Pursuant to G.S. 143-215.6A, a civil penalty of not more than twenty-five thousand dollars ($25,000.00) may be assessed against any person who violates or fails to act in accordance with the terms, conditions, or requirements of any permit issued pursuant to G.S. 143-215.1. If you wish to provide additional information regarding the noted violation, request technical assistance, or discuss overall compliance please respond in writing within ten (10) business days after receipt of this Notice. A review of your response will be considered along with any information provided on the submitted Monitoring Report(s). You will then be notified of any civil penalties that may be assessed regarding the violations. If no response is received in this Office within the 10-day period, a civil penalty assessment may be prepared. The Division of Water Resources may pursue enforcement action for this and any additional violations of State law. If the violations are of a continuing nature, not related to operation and/or maintenance problems, and you anticipate remedial construction activities, then you may wish to consider applying for a Special Order by Consent. Reminder: Pursuant to Permit Condition 6 in Section E, the Permittee is required to verbally notify the Regional Office as soon as possible, not to exceed 24 hours, from first knowledge of any non-compliance at the facility including limit violations, bypasses of, or failure of a treatment unit. A written report may be required within 5 days if directed by Division staff. Ms. Lowery, Thank you for responding to my voicemail yesterday regarding the attached NOV for Permit Number: NC0044423. The attached permit violation is for high turbidity in the plants effluent wastewater on 5/26/21. Since the high turbidity reading in May, ASU has taken the following steps to remediate the problem: 1. The week of June 28th 2021 ASU performed a plant shutdown in order to vacuum excavate the sludge basin. Approximately 9000 gallons of sludge and water was removed from the bottom of the sludge basin. The basin was then thoroughly pressure washed and and again pumped out. This was the first time the basin had been cleaned in at least 4 years. ASU has implemented a basin cleaning ticket into our work order system so that the basin will be cleaned yearly in the future. ASU believes that the removal of the basin sludge will serve to reduce turbidity in the wastewater. 2. ASU has also implemented a new discharge schedule to avoid running the plant during a waste water discharge. When the backwash from the plant runs into the basin, the basin water gets stirred up. ASU is now performing discharges when the plant is not running, giving the basin water approximately 20 hours to settle before the discharge is performed. We at the ASU Water Plant are highly committed to protecting the water quality of our basin, and will continue to strive for excellence in all aspects of water treatment.
