Gila Page IV ADDITIONAL FLOW OR REALLOCATION OF EXISTING FLOW 2 Additional flow:or reallocation of existing flow is avaliable to facilities that are owned by a unit of Government. Please be advised that additional flow will be allowed under an SOC amendment only in extreme circumstances. These circumstances include elimination of other discharges that are noncompliant with their NPDES Permit or continual noncompliance of the flow parameter as specified in the original SOC. These circumstances do not include failure by the facility to properly remove Infiltration and Inflow. When requesting the additional flow, the facility must include justification why this flow is needed and su rtin g documents to show what has been done to eliminate any flow problem causes (ie efforts undergone to eliminate inflow and infiltration into the plant). If the requested addtional flow is non -domestic, then the facility must be able to demonstrate the ablility to effectively treat the waste and that the waste will not adversely impact the wastewater system or its ablility to dispose of or utilize residuals. The non -domestic waste must be simular to domestic strength either before pretreatment or after pretreatment. The applicant must provide a detailed analysis of all parameters that can reasonably be expected to be containein the proposed non -domestic wastewater. The total domestic additional flow requested is zer gallons per day. The total non -domestic flow requested is zero allons per day. The total additional flow is zero gallons per day. (NOTE: Existing SOC permits 9.0 MGD monthly average) If a reallocation of existing addtional flow is needed then the facility must provide justification as to why this reallocation is needed. V. This'Amendment does not request an extension of the expiration date of the revised Special Order by Consent currently scheduled to expire on March 31, 1994. The revised SOC issued in February 1992 required constructidn to be completed by September 30, 1993. At the time this revised SOC was issued, design of the wastewater treatment plant improvements to comply with the SOC were nearly completed by Hazen & Sawyer Engineers. The design was submitted to NCDEM with Request for Authorization to Construct in April 1992, and after receiving appropriate authorization from NCDEM, bids were advertised in July and received on August 18, 1992. The contracts as.bid allowed a construction time of 11 months and was based on Hazen & Sawyer's opinion of the minimum time necessary for a qualified contractor in this work. Contracts were executed on October 14, 1992, after time was .permitted for approval of contract award was 'received from NCDEM's Construction Grahts and Loans Section. The Contractors' initial completion date; based on date of contract execution, was defined as September 20, 1993. Therefore, as of the beginning date of construction, there was less than two weeks contingency for events beyond the control of contractor before the SOC completion date. Two significant issues have impacted the contractors. beyond their control or the City's control since construction was initiated. These issues include (1) statistically abnormally wet weather during the period of November 1992 through March 1993; and (2) piping modifications required in current contracts to be compatible with plant expansion design. These two issues are explained below in detail. Wet weather delay has- been addressed to the City by Haren Construction based on rainfall between November and March. This period was a critical period in the contractor's schedule to perform pipeline installation and production concrete work and was the type work which is highly dependent bn weather. The City asked Hazen & Sawyer to critically evaluate this request based on factual comparison of actual weather *during construction to normal weather APPENDIX B -- PAGE 2 information for this season and recommend only the minimum additional time necessary to establish a legally defensible position. Hazen & Sawyer has recommended 32 additional days. Rainfall amounts between November 1992 and March 1993 in Monroe was an average 79.5% higher than statistical averages established by NOAA at Charlotte/Douglas Airport, and the spacing of rainfall events resulted in several periods of significant delays to the Contractor. Rainfall in March 1993 was 8.43 inches, or 96.2% of the highest March total on record at CLT. The piping modifications resulted from progress by Hazen & Sawyer on the design of a plant expansion from 7.0 MGD to 9.0 MGD. Upon completion of surveying and geotechnical investigation, Hazen & Sawyer identified the need to change the preliminary layout of a new aeration basin for the plant expansion, and this change conflicted with the location of several pipes to be constructed under the current contract. A change order has since been executed, with the approval of NCDEM's Construction Grafts and Loans Office, to modify the piping -to conform to the design layout of the plant expansion. The modified piping .plan has two significant advantages: (a) it substantially reduced the need for temporary plant shutdowns during the upcoming expansion construction thereby significantly reducing the risk of plant stress or upset; and (b) it yielded an overall reduction in cost to the combined two phases of construction. Haren Construction initially requested 47 days time extension to construct the modified piping, Hazen & Sawyer and the City reduced the time to 21 days through active negotiating. Hazen & Sawyer'has since advised the City that the actual impact of the modified work, based upon daily construction logs), was closer to the original 47 days initially requested. The City intends to maintain close inspection and review of the contractors' remaining work to provide the earliest possible completion date consistent with the contractor's legal rights of relief in additional time for -events beyond the contractors' control. The additional time requested in this SOC amendment is necessary to provide for the specific events defined in detail above and to assure effective administration of the completion of the construction consistent with the provisions of the construction contracts without the anticipated need .for any further SOC amendment. APPENDIX C APPLICATION FOR AN AMENDMENT TO A SPECIAL ORDER BY CONSENT CITY OF MONROE WASTEWATER TREATMENT PLANT EXPLANATION OF ACTIONS TAKEN TO AVOID NONCOMPLIANCE WITH SOC As of this date, the City of Monroe has maintained compliance with the existing SOC with the exception of the parameters listed in Appendix A. Listed violations of cadmium and lead have been corrected by industrial pretreatment control and have been in continuous compliance for the past nine months. A single monthly violation of flow in March 1993 was due to an extremely abnormal period of frequent and heavy rainfall; the City proposes in the current fiscal year to perform some I/I flow monitoring during the wetter season to determine if some sources of I/I can be cost- effectively removed. Ammonia violations in the summer of 1993 have been effectively traced to industrial wastes from the Union County sewer collection system and the City is actively pursuing a compliance schedule with the County to effectively provide permanent control. In .addition, Hazen & Sawyer completed an evaluation of ammonia in August 1993 to confirm this cause. The City has met the schedule•. for all construction activities to date in the SOC but will not meet the construction completion date of September 30, 1993 for the reasons described in detail in Appendix B. However, by this date the City does expect all yard piping to be installed, the new Centrifugal Blowers to be certified and in service, and the fine bubble diffusers to be installed, certified, and in service for one of the four aeration basins. It is possible but not certain that a second aeration basin can be complete by September 30. As these new aeration basins are phased into service one -at -a --times, the City will take maximum advantage of the new equipment fl xe ibility to optimize treatment of •the wastewater through the plant, thereby minimizing (consistent with achievable construction progress and equipment start-up "bugs" which. are the responsibility of contractors) any real effect this SOC amendment will have on plant effluent quality in the coming months. Delays in construction have been the result of weather and necessary construction piping modifications, which are explained in detail in Appendix B. The City will provide all reasonable controls .to see remaining construction completed in the shortest achievable time by the use of progress meetings and full-time inspection. The additional work items are required to accommodate and facilitate construction of the 9 mgd upgrade which is presently being designed. In most cases, failure to make the modifications proposed herein would result in unnecessary cost increases for the next construction phase. We have included the Change Order proposal as sent to us from Haren Construction Company as well as the results of our independent cost estimate. The -Contractor's price increases and time extension indicated in this change order are the final figures resulting from a lengthy period.of discussion and negotiation between Haren Construction and Hazen and Sawyer. We feel that the Contractor's revised Change Order prices are legitimate and reflective of the costs for the work. We are recommending that the net change in contract amount and time of completion be approved. Haren had originally requested 47 days time extension, but agreed to a reduced time extension of 21 days because the City mustmeet the SOC schedule. We feel that Haren Con,siruction has been extremely cooperative in these negotiations. We have obtained records that shot, the normal rainfall, and records from the City Of Monroe, NC that show their records of actual rainfall received on a monthly basis. Copies of these records are attached for your review and use in evaluating this request. In your review, you will notice that although the number of days that rain fell was -not abnormally high, the amount of rain that fell on these days was nearly double that of normal levels recorded for these same months for four months out of a six month period.. These high volume rainfalls impeded our ability of proceed with layout, excavation, and concrete pours. When these torrential downpours came, the ground and. earth took twice as long to dry to woryng conditions than if normal rainfall had been received. This has prompted this request for extending our contract completion date to 11-12-93, which would add 32 days to the existing contract total. Please be advised that additional flow will be allowed under an SOC amendment only in extreme circumstances. These circumstances include elimination of other discharges that are noncompliant with their NPDES Permit or continual noncompliance of the flow parameter as specified in the original SOC. These circumstances do not include failure by the facility to properly remove Infiltration and Inflow. When requesting the additional flow, the facility must include justification why this flow is needed and supporting documents to show what has been done to eliminate any flow problem causes (ie.efforts undergone to eliminate inflow and infiltration into the plant). This Amendment does not request an extension of the expiration date of the revised Special Order by Consent currently scheduled to expire on March 31, 1994. The revised SOC issued in February 1992 required constructidn to be completed by September 30, 1993. At the time this revised SOC was issued, design of the wastewater treatment plant improvements to comply with the SOC were nearly completed by Hazen & Sawyer Engineers. The design was submitted to NCDEM with Request for Authorization to Construct in April 1992, and after receiving appropriate authorization•from NCDEM, bids were advertised in July and received on August 18, 1992. The contracts as bid allowed a construction time of 11 months and was based on Hazen & Sawyer's opinion of the minimum time necessary for a qualified contractor in this work. Contracts were executed on October 14, 1992, after time was permitted for approval of contract award was •received from NCDEM's Construction Grahts and Loans Section. The Contractors' initial completion date; based on date of contract execution, was defined as September 20, 1993. Therefore, as of the beginning date of construction, there was less than two weeks contingency for events beyond the control of contractor before the SOC completion date. Two significant issues have impacted the contractors.beyond their control or the City's control since construction was initiated. These issues include (1) statistically abnormally wet weather during the period of November 1992 through March 1993; and (2) piping modifications required in current contracts to be compatible with plant expansion design. These two issues are explained below in detail. Wet weather delay has been addressed to the City by Haren Construction based on rainfall between November and March. This period was a critical period in the contractor's schedule to perform pipeline installation and production concrete work and was the type work which is highly dependent bn weather. The City asked Hazen & Sawyer to critically evaluate this request based on factual comparison of actual weather 'during construction to normal weather APPENDIX B - PAGE 2 information for this season and recommend only the minimum additional time necessary to establish a legally defensible position. Hazen & Sawyer has recommended 32 additional days. Rainfall amounts between November 1992 and March 1993 in Monroe was an average 79.5% higher than statistical averages established by NOAA at Charlotte/Douglas Airport, and the spacing of rainfall events resulted in several periods of significant delays to the Contractor. Rainfall in March 1993 was 8.43 inches, or 96.2% of the highest March total on record at CLT. The piping modifications resulted from progress by Hazen & Sawyer on the design of a plant expansion from 7.0 MGD to 9.0 MGD. Upon completion of surveying and geotechnical investigation, Hazen & Sawyer identified the need to change the preliminary layout of a new aeration basin for the plant expansion, and this change conflicted with the location of several pipes to be constructed under the current contract. A change order has since been executed, with the approval of NCDEM's Construction Grafrts and Loans Office, to modify the piping.to conform to the design layout of ,the plant expansion. The modified piping plan has two significant advantages: (a) it substantially reduced the need for temporary plant shutdowns 'during the upcoming expansion construction thereby significantly reducing the risk of plant stress or upset; and (b) it yielded an overall reduction in cost to the combined two phases of construction. Haren Construction initially requested 47 days time extension to construct the modified piping, Hazen & Sawyer and the City reduced the time to 21 days through active negotiating. Hazen & Sawyer has since advised the City that the actual impact of the modified work, based upon daily construction logs) was closer to the original 47 days initially requested. The Cityintends to maintain close inspection and review of the contractors' remaining work to provide the earliest possible completion date consistent with the contractor's legal rights of relief in additional time for events beyond the contractors' control. The additional time requested in this SOC amendment is necessary to provide for the specific events defined in detail above and to assure effective administration of the completion of the construction consistent with the provisions of the construction contracts without the anticipated need for any further SOC amendment. APPENDIX C APPLICATION FOR AN AMENDMENT TO A SPECIAL ORDER BY CONSENT CITY OF MONROE WASTEWATER TREATMENT PLANT EXPLANATION OF ACTIONS TAKEN TO AVOID NONCOMPLIANCE WITH SOC As of this date, the City of Monroe has maintained compliance with the existing SOC with the exception of the parameters listed in Appendix A. Listed violations of cadmium and lead have been corrected by industrial pretreatment control and have been in continuous compliance for the past nine months. A single monthly violation of flow in March 1993 was due to an extremely abnormal period of frequent and heavy rainfall; the City proposes in the current fiscal year to perform some I/I flow monitoring during the wetter season to determine if some sources of I/I can be cost- effectively removed. Ammonia violations in the summer of 1993 have been effectively traced to industrial wastes from the Union County sewer collection system and the City is actively pursuing a compliance schedule with the County to effectively provide permanent control. In .addition, Hazen & Sawyer completed an evaluation of ammonia in August 1993 to confirm this cause. The City has met the schedule for all construction activities to date in the SOC but will not meet the construction completion date of September 30, 1993 for the reasons described in detail in Appendix B. However, by this date the City does expect all yard piping to be installed,' the new Centrifugal Blowers to be certified and in service, and the fine bubble diffusers to be installed, certified, and in service for one of the four aeration basins. It is possible but not certain that a second aeration basin can be complete by September 30. As these new aeration basins are phased into service one -at -a -time, the City will take maximum advantage of the new equipment flexibility to optimize treatment of the wastewater through the plant, thereby minimizing (consistent with achievable construction progress and equipment start-up "bugs" which are the responsibility of contractors) any real effect this SOC amendment will have on plant effluent quality in the coming months. Delays in construction have been the result of weather and necessary construction piping modifications, which are explained in detail in Appendix B. The City will provide all reasonable controls to see remaining construction completed in the shortest achievable time by the use of progress meetings and full-time inspection. NC0024333 HELD BY THE CITY } OF MONROE SPECIAL ORDER BY CONSENT EMC WQ NO. 90-08 Pursuant to provisions of North Carolina General Statutes 143-215.2 and 143-215.67, this Special Order by Consent is made and entered into by the City of Monroe, hereafter referred to as the City, and the North Carolina Environmental Management Commission, an agency of the State of North Carolina created by NCGS 143B-282, and hereafter referred to as the Commission: 1. The City and the Commission hereby stipulate the following: (a) That the City holds North Carolina NPDES Permit No. NC0024333 for operation of an existing wastewater treatment works and making an outlet therefrom for treated wastewater to Richardson Creek, Class C waters of this State, in the Yadkin Pee -Dee River Basin, but is unable to comply with the final effluent limitations for Flow, BOD , NH3 as N, Cadmium, Nickel, Lead, Cyanide, and Chronic Toxicity as set forth in the Permit. Compliance will require preparation of plans and specifications for and construction and operation of additional treatment works. Compliance will also require the removal/reduction of toxic effluent constituents and effective control of industrial discharges to the treatment works through the City's approved industrial pretreatment program. (b) That noncompliance with final effluent limitations constitutes causing and contributing to pollution of the waters of this State named above, and the City is within the jurisdiction of the Commission as set forth in NCGS Chapter 143, Article 21. (c) That the City desires to cause or allow the discharge of up to 2.0 MGD of additional domestic strength wastewater to the treatment works, and that the discharge of such additional wastewater from the treatment works to the waters of this State will not result in any significant degradation in their quality or in the quality of any water ultimately receiving such discharge. Page Two (d) That the City has secured financing for planning and construction for treatment works which, when constructed and operated, will be sufficient to adequately treat the wastewater presently being discharged and the additional wastewater desired to be discharged, to the extent that the City will be able to comply with final permit effluent limitations. (e) That the City hereby waives its right to an administrative hearing authorized by NCGS 143-215.2 on the terms of this Special Order by Consent, and also hereby waives its right to seek judicial review of this Special Order by Consent as provided in NCGS 143-215.5. 2. The City, desiring to comply with conditions of the permit identified in paragraph 1(a) above, does hereby agree to do and perform all of the following: (a) Provide the Mooresville Regional Office located at Post Office Box 950, Mooresville, North Carolina 28115 with a list of flow added under this Special Order and update this list each time flow is added to the system. (b) Meet and comply with all terms and conditions of the permit except those effluent limitations identified in paragraph 1(a) above. See Attachments A, B, C, D, E and F for monitoring requirements and effluent limitations. The permittee may also be required to monitor for other parameters as deemed necessary by the Director in future permits or Administrative letters. (c) Upon execution of this Order, undertake the following activities in accordance with the indicated time schedule: 1) Begin construction by March 1,.1990. (met) 2) Attain compliance with final effluent limits for cadmium, nickel, lead and cyanide by March 31, 1991. 3) Attain compliance with final effluent limits for chronic toxicity by September 30, 1991. 4) Complete construction by February 28,1992. 5) Attain compliance with remaining Final Effluent Limits by March 31, 1992. (d) During the time in which this Special Order by Consent is effective, comply with the interim effluent limitations contained in Attachments A, B, C, D, E and F. The following reflects only the limitations that have been modified from NPDES requirements by this Order. (e) No later than 14 calendar days after any date or time identified for accomplishment of any activity listed in 2(c) above, submit to the Division Director and the Regional Office written notice of compliance or noncompliance therewith. In the case of noncompliance, the notice shall include a statement of the reason(s) for noncompliance, remedial action(s) taken, and a statement identifying the extent to which subsequent dates or times for accomplishment of listed activities may be affected. (f) Enforce the water conservation provisions of the State Building Code as it applies to new residential construction (Volume 11, Chapter IV 401.2, 401.3). (g) Enforce the pretreatment program as approved by the Director, including both categorical pretreatment standards and local limits. Identify probable constituents causative in effluent toxicity and effectively control such constituents through either industrial user permits or by additional treatment to the extent required to meet stream standards and action levels. Provide the Mooresville Regional Office with a monthly progress report relative to these activities by no later than the fifteenth (15) day of the following month. (h) In addition to completing the interim Chronic Toxicity testing requirement, complete quarterly full -range chronic toxicity tests to properly judge progress in decreasing effluent toxicity levels. The full range tests shall be performed during the months of March, June, September and December. These tests may be discontinued when the facility passes at an effluent concentration of 97%. (i) Submit a comprehensive plan of action, including activity completion dates, which will result in attaining compliance with the goals set forth in 2(c)(2) and the chronic toxicity requirements. Plan must be submitted to the Mooresville Regional office by no later than August 31, 1990. Initiate plan concurrently with its submittal as no formal approval of plan will be issued. Page Four (j) Conduct necessary sampling to preclude, or reduce to a minimum, use of default data, and complete a new headworks analysis. Submit analysis to the Pretreatment Unit in Raleigh for review, with a copy forwarded to the Mooresville Regional Office, by no later than July 31, 1990. (k) Evaluate Infiltration and Inflow problems associated with the facility and establish a program to correct these problems. (1) Use forty percent (400) of the revenue received from the one-half percent (1/2%) sales tax option for water and sewage capital outlay purposes or to retire indebtedness incurred by the municipality for these purposes. 3. The City shall pay the Commission the following stipulated penalties for failure to meet schedule dates, comply with the reporting requirements or limitations contained in Attachments A, B, C, D, E and F: 1. All reporting requirements $100.00 per day for first and schedule dates seven days, and $500.00 per day thereafter. 2. Compliance with Final $1000.00 plus $1.00 per 1000 Effluent Limits gallons based on design flow Payments shall be made by certified check, made payable to the Department of Environment, Health and Natural Resources, and shall be made within fourteen (14) days following demand by the Director. 4. In accordance with the provisions of NCGS 143-215.67(b) the Commission allows the City to accept the additional waste specified below to its waste -disposal system. 2.0 MGD of additional domestic strength wastewater. 5. This Special Order by Consent and any terms, conditions and interim effluent limitations contained herein, hereby supersede any and all previous Special Orders and Enforcement Compliance Schedule Letters, and terms, conditions, and limitations contained therein issued in connection with NPDES Permit No. NC0024333. 6. Any violation of terms of this Special Order by Consent_, including paragraph 2(c) above and Attachments A, B, C, D, E and F shall terminate Section 4 of this Order and any portion of the authorized additional waste not previously connected to the system shall not thereafter be connected until the necessary sewerage system improvements have been completed and placed in operation. There shall be no discharge of floating solids or visible foam in other than trace amounts. ATTACHMENT D Chronic Toxicity Testing Requirement The permittee shall conduct chronic toxicity tests using test procedures outlined in: 1. The North Carolina Ceriodaphnia chronic effluent bioassay procedure (North Carolina Chronic Bioassay Procedure - Revised *February, 1987) or subsequent versions. The effluent concentration defined as treatment two in the North Carolina procedure document is 97%. The permit holder shall perform monthly monitoring using this procedure to establish compliance with Special Order by Consent condition. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. All toxicity testing results required as part of this Special Order by Consent will be entered on the Effluent Discharge Monitoring Form (MR-1) for the month in which it was performed, using the appropriate parameter code, TGP3B. Additionally, DEM Form AT-1 (original) is to be sent to the following address: Attention: Environmental Sciences Branch North Carolina Division of Environmental Management Post Office Box 27687 Raleigh, North Carolina 27611-7687 Test data shall be complete and accurate and include all supporting chemical/physical measurements performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine 'must be measured and reported if employed for disinfection of the waste stream. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Environmental Management indicate potential impacts to the receiving stream, this Order may be reopened and modified to include alternate monitoring requirements. Note: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival and appropriate environmental controls, shall constitute an invalid test and will require immediate retesting. Failure to submit suitable test results will constitute a violation of Order conditions. ATTACHMENT E Chronic Toxicity Testing Requirement The effluent discharge shall at no time exhibit chronic toxicity in any two consecutive toxicity tests, using test procedures outlined in: 1. The North Carolina Ceriodaphnia chronic effluent bioassay procedure (North Carolina Chronic Bioassay Procedure - Revised *February, 1987) or subsequent version. The effluent concentration at which there may be no observable inhibition of reproduction or significant mortality is 97% (defined as treatment two in the North Carolina procedure document). The permit holder shall perform monthly monitoring using this procedure to establish compliance with the permit condition. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the month in which it was performed, using the parameter code TGP3B. Additionally, DEM form AT-1 (original) is to be sent to the following address: Attention: Environmental Sciences Branch North Carolina Division of Environmental Management Post Office Box 27687 Raleigh, North Carolina 27611-7687 Test data shall be complete and accurate and include all supporting chemical/physical measurements performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Environmental Management indicate potential impacts to the receiving stream, this permit may be reopened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such a minimum control organism survival and appropriate environmental controls, shall constitute an invalid test and will require immediate retesting (within 30 days of initial monitoring event). Failure to submit suitable test results -will constitute noncompliance with monitoring requirements. ATTACHMENT ,F The Permittee shall conduct a test for priority pollutants annually at the effluent from the treatment plant. The discharge shall be evaluated as follows: 1. A pollutant analysis of the effluent must be completed annually using EPA approved methods for the following analytic fractions: (a) purgeables (i.e., volatile organic compounds); (b) acid extractables; (c) base/neutral extractables; (d) organochlorine pesticides and PCB's (e) herbicides; and (f) metals and other inorganics. The Annual Pollutant Analysis (APA) Monitoring Requirement Reporting Form A, to be provided to all discharges affected by this monitoring requirement, describes the sampling and analysis requirements and lists chemicals to be included in the pollutant analysis. This monitoring requirement is to be referred to as the "Annual Pollutant Analysis" (APA). 2. Other significant levels of synthetic organic chemicals must be identified and approximately quantified. For the purpose of implementing this requirement, the largest 10 GC/MS peaks in each organic chemical analytic fraction (or fewer than 10, if less than 10 unidentified peaks) that occur for chemicals other than those specified on the APA Monitoring Requirement Reporting Form A should be identified and approximately quantified as stated in the APA Reporting Form A instructions. This part (item 2) of the APA monitoring requirement is to be referred to as the "10. significant peaks rule".
