter to curb and tied to a collection system of
piping. All of the collection system will be directed to a proposed wet detention basin
that is sized for the 1" runoff of impervious areas. The runoff from the buildings will be
directed into the collection system and sent to the basin. The basin is sized to provide
sufficient runoff capacity filtration for the entire allowable impervious area. The wet
detention basin is to provide detention of the pre -construction and post -construction
runoff difference and meet the 90% TSS water quality requirements. The amount of
retention was based on the Type III rainfall distribution of the 25 year, 24-hour storm.
Calculations are provided.
5. Erosion Control Considerations: The following erosion control measures are
used on this project:

1. Temporary Gravel Construction Entrance/Exit
To prevent sediment from leaving the site, temporary gravel construction
entrances should be installed where the access road enters the site and
instersects with Village. For dimensions and specifications, see construction
details.
2. Land Grading
The existing slope of the site is from south to north towards the front of the parcel.
Most of the disturbed areas on the site will sheet flow to the existing drainage
patterns on the site.
3. Silt Fence
Silt fence should be installed prior to clearing and grading activities. Silt fence
should be checked routinely. If needed, silt fence should be cleaned and replaced
if damaged. See Construction Detail for dimensions and specifications.
4. Wet Detention Basin
A wet detention basin will be constructed for long term runoff pollutant control, and
this area will be used as a sediment basin during construction. Outlet control
structure with rip rap energy dissapator will be installed when basin is excavated
and 30' sodded vegetated filter will be placed after the rip rap to provide additional
filtering prior to discharge into the existing wetland.
6. Construction Schedule:
1. Obtain plan approval and other applicable permits.
2. Hold pre -construction meeting at least one week prior to beginning construction.
3. Install temporary construction entrance/exits.
4. Before clearing and grading of the site, install silt fencing, detention basin with outlet
structure, and clean and replace as necessary.
5. Begin clearing and grading of the site.
6. Install storm piping.
7. Install new roadway.
8. Sod/Seed, mulch, and tack immediately to establish proper vegetation.
9. All erosion and sediment control practices will be inspected weekly and after each
rainfall event. Needed repairs will be made immediately.
10. After the entire covered area is stabilized, all temporary measures will be removed
and permanent vegetative repairs to be completed.

1. After complete stabilization of the entire covered area, top cover soils will be
roughened by making 1 "-2" deep grooves perpendicular to the slope.
2. Spread lime (agricultural limestone) evenly over the area at a rate of 1.5 tons/acre;
spread 10-10-10 fertilizer at a rate of 1000 lb/acre and incorporate into the top 6" of
soil.
3. Loosen surface prior to applying seed.
4. Broadcast seed at recommended rates.
5. Rake seed into the soil and lightly pack to establish good contact.
6. Mulch with 4000 lb/acre grain straw or equivalent and anchor by weighted farm disc
set nearly straight or other mulch anchoring tool.
7. Mow as needed and refertilize in late winter or early spring by topdressing with 10-
10-10 fertilizer.
8. Graded surfaces shall not be exposed without grass coverage for more than 15
days. If grades are not complete and exposure is more than 15 days, temporary
seed with rye grain at 50 lb/acre.
8. Maintenance Plan:
1 Contractor shall maintain all sedimentation and erosion control devices during
construction.
2. All devices shall be checked after each rain event and weekly. Repairs shall be
made immediately when detected.
3. Any deficiencies shall be brought to the immediate attention of the Engineer.

Christine thanks for the help and explanation. WE are working with Pat Mazzarone who owns both Mazzarone
Construction and Summerlyn Trace.
He will attend the submittal appointment for the modification when the appointment is scheduled. He and Right Angle
engineering will have a compete permit transfer application to submit then to. We think the most straight
forward process is to Transfer from Mazzarone Construction to the current land owner Summerlyn Trace. This will
allow the minor modifications to be reviewed and permit modified to the current land owner.

current property owner. If the transfer package is not complete or not available at the submittal meeting, the
modification will not be able to be accepted into the express program.
Once it is confirmed that a complete transfer package will be provided at the submittal meeting, we will be happy to

1. Project Description: The Project is proposed to be a residential town home
project 13.87 acre parcel with 78 units along Village Road. Infrastructure will include
construction of road, curb, gutter, storm drainage system, water, and sewer. The land
disturbing activity associated with.the project will consist of clearing and grubbing of
vegetation, preservation of existing trees, grading of the site, and sediment and erosion
control measures such as a silt fence, gravel construction entrance, and the wet
detention pond will function as a sediment basin. The total area which will be disturbed
for this project is 12 acres. Total impervious area will be 6.56 AC for the proposed
construction of roads, sidewalks, and residential units. This project was previously
permitted in 2007 under SW8 070103. This minor modification is a result of slight
changes to the site layout but does not exceed the permitted impervious amount or the
surface area of the permanent pool.
2. Site Description: The project site is in Brunswick County, NC, located just off
of Village Road just north of intersection of Cleatwood Road. The property on which the
development will take place is currently in the Town of Leland corporate limits.
On site soils consist mainly of Leon and Baymeade soils. These soils are mainly loamy,
fine sands. Approximately 0.2 acres of wetlands are located on the parcel and have
been submitted for approval to the USACE. No wetlands will be impacted by the project
construction.
General slope of the site is from south to north towards the rear of the site.
Land use in the vicinity is residential, light commercial, and rural agricultural.
3. Adjacent Property: The areas adjacent to the project site are residential areas
and one commercial site that is currently used for mobile home rentals.
4. Drainage Considerations: There is an existing wetland area on the property
that is connected to Mill Branch Creek. There are ditches on site that feed into the
existing wetlands.
The road will be bounded with curb and gutter to curb and tied to a collection system of
piping. All of the collection system will be directed to a proposed wet detention basin
that is sized for the 1" runoff of impervious areas. The runoff from the buildings will be
directed into the collection system and sent to the basin. The basin is sized to provide
sufficient runoff capacity filtration for the entire allowable impervious area. The wet
detention basin is to provide detention of the pre -construction and post -construction
runoff difference and meet the 90% TSS water quality requirements. The amount of
retention was based on the Type III rainfall distribution of the 25 year, 24-hour storm.
Calculations are provided.

1. Temporary Gravel Construction Entrance/Exit
To prevent sediment from leaving the site, temporary gravel construction
entrances should be installed where the access road enters the site and
instersects with Village. For dimensions and specifications, see construction
details.
2. Land Grading
The existing slope of the site is from south to north towards the front of the parcel.
Most of the disturbed areas on the site will sheet flow to the existing drainage
patterns on the site.
3. Silt Fence
Silt fence should be installed prior to clearing and grading activities. Silt fence
should. be checked routinely. If needed, silt fence should be cleaned and replaced
if damaged. See Construction Detail for dimensions and specifications.
4. Wet Detention Basin
A wet detention basin will be constructed for long term runoff pollutant control, and
this area will be used as a sediment basin during construction. Outlet control
structure with rip rap energy dissapator will be installed when basin is excavated
and 30' sodded vegetated filter will be placed after the rip rap to provide additional
filtering prior to discharge into the existing wetland.
6. Construction Schedule:
1. Obtain plan approval and other applicable permits.
2. Hold pre -construction meeting at least one week prior to beginning construction.
3. Install temporary construction entrance/exits.
4. Before clearing and grading of the site, install silt fencing, detention basin with outlet
structure, and clean and replace as necessary.
5. Begin clearing and grading of the site.
6. Install storm piping.
7. Install new roadway.
8. Sod/Seed, mulch, and tack immediately to establish proper vegetation.
9. All erosion and sediment control practices will be inspected weekly and after each
rainfall event. Needed repairs will be made immediately.
10. After the entire covered area is stabilized, all temporary measures will be removed
and permanent vegetative repairs to be completed.

1. After complete stabilization of the entire covered area, top cover soils will be
roughened by making 1 "-2" deep grooves perpendicular to the slope.
2. Spread lime (agricultural limestone) evenly over the area at a rate of 1.5 tons/acre;
spread 10-10-10 fertilizer at a rate of 1000 lb/acre and incorporate into the top 6" of
soil.
3. Loosen surface prior to applying seed.
4. Broadcast seed at recommended rates.
5. Rake seed into the soil and lightly pack to establish good contact.
6. Mulch with 4000 lb/acre grain straw or equivalent and anchor by weighted farm disc
set nearly straight or other mulch anchoring tool.
7. Mow as needed and refertilize in late winter or early spring by topdressing with 10-
10-10 fertilizer.
8. Graded surfaces shall not be exposed without grass coverage for more than 15
days. If grades are not complete and exposure is more than 15 days, temporary
seed with rye grain at 50 lb/acre.
8. Maintenance Plan:
1. Contractor shall maintain all sedimentation and erosion control devices during
construction.
2. All devices shall be checked after each rain event and weekly. Repairs shall be
made immediately when detected.
3. Any deficiencies shall be brought to the immediate attention of the Engineer.

Hey there Cameron.
Got an old one coming back to life. I talked to Christine about it last week and we think it fits into a minor modification that
we could do through express.
The original permit was SW8 070103. The project did not get constructed then, but is moving forward now. We had to
take it back through Leland TRC and had some changes to the layout and impervious amounts. Fortunately it was not
over the previous allocated amount.
Attached is express request, narrative, and site plan.
Let me know what the next available scheduling time is.
